Hadith 1540
حَدَّثَنَا مَالِك، عَنْ
نَافِعٍ ، عَنْ
عَبْدِ اللَّهِ بْنِ عُمَرَ ، أَنَّهُ قَالَ : جَاءَتْ الْيَهُودُ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَذَكَرُوا لَهُ أَنَّ رَجُلًا مِنْهُمْ وَامْرَأَةً زَنَيَا، فَقَالَ لَهُمْ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ :
" مَا تَجِدُونَ فِي التَّوْرَاةِ فِي شَأْنِ الرَّجْمِ ؟ " فَقَالُوا : نَفْضَحُهُمْ وَيُجْلَدُونَ . فَقَالَ عَبْدُ اللَّهِ بْنُ سَلَامٍ : كَذَبْتُمْ، إِنَّ فِيهَا الرَّجْمَ . فَأَتَوْا بِالتَّوْرَاةِ، فَنَشَرُوهَا، فَوَضَعَ أَحَدُهُمْ يَدَهُ عَلَى آيَةِ الرَّجْمِ، ثُمَّ قَرَأَ مَا قَبْلَهَا وَمَا بَعْدَهَا، فَقَالَ لَهُ عَبْدُ اللَّهِ بْنُ سَلَامٍ : ارْفَعْ يَدَكَ . فَرَفَعَ يَدَهُ، فَإِذَا فِيهَا آيَةُ الرَّجْمِ، فَقَالُوا : صَدَقَ يَا مُحَمَّدُ، فِيهَا آيَةُ الرَّجْمِ، فَأَمَرَ بِهِمَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَرُجِمَا . فَقَالَ عَبْدُ اللَّهِ بْنُ عُمَرَ : فَرَأَيْتُ الرَّجُلَ يَحْنِي عَلَى الْمَرْأَةِ يَقِيهَا الْحِجَارَةَ .¤ قَالَ مَالِك : يَعْنِي يَحْنِي يُكِبُّ عَلَيْهَا حَتَّى تَقَعَ الْحِجَارَةُ عَلَيْهِ
It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that the Jews came to the Messenger of Allah (peace and blessings be upon him) and stated that a man and a woman among them had committed adultery. The Messenger of Allah (peace and blessings be upon him) asked: "What is the ruling of stoning in the Torah?" The Jews said: "Whoever among us commits adultery, we disgrace him and flog him." Sayyiduna Abdullah bin Salam (may Allah be pleased with him) said: "You are lying; stoning is in the Torah. Bring the Torah and read it." They opened the Torah, and one of them placed his hand over the verse of stoning and read the verses before and after it. Sayyiduna Abdullah bin Salam (may Allah be pleased with him) said to him: "Lift your hand." When he lifted his hand, the verse of stoning appeared. Then all the Jews said that Sayyiduna Abdullah bin Salam (may Allah be pleased with him) had spoken the truth; the verse of stoning is present. Then the Messenger of Allah (peace and blessings be upon him) ordered the stoning, and the man and woman were stoned. Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) said: "I saw the man leaning towards the woman to shield her from the stones." Imam Malik (may Allah have mercy on him) said: "That is, he would come over the woman so that the stones would fall on him and not on the woman."
Hadith 1541
حَدَّثَنِي مَالِك، عَنْ
يَحْيَى بْنِ سَعِيدٍ ، عَنْ
سَعِيدِ بْنِ الْمُسَيَّبِ ، أَنَّ رَجُلًا مِنْ أَسْلَمَ جَاءَ إِلَى أَبِي بَكْرٍ الصِّدِّيقِ، فَقَالَ لَهُ : إِنَّ الْأَخِرَ زَنَى . فَقَالَ لَهُ أَبُو بَكْرٍ : هَلْ ذَكَرْتَ هَذَا لِأَحَدٍ غَيْرِي ؟ فَقَالَ : لَا . فَقَالَ لَهُ أَبُو بَكْرٍ : فَتُبْ إِلَى اللَّهِ وَاسْتَتِرْ بِسِتْرِ اللَّهِ، فَإِنَّ اللَّهَ يَقْبَلُ التَّوْبَةَ عَنْ عِبَادِهِ . فَلَمْ تُقْرِرْهُ نَفْسُهُ حَتَّى أَتَى عُمَرَ بْنَ الْخَطَّابِ، فَقَالَ لَهُ مِثْلَ مَا قَالَ لِأَبِي بَكْرٍ، فَقَالَ لَهُ عُمَرُ مِثْلَ مَا قَالَ لَهُ أَبُو بَكْرٍ، فَلَمْ تُقْرِرْهُ نَفْسُهُ حَتَّى جَاءَ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ لَهُ : إِنَّ الْأَخِرَ زَنَى . فَقَالَ سَعِيدٌ : فَأَعْرَضَ عَنْهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ثَلَاثَ مَرَّاتٍ، كُلُّ ذَلِكَ يُعْرِضُ عَنْهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، حَتَّى إِذَا أَكْثَرَ عَلَيْهِ، بَعَثَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِلَى أَهْلِهِ، فَقَالَ :
