Hadith 3456

أَخْبَرَنِي مُحَمَّدُ بْنُ عَبْدِ الْأَعْلَى ، قَالَ : حَدَّثَنَا مُحَمَّدٌ وَهُوَ ابْنُ ثَوْرٍ ، عَنْ مَعْمَرٍ ، عَنْ الزُّهْرِيِّ ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ كَعْبِ بْنِ مَالِكٍ ، عَنْ أَبِيهِ ، قَالَ فِي حَدِيثِهِ : إِذَا رَسُولٌ مِنَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَدْ أَتَانِي ، فَقَالَ : اعْتَزِلِ امْرَأَتَكَ ، فَقُلْتُ : أُطَلِّقُهَا ؟ قَالَ : لَا ، وَلَكِنْ لَا تَقْرَبْهَا " ، وَلَمْ يَذْكُرْ فِيهِ ، الْحَقِي بِأَهْلِكِ .
´It was narrated from 'Abdur-Rahman bin Ka'b bin Malik that his father said:` "The envoy of the Messenger of Allah came to me and said: 'Keep away from your wife.' I said: 'Should I divorce her?' He said: 'No, but do not approach her.'" And he (the narrator) did not mention (the words): "Go to your family."

Explanation & Benefits

(1) It should be noted that this narration is reported from Hazrat Ka'b bin Malik radi Allahu anhu by various individuals. These include his three sons: Abdullah, Ubaydullah, and Abdur Rahman, as well as his grandson Abdur Rahman bin Abdullah. Abdur Rahman bin Abdullah sometimes narrates from Hazrat Ka'b bin Malik radi Allahu anhu through his father Abdullah, sometimes through his uncle Ubaydullah, and sometimes directly without any intermediary. However, this variation is not harmful because this hadith is established through all these chains. And Allah knows best.

(2) The repetition of this narration clarifies, and in fact resolves, some of the differences in the chain of transmission and the text, as has been attempted above. There are also several other benefits to this repetition.

Benefits and Issues:
➊ If a husband says to his wife, "Go to your family," and he intends divorce by this statement, then divorce will take place; otherwise, it will not.

➋ The incident of Ka'b ibn Malik radi Allahu anhu is a great historical event.
It can be seen in Tafsir Ibn Kathir under the noble verse of Surah At-Tawbah: (And [He also forgave] the three who were left behind...) (: al-Tawbah: 118).

(1) In Hadith 3451, Abdur Rahman bin Abdullah bin Ka'b is narrating from his grandfather Ka'b bin Malik radi Allahu anhu, and in 3452, he is narrating from his father Abdullah bin Ka'b. Both ways are correct because it is established that Abdur Rahman heard (had direct transmission) from both his father Abdullah bin Ka'b and his grandfather Ka'b bin Malik radi Allahu anhu, as Hafiz Ibn Hajar rahimahullah has indicated in Hady al-Sari. Imam Bukhari rahimahullah has brought his authentic narration with the aforementioned chain (3451). In this, Abdur Rahman has explicitly stated his hearing from his grandfather. (2) If the explicit word of divorce (talaq) is uttered, then divorce is intended, whether there is intention or not. However, there are some words by which divorce can be meant, and some other meaning can also be intended. Divorce will only take place with these words when there is the intention of divorce. These are called allusive expressions of divorce (kinayat al-talaq). The words mentioned in the hadith are also of this category. Since Ka'b radi Allahu anhu did not intend to give divorce, therefore, with these words ("Go to your house"), divorce does not take place.

(1) “Do not go near her” means not to have intercourse or the like. Speaking with the wife was not prohibited. Since Ka‘b (radi Allahu anhu) was a young man, he sensed the danger that if he remained close, intercourse or something similar might occur; therefore, he himself sent his wife to her parents’ home.

(2) “Whose repentance was accepted”: In the expedition of Tabuk, going out for jihad had become an individual obligation (fard ‘ayn), so those who did not go were questioned. The hypocrites saved themselves by lying, but the three sincere Muslims who stayed behind due to laziness admitted their mistake, did not invent any excuse, and surrendered themselves to the Messenger of Allah (sallallahu alayhi wa sallam). The Messenger of Allah (sallallahu alayhi wa sallam) ordered the entire Islamic society to boycott them; no one would even greet them, to the extent that the earth became constricted for them. Yet, they remained loyal to Allah and His Messenger. Finally, after a trial of fifty days, the command for the acceptance of their repentance was revealed and their trial ended. These noble individuals demonstrated great patience in such a severe trial and became deserving of Paradise. Their names are: Ka‘b ibn Malik, Murarah ibn Rabi‘, and Hilal ibn Umayyah (radi Allahu anhum wa ardaahum).

Yunus ibn Yazid, Ishaq ibn Rashid, Aqil ibn Khalid, and Ma'qil ibn Ubaydullah are all students of Imam al-Zuhri. Yunus, Ishaq, and Aqil have narrated this report with the chain: 'Abd al-Rahman ibn 'Abdullah ibn Ka'b from his father ('Abdullah ibn Ka'b), whereas Ma'qil has narrated it with the chain: 'Abd al-Rahman ibn 'Abdullah ibn Ka'b from his uncle ('Ubaydullah ibn Ka'b), meaning he has stated that 'Abd al-Rahman is narrating from his uncle 'Ubaydullah ibn Ka'b instead of his father 'Abdullah ibn Ka'b. However, this difference is not harmful because the narration is established through both routes. The narration of Ma'qil is the next narration.

English translation:

Like Yunus and Ishaq, Mu‘ammar is also a student of Imam Zuhri rahimahullah. He narrates this report with the chain of ‘Abdur-Rahman bin Ka‘b, that is, unlike Ma‘qil, he does not say ‘Ubaydullah bin Ka‘b.
