Hadith 1578
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ
ابْنِ شِهَابٍ ، عَنْ
السَّائِبِ بْنِ يَزِيدَ أَنَّهُ أَخْبَرَهُ، أَنَّ
عُمَرَ بْنَ الْخَطَّابِ خَرَجَ عَلَيْهِمْ، فَقَالَ : " إِنِّي
وَجَدْتُ مِنْ فُلَانٍ رِيحَ شَرَابٍ، فَزَعَمَ أَنَّهُ شَرَابُ الطِّلَاءِ، وَأَنَا سَائِلٌ عَمَّا شَرِبَ، فَإِنْ كَانَ يُسْكِرُ جَلَدْتُهُ " . فَجَلَدَهُ عُمَرُ الْحَدَّ تَامًّا
It is narrated from Sayyiduna Sa’ib bin Yazid (may Allah be pleased with him) that Sayyiduna Umar bin Khattab (may Allah be pleased with him) went out and said: I found the smell of wine from so-and-so (Ubaydullah, the son of Sayyiduna Umar, may Allah be pleased with him). He says, "I drank tila (grape juice boiled until it becomes thick, for example, two-thirds evaporate and one-third remains)," and I ask, "If it contains intoxication, I will administer the hadd (punishment)." Sayyiduna Umar (may Allah be pleased with him) administered the full hadd to him.
Hadith 1579
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ
ثَوْرِ بْنِ زَيْدٍ الدِّيلِيِّ ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ اسْتَشَارَ فِي الْخَمْرِ يَشْرَبُهَا الرَّجُلُ، فَقَالَ لَهُ
عَلِيُّ بْنُ أَبِي طَالِبٍ : نَرَى أَنْ
" تَجْلِدَهُ ثَمَانِينَ، فَإِنَّهُ إِذَا شَرِبَ سَكِرَ، وَإِذَا سَكِرَ هَذَى، وَإِذَا هَذَى افْتَرَى " أَوْ كَمَا قَالَ فَجَلَدَ عُمَرُ فِي الْخَمْرِ ثَمَانِينَ
It is narrated from Thawr bin Zayd that Sayyiduna Umar (may Allah be pleased with him) consulted the companions regarding the punishment for wine (khamr), because the Messenger of Allah (peace and blessings be upon him) had not fixed any specific punishment for it. Sayyiduna Ali (may Allah be pleased with him) said: In my opinion, eighty lashes are appropriate, because when a person drinks wine, he becomes intoxicated, and when he becomes intoxicated, he speaks nonsense, and when he speaks nonsense, he may abuse someone or something similar (and the punishment for abuse is eighty (80) lashes). Sayyiduna Umar (may Allah be pleased with him) then fixed eighty lashes as the punishment for wine.
Hadith 1580
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ
ابْنِ شِهَابٍ ، أَنَّهُ سُئِلَ عَنْ حَدِّ الْعَبْدِ فِي الْخَمْرِ، فَقَالَ : بَلَغَنِي أَنَّ عَلَيْهِ نِصْفَ حَدِّ الْحُرِّ فِي الْخَمْرِ .
" وَأَنَّ عُمَرَ بْنَ الْخَطَّابِ، وَعُثْمَانَ بْنَ عَفَّانَ، وَعَبْدَ اللَّهِ بْنَ عُمَرَ قَدْ جَلَدُوا عَبِيدَهُمْ نِصْفَ حَدِّ الْحُرِّ فِي الْخَمْرِ "
Ibn Shihab was asked: If a slave drinks wine, what is his punishment? He said: It has reached me that the slave receives half the punishment of a free man, and Sayyiduna Umar (may Allah be pleased with him), Sayyiduna Uthman (may Allah be pleased with him), and Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) administered half the punishment of a free man to their slaves.
Hadith 1581
وَحَدَّثَنِي، عَنْ مَالِك، عَنْ
يَحْيَى بْنِ سَعِيدٍ ، أَنَّهُ سَمِعَ
سَعِيدَ بْنَ الْمُسَيَّبِ ، يَقُولُ :
" مَا مِنْ شَيْءٍ إِلَّا اللَّهُ يُحِبُّ أَنْ يُعْفَى عَنْهُ مَا لَمْ يَكُنْ حَدًّا " . قَالَ يَحْيَى : قَالَ مَالِك : وَالسُّنَّةُ عِنْدَنَا، أَنَّ كُلَّ مَنْ شَرِبَ شَرَابًا مُسْكِرًا فَسَكِرَ أَوْ لَمْ يَسْكَرْ، فَقَدْ وَجَبَ عَلَيْهِ الْحَدُّ
Hazrat Saeed bin Musayyib used to say that there is no sin except that Allah wants it to be forgiven, except for the prescribed punishment (hadd).
Imam Malik, may Allah have mercy on him, said: In our view, the ruling is that whoever drinks such an intoxicant in which there is intoxication, then the prescribed punishment (hadd) will be applied to him, whether he became intoxicated or not.
