بَابُ جَامِعِ تَحْرِيمِ الْخَمْرِ
Comprehensive rulings on the prohibition of alcohol
Hadith 1589
حَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ زَيْدِ بْنِ أَسْلَمَ ، عَنْ ابْنِ وَعْلَةَ الْمِصْرِيِّ ، أَنَّهُ سَأَلَ عَبْدَ اللَّهِ بْنَ عَبَّاسٍ عَمَّا يُعْصَرُ مِنَ الْعِنَبِ ؟ فَقَالَ ابْنُ عَبَّاسٍ : أَهْدَى رَجُلٌ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ رَاوِيَةَ خَمْرٍ، فَقَالَ لَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَمَا عَلِمْتَ أَنَّ اللَّهَ حَرَّمَهَا "، قَالَ : لَا، فَسَارَّهُ رَجُلٌ إِلَى جَنْبِهِ، فَقَالَ لَهُ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " بِمَ سَارَرْتَهُ ؟ " فَقَالَ : أَمَرْتُهُ أَنْ يَبِيعَهَا، فَقَالَ لَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِنَّ الَّذِي حَرَّمَ شُرْبَهَا حَرَّمَ بَيْعَهَا "، فَفَتَحَ الرَّجُلُ الْمَزَادَتَيْنِ حَتَّى ذَهَبَ مَا فِيهِمَا
Sayyiduna Ibn Abbas (may Allah be pleased with both of them) said that a man brought a waterskin of wine as a gift for the Messenger of Allah (peace and blessings be upon him). The Prophet (peace and blessings be upon him) said: "Do you not know that Allah has made it unlawful?" He replied: "I did not know." A man whispered something in his ear. The Prophet (peace and blessings be upon him) asked: "What did you say?" He replied: "I told him to sell it." The Prophet (peace and blessings be upon him) said: "The One who made its drinking unlawful has also made its selling unlawful." Upon hearing this, the man opened the mouth of the waterskin and all the wine flowed out.
Hadith 1590
وَحَدَّثَنِي، عَنْ مَالِك، عَنْ إِسْحَاق بْنِ عَبْدِ اللَّهِ بْنِ أَبِي طَلْحَةَ ، عَنْ أَنَسِ بْنِ مَالِكٍ ، أَنَّهُ قَالَ : كُنْتُ أَسْقِي أَبَا عُبَيْدَةَ بْنَ الْجَرَّاحِ، وَأَبَا طَلْحَةَ الْأَنْصَارِيَّ، وَأُبَيَّ بْنَ كَعْبٍ شَرَابًا مِنْ فَضِيخٍ وَتَمْرٍ، قَالَ : فَجَاءَهُمْ آتٍ، فَقَالَ : إِنَّ " الْخَمْرَ قَدْ حُرِّمَتْ "، فَقَالَ أَبُو طَلْحَةَ : يَا أَنَسُ قُمْ إِلَى هَذِهِ الْجِرَارِ فَاكْسِرْهَا، قَالَ : فَقُمْتُ إِلَى مِهْرَاسٍ لَنَا فَضَرَبْتُهَا بِأَسْفَلِهِ حَتَّى تَكَسَّرَتْ
It is narrated from Sayyiduna Anas bin Malik (may Allah be pleased with him) that I used to serve wine made from fresh dates and dried dates to Sayyiduna Abu Ubaid bin Jarrah, Sayyiduna Abu Talha, and Sayyiduna Ubayy bin Ka'b (may Allah be pleased with them). In the meantime, a person came and said: Wine has been declared unlawful. Sayyiduna Abu Talha (may Allah be pleased with him) said: O Anas! Get up and break the pitchers. I got up and struck all the pitchers with a pestle and broke them.
