1362. Commentary: Unnecessary rigidity is not correct. When there are evidences on both sides, instead of arguing and prolonging the matter, one should try to find the reason for preference. It is not appropriate to stubbornly adhere to one opinion without reason. Similarly, in those issues which remained disputed during the era of the noble Companions (radi Allahu anhum) and upon which consensus could not be reached, a verdict permitting both options should be given, provided the matter concerns permissibility and recommendation. Otherwise, in the case of a conflict between permissibility and prohibition, giving precedence to prohibition and avoidance is the cautious path. However, any issue upon which the noble Companions (radi Allahu anhum) were unanimously agreed should be firmly adhered to, because the noble Companions (radi Allahu anhum) could not have unanimously agreed upon an error.
