Hadith 33

أَخْبَرَنَا عَمْرُو بْنُ عَلِيٍّ ، قال : أَنْبَأَنَا أَزْهَرُ ، أَنْبَأَنَا ابْنُ عَوْنٍ ، عَنْ إِبْرَاهِيمَ ، عَنْ الْأَسْوَدِ ، عَنْ عَائِشَةَ ، قالت : يَقُولُونَ : إِنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَوْصَى إِلَى عَلِيٍّ " لَقَدْ دَعَا بِالطَّسْتِ لِيَبُولَ فِيهَا فَانْخَنَثَتْ نَفْسُهُ " . وَمَا أَشْعُرُ فَإِلَى مَنْ أَوْصَى ، قَالَ الشَّيْخُ : أَزْهَرُ هُوَ ابْنُ سَعْدٍ السَّمَّانُ .
´It was narrated that 'Aishah said:` "They say that the Prophet (ﷺ) made a will for 'Ali,[1] but he called for a basin in which to urinate, then he went flaccid suddenly (and died), so how could he leave a will?!" The Shaikh said: Azhar (one of the narrators) is Ibn Sa'd As-Samman. [1] Meaning, appointing him as the Khalifah.

33. Commentary:
«طست» is a type of vessel similar to a large dish, whose base is close (to the ground) and mouth is wide open. There is a likelihood of splashing when urinating in such a vessel; therefore, this chapter has been established to clarify that if one urinates carefully and no splashes occur, then there is no harm.
➋ In this hadith, the "bequest" refers to the bequest of caliphate, as is the belief of the Rawafid; for this reason, they call Ali radi Allahu anhu the "Wasi" (legatee). The intent of Aisha radi Allahu anha is that a bequest is made at the time of death, and at that time, the blessed head of the Prophet sallallahu alayhi wa sallam was in my lap. Therefore, when was the bequest made? And to whom was it made? That is, he did not make any bequest, nor did he get the opportunity to do so.

Hadith Commentary:

A bequest (wasiyyah) could only have been made in the final moments of life.
Aishah (radi Allahu anha) is denying the occurrence of a bequest at the last moment; moreover, if the Messenger of Allah (sallallahu alayhi wa sallam) had made any bequest to the people while delivering a sermon, then at least one of the Companions would have heard it.
Someone would have narrated it, whereas in the books of hadith, there is no narration or account transmitted regarding the alleged bequest.
In such circumstances, how did Ali (radi Allahu anhu) become the "legatee of the Messenger of Allah"?

Ali (radi Allahu anhu) himself has made explicit statements that there is no particular distinction for us regarding the bequest.
Ali (radi Allahu anhu) used to show his scroll, in which there were rulings about charity (sadaqat), blood money (diyat), and so on.
Even in that, there was no mention of the caliphate or similar matters.

The intent of Aisha (radi Allahu anha) is that until the Prophet’s (sallallahu alayhi wa sallam) passing, I was constantly engaged in serving him. Several days before his passing, he had already moved to my house. If he had made a bequest (wasiyyah) to Ali (radi Allahu anhu), I would certainly have known about it. Moreover, at the very moment of his passing, he was in my lap. As for a financial bequest, he did not make one at all, because he left behind no wealth. As for the bequest of the Book and the Sunnah, that was for all Muslims, not just for Ali (radi Allahu anhu). And if what is meant is the caliphate, then Ali (radi Allahu anhu) never claimed that such a bequest was made to him. Therefore, this was nothing but propaganda.

Umaymah bint Ruqayqah narrates:

«كَانَ لِلنَّبِيِّ صلی اللہ علیہ وسلم قَدَحٌ مِنْ عِيْدَانِ تَحْتَ سَرِيرِهِ يَبُولُ فيه بالليل»

“There was a wooden vessel made of date-palm under the bed of the Prophet sallallahu alayhi wa sallam, in which he would urinate at night.”

[ابوداؤد: 24، نسائي: 32، صحيح الجامع: 4832، صحيح]

Shawkani rahimahullah says: This hadith is evidence that it is permissible to keep a vessel for urination at night, and there is no difference of opinion regarding this.