" أَيَشْتَكِي، أَمْ بِهِ جِنَّةٌ ؟ " فَقَالُوا : يَا رَسُولَ اللَّهِ، وَاللَّهِ إِنَّهُ لَصَحِيحٌ . فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَبِكْرٌ أَمْ ثَيِّبٌ ؟ " فَقَالُوا : بَلْ ثَيِّبٌ يَا رَسُولَ اللَّهِ . فَأَمَرَ بِهِ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَرُجِمَ
It is narrated from Sa'id bin al-Musayyib that a man from the tribe of Aslam (whose name was Ma'iz bin Malik) came to Sayyiduna Abu Bakr al-Siddiq (may Allah be pleased with him) and said that this wretch (pointing to himself) has committed adultery. Sayyiduna Abu Bakr al-Siddiq (may Allah be pleased with him) said: Have you told this to anyone else? He replied: No. Sayyiduna Abu Bakr al-Siddiq (may Allah be pleased with him) said: Repent to Allah, and remain concealed in Allah's covering (i.e., do not tell anyone), for Allah, Glorified and Exalted, accepts the repentance of His servants. He was not satisfied with this, so he went to Sayyiduna Umar (may Allah be pleased with him). Sayyiduna Umar (may Allah be pleased with him) also said the same as Sayyiduna Abu Bakr (may Allah be pleased with him) had said, and gave the same answer. Still, he was not satisfied, so he went to the Messenger of Allah (peace and blessings be upon him) and said that this wretch has committed adultery. He said it three times, and each time the Messenger of Allah (peace and blessings be upon him) turned his face away from him. When he insisted greatly, the Messenger of Allah (peace and blessings be upon him) said to the people: "Is he ill or does he have madness (insanity)?" The people said: O Messenger of Allah (peace and blessings be upon him)! He is healthy. The Prophet (peace and blessings be upon him) said: "Is he married or not?" The people said: He is married. So the Prophet (peace and blessings be upon him) ordered that he be stoned, and he was stoned.
Hadith 1542
حَدَّثَنِي مَالِك، عَنْ
يَحْيَى بْنِ سَعِيدٍ ، عَنْ
سَعِيدِ بْنِ الْمُسَيَّبِ ، أَنَّهُ قَالَ : بَلَغَنِي، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ لِرَجُلٍ مِنْ أَسْلَمَ، يُقَالُ لَهُ : هَزَّالٌ : يَا هَزَّالُ،
" لَوْ سَتَرْتَهُ بِرِدَائِكَ، لَكَانَ خَيْرًا لَكَ " . قَالَ يَحْيَى بْنُ سَعِيدٍ : فَحَدَّثْتُ بِهَذَا الْحَدِيثِ فِي مَجْلِسٍ فِيهِ يَزِيدُ بْنُ نُعَيْمِ بْنِ هَزَّالٍ الْأَسْلَمِيِّ، فَقَالَ يَزِيدُ : هَزَّالٌ جَدِّي، وَهَذَا الْحَدِيثُ حَقٌّ
It is narrated from Sa'id bin al-Musayyib that the Messenger of Allah, peace and blessings be upon him, said to a man from the tribe of Aslam whose name was Hazzal: "O Hazzal! If you had concealed this matter, it would have been better for you." Yahya bin Sa'id said: I narrated this hadith in a gathering in which Yazid bin Na'eem bin Hazzal al-Aslami was present, so Yazid said: Hazzal was my grandfather, and this hadith is true.
Hadith 1543
حَدَّثَنِي مَالِك، عَنْ
ابْنِ شِهَابٍ أَنَّهُ أَخْبَرَهُ، أَنَّ رَجُلًا اعْتَرَفَ عَلَى نَفْسِهِ بِالزِّنَا عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، وَشَهِدَ عَلَى نَفْسِهِ أَرْبَعَ مَرَّاتٍ،
" فَأَمَرَ بِهِ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَرُجِمَ " . قَالَ ابْنُ شِهَابٍ : فَمِنْ أَجْلِ ذَلِكَ يُؤْخَذُ الرَّجُلُ بِاعْتِرَافِهِ عَلَى نَفْسِهِ
Ibn Shihab used to say that a man confessed to adultery during the time of the Messenger of Allah, may Allah bless him and grant him peace, and he confessed four times, so the Messenger of Allah, may Allah bless him and grant him peace, ordered that he be stoned, and he was stoned. Ibn Shihab said that for this reason, a person is held accountable for what he confesses upon himself.
