´It was narrated from 'Aishah:` "A girl came to her and said: 'My father married me to his brother's son so that he might raise his own status thereby, and I was unwilling.' She said: 'Sit here until the Prophet comes.' Then the Messenger of Allah came, and I told him (what she had said). He sent word to her father, calling him, and he left the matter up to her. She said: 'O Messenger of Allah, I accept what my father did, but I wanted to know whether women have any say in the matter.'"
Explanation & Benefits
Hafiz Muhammad Ameen
(1) From this narration, it is clearly understood that even the marriage of a virgin girl cannot be conducted by her father without her permission. If he does so and the girl is not pleased, then she has the right to contract her own marriage. If the husband is not agreeable, then for the annulment of the marriage, one will have to refer to the court or a council.
(2) “Elevate his status”—this could mean that he will be of lower standing in society, or he will not possess good character. It could also refer to financial status; he will be poor while this girl and her father will be wealthy.
(3) “I maintain (the marriage)”—it appears that the girl was indeed intelligent and virtuous. She also proved her point and preserved her father’s honor. Radi Allahu anhu wa ardaahu.
