´It was narrated from Ibn 'Abbas, with regard to Allah's saying:` "And those of you who die and leave behind wives should bequeath for their wives a year's maintenance and residence without turning them out." This was abrogated by the Verse on inheritance, which allocated to her one-quarter or one-eighth. And the appointed time ('Iddah) of one year was abrogated and replaced with the ('Iddah) term of four months and ten days.
Explanation & Benefits
Hafiz Muhammad Ameen
This verse, according to Ibn Abbas radi Allahu anhu, is abrogated. However, according to some scholars, it is a form of good conduct that the husband should make a bequest (wasiyyah) that his wife should not be turned out of the house for one year, so that she does not face hardship; when she has made her own arrangements, she may move. However, this is not obligatory, nor is it obligatory for the heirs to act upon it. Since the woman's share of inheritance has been fixed, it is not necessary for the heirs to provide her expenses during the waiting period (‘iddah).
Regarding the verse: ﴿وَالَّذِينَ يُتَوَفَّوْنَ مِنْكُمْ… غَيْرَ إِخْرَاجٍ﴾ “Those among you who are about to die and their wives are alive, they should make a bequest before dying that their wives be provided for a year and not turned out of the house,” it is stated that this verse has been abrogated by the (other) verse: ﴿وَالَّذِينَ يُتَوَفَّوْنَ مِنْكُمْ… أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا﴾ “Those among you who die and their wives are alive, the wives should restrain themselves (from going out, beautifying themselves, and remarrying, etc.) for four months and ten days.”