Hadith 1544
حَدَّثَنِي مَالِك، عَنْ
يَعْقُوبَ بْنِ زَيْدِ بْنِ طَلْحَةَ ، عَنْ أَبِيهِ
زَيْدِ بْنِ طَلْحَةَ ، عَنْ
عَبْدِ اللَّهِ بْنِ أَبِي مُلَيْكَةَ أَنَّهُ أَخْبَرَهُ، أَنَّ امْرَأَةً جَاءَتْ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَأَخْبَرَتْهُ أَنَّهَا زَنَتْ وَهِيَ حَامِلٌ، فَقَالَ لَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ :
" اذْهَبِي حَتَّى تَضَعِي " . فَلَمَّا وَضَعَتْ جَاءَتْهُ، فَقَالَ لَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " اذْهَبِي حَتَّى تُرْضِعِيهِ " . فَلَمَّا أَرْضَعَتْهُ، جَاءَتْهُ، فَقَالَ : " اذْهَبِي فَاسْتَوْدِعِيهِ " . قَالَ : فَاسْتَوْدَعَتْهُ ثُمَّ جَاءَتْ، فَأَمَرَ بِهَا، فَرُجِمَتْ
It is narrated from Abdullah bin Abi Mulaika that a woman (from the tribe of Ghamid) came to the Messenger of Allah, peace and blessings be upon him, and said: "I have committed adultery," and she was pregnant. The Prophet, peace and blessings be upon him, said: "Come back when you have given birth." When she gave birth (to the child), she came again. The Prophet, peace and blessings be upon him, said: "Come back when you have weaned the child." Then, when she had weaned the child, she came again. The Prophet, peace and blessings be upon him, said: "Go and entrust the child to someone." (For protection and upbringing.) She entrusted the child and came again. Then the Messenger of Allah, peace and blessings be upon him, gave the order and she was stoned.
Hadith 1545
حَدَّثَنِي مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ عُتْبَةَ بْنِ مَسْعُودٍ، عَنْ أَبِي هُرَيْرَةَ، وَزَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ، أَنَّهُمَا أَخْبَرَاهُ أَنَّ رَجُلَيْنِ اخْتَصَمَا إِلَى رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَقَالَ أَحَدُهُمَا: يَا رَسُولَ اللَّهِ اقْضِ بَيْنَنَا بِكِتَابِ اللَّهِ. وَقَالَ الْآخَرُ وَهُوَ أَفْقَهُهُمَا: أَجَلْ يَا رَسُولَ اللَّهِ فَاقْضِ بَيْنَنَا بِكِتَابِ اللَّهِ. وَائْذَنْ لِي فِي أَنْ أَتَكَلَّمَ قَالَ: «تَكَلَّمْ» فَقَالَ: إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا. فَزَنَى بِامْرَأَتِهِ. فَأَخْبَرَنِي أَنَّ عَلَى ابْنِي الرَّجْمَ. فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَبِجَارِيَةٍ لِي. ثُمَّ إِنِّي سَأَلْتُ أَهْلَ الْعِلْمِ فَأَخْبَرُونِي: أَنَّ مَا عَلَى ابْنِي جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ. وَأَخْبَرُونِي أَنَّمَا الرَّجْمُ عَلَى امْرَأَتِهِ. فَقَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «أَمَا وَالَّذِي نَفْسِي بِيَدِهِ، لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللَّهِ أَمَّا غَنَمُكَ وَجَارِيَتُكَ فَرَدٌّ عَلَيْكَ» وَجَلَدَ ابْنَهُ مِائَةً. وَغَرَّبَهُ عَامًا وَأَمَرَ أُنَيْسًا الْأَسْلَمِيَّ أَنْ يَأْتِيَ امْرَأَةَ الْآخَرِ. فَإِنِ اعْتَرَفَتْ، رَجَمَهَا. فَاعْتَرَفَتْ. فَرَجَمَهَا ¤قَالَ مَالِكٌ: وَالْعَسِيفُ الْأَجِيرُ
It is narrated from Sayyiduna Abu Hurairah and Sayyiduna Zayd bin Khalid al-Juhani (may Allah be pleased with them) that two men had a dispute and came to the Messenger of Allah (peace and blessings be upon him). One said: O Messenger of Allah (peace and blessings be upon him)! Decide between us according to the Book of Allah. The other, who was more intelligent, said: Yes, O Messenger of Allah! Decide between us according to the Book of Allah, and allow me to speak. The Prophet (peace and blessings be upon him) said: "Alright, speak." He said: My son was a servant with this man, and he committed adultery with his wife. People told me that my son deserved to be stoned, so I gave a hundred sheep and a slave girl as ransom on his behalf. Then I asked the people of knowledge, and they said that my son deserved a hundred lashes and one year of exile, and stoning was for the man's wife. The Messenger of Allah (peace and blessings be upon him) said: "I will decide between you both according to the Book of Allah. Your sheep and slave girl are your property, take them back." And he ordered that his son be given a hundred lashes and exiled for one year, and he ordered Unais al-Aslami to go to the wife of the other man; if she confessed to adultery, then stone her. She confessed to adultery, and she was stoned.
