Hadith 2508

أَخْبَرَنَا إِسْمَاعِيلُ بْنُ مَسْعُودٍ ، قَالَ : حَدَّثَنَا يَزِيدُ بْنُ زُرَيْعٍ ، قَالَ : أَنْبَأَنَا شُعْبَةُ ، عَنِ الْحَكَمِ بْنِ عُتَيْبَةَ ، عَنِ الْقَاسِمِ بْنِ مُخَيْمِرَةَ ، عَنْ عَمْرِو بْنِ شُرَحْبِيلَ ، عَنْ قَيْسِ بْنِ سَعْدِ بْنِ عُبَادَةَ ، قَالَ : " كُنَّا نَصُومُ عَاشُورَاءَ ، وَنُؤَدِّي زَكَاةَ الْفِطْرِ ، فَلَمَّا نَزَلَ رَمَضَانُ وَنَزَلَتِ الزَّكَاةُ ، لَمْ نُؤْمَرْ بِهِ ، وَلَمْ نُنْهَ عَنْهُ وَكُنَّا نَفْعَلُهُ " .
´It was narrated that Qais bin Sa'd bin 'Ubadah Said:` "We used to fast on 'Ashura and give Zakatul-Fitr, and when the command to fast in Ramadan was revealed, and the command to give Zakah was revealed, we were neither commanded to give it, nor told not to do so, and we used to do it."

From this narration, some individuals have argued that Sadaqat al-Fitr is no longer obligatory, whereas there is no such explicit statement in this narration, because the obligation of a new thing does not abrogate the obligation of an old thing. Nor is there any need for a new ruling for this, while in other explicit narrations its obligation is established. The obligation of zakat is from the 2nd year of Hijrah. Those who became Muslim later have mentioned its obligation, for example: Ibn Abbas radi Allahu anhu (see, Hadith: 2510, 2517). Therefore, Sadaqat al-Fitr is obligatory despite the obligation of zakat; however, the Hanafis have termed it as wajib, but in practice, there is no difference between wajib and fard. As for the fast of Ashura, it is explicitly mentioned regarding it that the Prophet sallallahu alayhi wa sallam gave the choice of observing it or not.
