Hadith 2621

أَخْبَرَنَا مُحَمَّدُ بْنُ يَحْيَى بْنِ عَبْدِ اللَّهِ النَّيْسَابُورِيُّ ، قَالَ : حَدَّثَنَا سَعِيدُ بْنُ أَبِي مَرْيَمَ ، قَالَ : أَنْبَأَنَا مُوسَى بْنُ سَلَمَةَ ، قَالَ : حَدَّثَنِي عَبْدُ الْجَلِيلِ بْنُ حُمَيْد ، عَنْ ابْنِ شِهَابٍ ، عنْ أَبِي سِنَانٍ الدُّؤَلِيِّ ، عَنْ ابْنِ عَبَّاسٍ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَامَ فَقَالَ : " إِنَّ اللَّهَ تَعَالَى كَتَبَ عَلَيْكُمُ الْحَجَّ " , فَقَالَ الأَقْرَعُ بْنُ حَابِسٍ التَّمِيمِيّ : كُلُّ عَامٍ يَا رَسُولَ اللَّهِ ؟ فَسَكَتَ ، فَقَال : " لَوْ قُلْتُ نَعَمْ لَوَجَبَتْ ثُمَّ إِذًا لَا تَسْمَعُونَ وَلَا تُطِيعُونَ وَلَكِنَّهُ حَجَّةٌ وَاحِدَةٌ " .
´It was narrated from Ibn 'Abbas that the Messenger of Allah stood up and said:` Allah, Most High, has decreed Hajj for you. Al-Aqra' bin Habis At-Tamimi said: "Every year, O Messenger of Allah?" But he remained silent, then he said: "If I said yes, it would become obligatory, then you would not hear and obey. Rather it is just one Hajj."

589 Benefits and Issues:
➊ This hadith is evidence that Hajj is obligatory only once in a lifetime; anything beyond that is voluntary (nafl).
➋ In this narration, where it is mentioned that if I had declared Hajj to be obligatory every year, it would have become obligatory every year, some scholars have inferred from this that the Prophet sallallahu alayhi wa sallam could establish legal rulings (ahkam shar‘iyyah) by his own will. However, most scholars do not consider this view to be correct, and the correct position is the latter.
➌ The legislative command (tashri‘i hukm) of the Prophet sallallahu alayhi wa sallam was always dependent upon the pleasure of Allah, the Exalted and Glorious. The details of this fundamental difference are found in the books of principles (usul) and creed (‘aqidah), and mentioning them here is unnecessary.

Explanation:
Hazrat Aqra‘ bin Habis radi Allahu anhu belonged to the tribe of Tamim. After the conquest of Makkah, he was among the delegation of Banu Tamim that presented itself before the Prophet sallallahu alayhi wa sallam. He is counted among the mu’allafatu’l-qulub (those whose hearts were to be reconciled). He was the chief of his tribe both in the time of ignorance (jahiliyyah) and in Islam. He passed away during the caliphate of Hazrat Umar radi Allahu anhu.
