Hadith 3623

قَالَ : الْحَارِثُ بْنُ مِسْكِينٍ قِرَاءَةً عَلَيْهِ وَأَنَا أَسْمَعُ ، عَنْ ابْنِ وَهْبٍ ، قَالَ : أَخْبَرَنِي سَعِيدُ بْنُ عَبْدِ الرَّحْمَنِ ، عَنْ هِشَامِ بْنِ عُرْوَةَ ، عَنْ يَحْيَى بْنِ عَبَّادِ بْنِ عَبْدِ اللَّهِ بْنِ الزُّبَيْرِ ، عَنْ جَدِّهِ ، أَنَّهُ كَانَ يَقُولُ : " ضَرَبَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَامَ خَيْبَرَ لِلزُّبَيْرِ بْنِ الْعَوَّامِ ، أَرْبَعَةَ أَسْهُمٍ سَهْمًا لِلزُّبَيْرِ ، وَسَهْمًا لِذِي الْقُرْبَى لِصَفِيَّةَ بِنْتِ عَبْدِ الْمُطَّلِبِ أُمِّ الزُّبَيْرِ ، وَسَهْمَيْنِ لِلْفَرَسِ " .
´It was narrated from Yahya bin 'Abbad bin 'Abdullah bin Az-Zubair, from his grandfather, that he used to say:` "In the year of Khaibar, the Messenger of Allah allocated four shares to Az-Zubair bin Al-'Awwam: A share of Az-Zubair, a share for the relatives of Safiyyah bint 'Abdul-Muttalib, the mother of Az-Zubair, and two shares for the horse."

(1) Hazrat Zubair radi Allahu anhu was your cousin from your paternal aunt’s side. Islamic law has established a right for the relatives of the Messenger of Allah sallallahu alayhi wa sallam in the khums (one-fifth share), so that this may serve as a substitute for zakat for them, and so that you may give gifts and presents to your relatives. This khums (one-fifth share) was separated from every war booty and kept in the public treasury (bayt al-mal), which you would use at your discretion for your noble self, your relatives, and for the welfare of the Muslims and the strengthening of their military power. ﷺ.

(2) The majority of the scholars hold the view that a horse is allotted two shares from the war booty, and a man is allotted one. Thus, a horseman receives three shares, and a foot soldier receives one share. It is narrated from Imam Abu Hanifah rahimahullah that he said: “I cannot give preference to a horse over a human,” therefore, he holds the opinion that a horse is allotted only one share. However, there is nothing of virtue in this. Besides, a horse eats more than a human—so has it become superior merely because it eats more? The reason for giving two shares to a horse is that its upkeep costs more, and it performs more work in battle than a man. A mounted soldier is many times more useful than a foot soldier, and this difference is solely due to the horse; therefore, justice demands that its share be greater than that of a man. The ahadith on this matter are explicit. Ambiguous narrations will be interpreted accordingly, and in comparison to hadith, opinion and analogy hold no significance.
