Hadith 3452

أَخْبَرَنَا مُحَمَّدُ بْنُ حَاتِمِ بْنِ نُعَيْمٍ ، قَالَ : حَدَّثَنَا مُحَمَّدُ بْنُ مَكِّيِّ بْنِ عِيسَى ، قَالَ : حَدَّثَنَا عَبْدُ اللَّهِ ، قَالَ : حَدَّثَنَا يُونُسُ ، عَنْ الزُّهْرِيِّ ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ عَبْدِ اللَّهِ بْنِ كَعْبِ بْنِ مَالِكٍ ، قَالَ : سَمِعْتُ كَعْبَ بْنَ مَالِكٍ , يُحَدِّثُ حَدِيثَهُ حِينَ تَخَلَّفَ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي غَزْوَةِ تَبُوكَ ، وَقَالَ فِيهِ : إِذَا رَسُولُ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَأْتِينِي ، فَقَالَ : إِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ . ح وأَخْبَرَنِي سُلَيْمَانُ بْنُ دَاوُدَ ، قَالَ : أَنْبَأَنَا ابْنُ وَهْبٍ ، عَنْ يُونُسَ ، قَالَ ابْنُ شِهَابٍ ، أَخْبَرَنِي عَبْدُ الرَّحْمَنِ بْنُ عَبْدِ اللَّهِ بْنِ كَعْبِ بْنِ مَالِكٍ ، أَنَّ عَبْدَ اللَّهِ بْنَ كَعْبِ بْنِ مَالِكٍ , قَالَ : سَمِعْتُ كَعْبَ بْنَ مَالِكٍ , يُحَدِّثُ حَدِيثَهُ حِينَ تَخَلَّفَ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي غَزْوَةِ تَبُوكَ ، وَسَاقَ قِصَّتَهُ ، وَقَالَ : إِذَا رَسُولُ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَأْتِي فَقَالَ : " إِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَأْمُرُكَ أَنْ تَعْتَزِلَ امْرَأَتَكَ ، فَقُلْتُ أُطَلِّقُهَا أَمْ مَاذَا ؟ قَالَ : لَا ، بَلِ اعْتَزِلْهَا ، فَلَا تَقْرَبْهَا ، فَقُلْتُ لِامْرَأَتِي : الْحَقِي بِأَهْلِكِ ، فَكُونِي عِنْدَهُمْ حَتَّى يَقْضِيَ اللَّهُ عَزَّ وَجَلَّ فِي هَذَا الْأَمْرِ " .
‘Abdullah bin Ka‘b bin Malik says: I heard Ka‘b bin Malik (may Allah be pleased with him) narrating his incident when he lagged behind the Messenger of Allah (peace and blessings of Allah be upon him) in the expedition of Tabuk. While narrating the mentioned story, he continues and says: The messenger of the Messenger of Allah (peace and blessings of Allah be upon him) came and said: The Messenger of Allah (peace and blessings of Allah be upon him) commands you to keep away from your wife. I said: Should I divorce her, or is there some other meaning? He (the messenger) said: No, do not divorce her, just do not go near her (remain apart from her). I said to my wife: Go to your family and stay there until Allah decides something in this matter.

(1) In Hadith 3451, Abdur Rahman bin Abdullah bin Ka'b is narrating from his grandfather Ka'b bin Malik radi Allahu anhu, and in 3452, he is narrating from his father Abdullah bin Ka'b. Both ways are correct because it is established that Abdur Rahman heard (had direct transmission) from both his father Abdullah bin Ka'b and his grandfather Ka'b bin Malik radi Allahu anhu, as Hafiz Ibn Hajar rahimahullah has indicated in Hady al-Sari. Imam Bukhari rahimahullah has brought his authentic narration with the aforementioned chain (3451). In this, Abdur Rahman has explicitly stated his hearing from his grandfather. (2) If the explicit word of divorce (talaq) is uttered, then divorce is intended, whether there is intention or not. However, there are some words by which divorce can be meant, and some other meaning can also be intended. Divorce will only take place with these words when there is the intention of divorce. These are called indirect expressions of divorce (kinayat al-talaq). The words mentioned in the hadith are also of this category. Since Ka'b radi Allahu anhu did not intend to give divorce, therefore, with these words ("Go to your house"), divorce does not take place.
