Hadith 2619

أَخْبَرَنَا عَمْرُو بْنُ عَلِيٍّ ، قَالَ : حَدَّثَنَا بِشْرٌ ، وَيَزِيدُ قَالَا : حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ إِسْحَاقَ ، عَنِ الزُّهْرِيِّ ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " أَمَرَ عَتَّابَ بْنَ أَسِيدٍ أَنْ يَخْرُصَ الْعِنَبَ ، فَتُؤَدَّى زَكَاتُهُ زَبِيبًا كَمَا تُؤَدَّى زَكَاةُ النَّخْلِ تَمْرًا " .
´It was narrated from Sa'eed bin Al-Musayyab:` That the Messenger of Allah told 'Attab bin Usaid to estimate the (harvest of) grapes, and to pay Zakah in raisins, just as the Zakah on date palms is given in died dates.

English Translation:

The discussion regarding zakat has already passed previously, that ‘ushr and similar dues will be collected in such a manner in which it can be stored. However, the matter requiring discussion here is: what connection does this hadith have with the chapter, when there is no mention of purchasing charity (sadaqah) in it? It could be said that when the cultivator gave ‘ushr in the form of raisins after storing grapes, it is as if he bought the grapes given in charity with the raisins. In other words, purchasing one’s own charity became permissible. In this case, the prohibition against purchasing one’s own charity in the aforementioned narrations would be for the sake of caution and as a recommended precaution (tanzih), not absolute prohibition. And Allah knows best. However, this is a rather peculiar inference. The giver merely dried the grapes given as charity and presented them as raisins; he did not exchange them for something from his own wealth such that the meaning of selling could apply in any way. The charity began with the raisins themselves. Besides, this narration is mursal. Sa‘id ibn al-Musayyib is a Tabi‘i; he has not mentioned from which Companion (radi Allahu anhu) he heard this narration. This reduces the status of the narration and renders it weak.