Hadith 1591
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ دَاوُدَ بْنِ الْحُصَيْنِ ، عَنْ وَاقِدِ بْنِ عَمْرِو بْنِ سَعْدِ بْنِ مُعَاذٍ أَنَّهُ أَخْبَرَهُ، عَنْ مَحْمُودِ بْنِ لَبِيدٍ الْأَنْصَارِيِّ ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ حِينَ قَدِمَ الشَّامَ شَكَا إِلَيْهِ أَهْلُ الشَّامِ وَبَاءَ الْأَرْضِ وَثِقَلَهَا، وَقَالُوا : لَا يُصْلِحُنَا إِلَّا هَذَا الشَّرَابُ، فَقَالَ عُمَرُ : " اشْرَبُوا هَذَا الْعَسَلَ "، قَالُوا : لَا يُصْلِحُنَا الْعَسَلُ، فَقَالَ رَجُلٌ مِنْ أَهْلِ الْأَرْضِ : هَلْ لَكَ أَنْ نَجْعَلَ لَكَ مِنْ هَذَا الشَّرَابِ شَيْئًا لَا يُسْكِرُ ؟ قَالَ : نَعَمْ، فَطَبَخُوهُ حَتَّى ذَهَبَ مِنْهُ الثُّلُثَانِ وَبَقِيَ الثُّلُثُ، فَأَتَوْا بِهِ عُمَرَ فَأَدْخَلَ فِيهِ عُمَرُ إِصْبَعَهُ ثُمَّ رَفَعَ يَدَهُ فَتَبِعَهَا يَتَمَطَّطُ، فَقَالَ : " هَذَا الطِّلَاءُ هَذَا مِثْلُ طِلَاءِ الْإِبِلِ "، فَأَمَرَهُمْ عُمَرُ أَنْ يَشْرَبُوهُ، فَقَالَ لَهُ عُبَادَةُ بْنُ الصَّامِتِ : أَحْلَلْتَهَا وَاللَّهِ ؟ فَقَالَ عُمَرُ : " كَلَّا وَاللَّهِ، اللَّهُمَّ إِنِّي لَا أُحِلُّ لَهُمْ شَيْئًا حَرَّمْتَهُ عَلَيْهِمْ، وَلَا أُحَرِّمُ عَلَيْهِمْ شَيْئًا أَحْلَلْتَهُ لَهُمْ "
Mahmood bin Labeed Ansari narrates that when Sayyiduna Umar bin Khattab (may Allah be pleased with him) came towards Syria, people mentioned the epidemic and the heaviness of the climate, and said: Our health does not remain good without this drink. He (may Allah be pleased with him) said: Drink honey. They said: Honey does not suit us. A person said: We will prepare it in such a way that it does not intoxicate. He (may Allah be pleased with him) said: Yes. They cooked it until one third remained and two thirds evaporated, then brought it to Sayyiduna Umar (may Allah be pleased with him). He dipped his finger in it, and when it became sticky, he (may Allah be pleased with him) said: This syrup is similar to camel’s syrup. Sayyiduna Umar (may Allah be pleased with him) permitted its drinking. Sayyiduna Ubadah bin Samit (may Allah be pleased with him) said: You have made it lawful. Sayyiduna Umar (may Allah be pleased with him) said: No, by Allah! O Allah! I have never made lawful what You have made unlawful, nor made unlawful what You have made lawful.
Hadith 1592
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ نَافِعٍ ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ : أَنَّ رِجَالًا مِنْ أَهْلِ الْعِرَاقِ، قَالُوا لَهُ : يَا أَبَا عَبْدِ الرَّحْمَنِ إِنَّا نَبْتَاعُ مِنْ ثَمَرِ النَّخْلِ وَالْعِنَبِ فَنَعْصِرُهُ خَمْرًا فَنَبِيعُهَا، فَقَالَ عَبْدُ اللَّهِ بْنُ عُمَرَ : " إِنِّي أُشْهِدُ اللَّهَ عَلَيْكُمْ وَمَلَائِكَتَهُ وَمَنْ سَمِعَ مِنَ الْجِنِّ وَالْإِنْسِ، أَنِّي لَا آمُرُكُمْ أَنْ تَبِيعُوهَا وَلَا تَبْتَاعُوهَا وَلَا تَعْصِرُوهَا وَلَا تَشْرَبُوهَا وَلَا تَسْقُوهَا، فَإِنَّهَا رِجْسٌ مِنْ عَمَلِ الشَّيْطَانِ "
It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that the people of Iraq said to him: We buy dates and grapes, then make wine from them and sell it. Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) said: I bear witness before Allah, and the angels, and those who hear among the jinn and mankind, that I do not permit you to sell it, nor to buy it, nor to extract it, nor to drink it, nor to serve it, because wine is impure, the work of Satan.
