أَخْبَرَنَا مَحْمُودُ بْنُ غَيْلَانَ ، قَالَ : حَدَّثَنَا وَكِيعٌ ، قَالَ : حَدَّثَنَا سُفْيَانُ ، عَنْ عَلْقَمَةَ بْنِ مَرْثَدٍ ، عَنْ رَزِينِ بْنِ سُلَيْمَانَ الْأَحْمَرِيِّ ، عَنْ ابْنِ عُمَرَ ، قَالَ : سُئِلَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنِ الرَّجُلِ يُطَلِّقُ امْرَأَتَهُ ثَلَاثًا ، فَيَتَزَوَّجُهَا الرَّجُلُ فَيُغْلِقُ الْبَاب : وَيُرْخِي السِّتْرَ ، ثُمَّ يُطَلِّقُهَا قَبْلَ أَنْ يَدْخُلَ بِهَا ؟ قَالَ : " لَا تَحِلُّ لِلْأَوَّلِ ، حَتَّى يُجَامِعَهَا الْآخَرُ " , قَالَ أَبُو عَبْد الرَّحْمَنِ : هَذَا أَوْلَى بِالصَّوَابِ .
´It was narrated that Ibn 'Umar said:` "The Prophet was asked about a man who divorced his wife three times, then another man married her and he closed the door and drew the curtain, then divorced her before consummating the marriage with her. He said: "She is not permissible for the first one (to remarry her) until the second one has had intercourse with her.""

It is understood from this that in this issue, valid seclusion (khalwah sahihah) does not take the place of intercourse (jima‘), even though in some other matters, valid seclusion is considered equivalent to intercourse. Valid seclusion (khalwah sahihah) is when the husband and wife are alone together in privacy, and there is no legal (shar‘i), medical, or moral impediment to intercourse.

From this it is understood that merely contracting a marriage (nikah) with a second husband is not sufficient; rather, consummation (sexual intercourse) is necessary. In addition, it is also necessary that the marriage be contracted with the intention of a regular, settled marital life. Without these two conditions, she does not become lawful (halal) for the first husband.
