Hadith 3008

أَخْبَرَنَا يُونُسُ بْنُ عَبْدِ الْأَعْلَى ، قَالَ : أَخْبَرَنِي أَشْهَبُ ، قَالَ : أَخْبَرَنِي مَالِكٌ , أَنَّ ابْنَ شِهَابٍ حَدَّثَهُ ، عَنْ سَالِمِ بْنِ عَبْدِ اللَّهِ ، قَالَ : كَتَبَ عَبْدُ الْمَلِكِ بْنُ مَرْوَانَ إِلَى الْحَجَّاجِ بْنِ يُوسُفَ يَأْمُرُهُ أَنْ لَا يُخَالِفَ ابْنَ عُمَرَ فِي أَمْرِ الْحَجِّ ، فَلَمَّا كَانَ يَوْمُ عَرَفَةَ ، جَاءَهُ ابْنُ عُمَرَ حِينَ زَالَتِ الشَّمْسُ وَأَنَا مَعَهُ ، فَصَاحَ عِنْدَ سُرَادِقِهِ أَيْنَ هَذَا ؟ فَخَرَجَ إِلَيْهِ الْحَجَّاجُ وَعَلَيْهِ مِلْحَفَةٌ مُعَصْفَرَةٌ ، فَقَالَ لَهُ : مَا لَكَ يَا أَبَا عَبْدِ الرَّحْمَنِ ؟ قَالَ : الرَّوَاحَ إِنْ كُنْتَ تُرِيدُ السُّنَّةَ ، فَقَالَ لَهُ هَذِهِ السَّاعَةَ ، فَقَالَ لَهُ : نَعَمْ ، فَقَالَ : أُفِيضُ عَلَيَّ مَاءً ثُمَّ أَخْرُجُ إِلَيْكَ ، فَانْتَظَرَهُ حَتَّى خَرَجَ فَسَارَ بَيْنِي وَبَيْنَ أَبِي ، فَقُلْتُ : إِنْ كُنْتَ تُرِيدُ أَنْ تُصِيبَ السُّنَّةَ ، فَأَقْصِرِ الْخُطْبَةَ وَعَجِّلِ الْوُقُوفَ ، فَجَعَلَ يَنْظُرُ إِلَى ابْنِ عُمَرَ كَيْمَا يَسْمَعَ ذَلِكَ مِنْهُ ، فَلَمَّا رَأَى ذَلِكَ ابْنُ عُمَرَ قَالَ : صَدَقَ " .
´It was narrated that Salim Bin Abdullah said:` "Abdul Malik bin Marwan wrote to Al-Hajjaj bin Yusuf telling him not to go against Ibn Umar with regard to the Hajj. On the day of Arafat, Ibn Umar came to him when the sun had passed its zenith, and I was with him, and shouted near his cotton tent: 'Where is he?' Al-Hajjaj came out to him, wearing a wrap dyed with safflower. He said: 'What is the matter, O Abu Abdur Rahman?' He said: 'We have to move on if you want to follow Sunnah.' He said to him: 'At this hour?' He said: 'Yes.' He said: 'I will pour some water over my self (have a bath) then I will come out to you.' So he waited until he came, then he walked between my father and me, I said: 'If you want to follow the Sunnah, then deliver a short Khutbah and hasten to stand (in Arafat).' He started to look at Ibn Umar so that he could hear that, and when Ibn Umar noticed that he said: 'He is speaking the truth.'"

(1) This refers to the year in which Hajjaj killed Hazrat Ibn Zubair radi Allahu anhu and took control of Makkah. The days of Hajj were near, so the caliph of the time, Abdul Malik, appointed him as the leader of Hajj, but made him bound to follow Hazrat Ibn Umar radi Allahu anhu in the matters of Hajj. This was displeasing to him. Abdul Malik was a very learned person, but his knowledge was suppressed by his rule. Hajjaj was Abdul Malik’s governor, but he was extremely oppressive and disrespectful and insolent towards the righteous. He too was a great scholar, but these faults made him infamous and detested among Muslims and the righteous until the Day of Judgment. May Allah protect us from this.

(2) “At this time?” The governors of Banu Umayyah in that era would generally perform the Zuhr prayer late, so it was surprising to him that the sermon and prayer were started immediately after the sun’s decline (zawal).

(3) “Abu Abdur Rahman” — this was the famous kunya of Hazrat Ibn Umar radi Allahu anhu. Among the Arabs, a respected person is addressed by his kunya.

(4) The brevity of the sermon is wisdom, but this does not mean it should be shorter than the prayer; rather, it means it should be shorter than ordinary sermons, because after the sermon and prayer, the standing (wuquf) at Arafah begins, in which there are remembrances, supplications, and seeking forgiveness until Maghrib. Therefore, by keeping the sermon brief, the standing will begin sooner, which is recommended (mustahabb).

(5) The ruler of the time should act upon the opinion of the people of knowledge in religious matters.

(6) A student may give a legal verdict (fatwa) in the presence of his teacher.

(7) It is permissible to pray behind a sinful (fajir) ruler.