Hadith 1546
حَدَّثَنِي مَالِك، عَنْ
سُهَيْلِ بْنِ أَبِي صَالِحٍ ، عَنْ
أَبِيهِ ، عَنْ
أَبِي هُرَيْرَةَ ، أَنَّ سَعْدَ بْنَ عُبَادَةَ، قَالَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : أَرَأَيْتَ
" لَوْ أَنِّي وَجَدْتُ مَعَ امْرَأَتِي رَجُلًا، أَأُمْهِلُهُ حَتَّى آتِيَ بِأَرْبَعَةِ شُهَدَاءَ ؟ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : نَعَمْ "
It is narrated from Sayyiduna Abu Huraira, may Allah be pleased with him, that Sayyiduna Sa'd bin 'Ubada, may Allah be pleased with him, said to the Messenger of Allah, peace and blessings be upon him: "If I find a man with my wife, should I give him respite until I gather four witnesses?" The Messenger of Allah, peace and blessings be upon him, said: "Yes."
Hadith 1547
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) heard from Sayyiduna Umar (may Allah be pleased with him), he said: He used to say that stoning (rajm) is in the Book of Allah, it is true. Whoever commits adultery, whether man or woman, if he is muhsan (i.e., has been married and consummated the marriage), then he will be stoned, when it is proven by four witnesses, or by pregnancy of the woman, or by confession from both the man and the woman.
Hadith 1548
حَدَّثَنِي حَدَّثَنِي مَالِك، عَنْ
يَحْيَى بْنِ سَعِيدٍ ، عَنْ
سُلَيْمَانَ بْنِ يَسَارٍ ، عَنْ
أَبِي وَاقِدٍ اللَّيْثِيِّ ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ أَتَاهُ رَجُلٌ وَهُوَ بِالشَّامِ، فَذَكَرَ لَهُ أَنَّهُ وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا، فَبَعَثَ عُمَرُ بْنُ الْخَطَّابِ، أَبَا وَاقِدٍ اللَّيْثِيَّ إِلَى امْرَأَتِهِ يَسْأَلُهَا عَنْ ذَلِكَ، فَأَتَاهَا وَعِنْدَهَا نِسْوَةٌ حَوْلَهَا، فَذَكَرَ لَهَا الَّذِي قَالَ زَوْجُهَا لِعُمَرَ بْنِ الْخَطَّابِ، وَأَخْبَرَهَا أَنَّهَا لَا تُؤْخَذُ بِقَوْلِهِ، وَجَعَلَ يُلَقِّنُهَا أَشْبَاهَ ذَلِكَ لِتَنْزِعَ، فَأَبَتْ أَنْ تَنْزِعَ وَتَمَّتْ عَلَى الْاعْتِرَافِ،
" فَأَمَرَ بِهَا عُمَرُ، فَرُجِمَتْ "
It is narrated from Abu Waqid Al-Laithi that a man came to Sayyiduna Umar (may Allah be pleased with him) while he was in Syria. The man stated that he had found a man with his wife. Umar sent Abu Waqid to go and ask the woman. He went to the woman, and there were other women sitting with her. They said to her what her husband had reported to Sayyiduna Umar (may Allah be pleased with him), and also told her that she would not be held accountable just because her husband said so. They began to teach her such things so that she would not confess, but she did not accept and confessed to adultery. Sayyiduna Umar (may Allah be pleased with him) ordered her to be stoned, and she was stoned. (It is understood from this that a person is held accountable for what he confesses to himself.)
Hadith 1549
حَدَّثَنِي مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، أَنَّهُ سَمِعَهُ يَقُولُ: لَمَّا صَدَرَ عُمَرُ بْنُ الْخَطَّابِ، مِنْ مِنًى أَنَاخَ بِالْأَبْطَحِ ثُمَّ كَوَّمَ كَوْمَةً بَطْحَاءَ ثُمَّ طَرَحَ عَلَيْهَا رِدَاءَهُ. وَاسْتَلْقَى. ثُمَّ مَدَّ يَدَيْهِ إِلَى السَّمَاءِ فَقَالَ: «اللَّهُمَّ كَبِرَتْ سِنِّي، وَضَعُفَتْ قُوَّتِي، وَانْتَشَرَتْ رَعِيَّتِي، فَاقْبِضْنِي إِلَيْكَ غَيْرَ مُضَيِّعٍ، وَلَا مُفَرِّطٍ» ثُمَّ قَدِمَ الْمَدِينَةَ فَخَطَبَ النَّاسَ. فَقَالَ: «أَيُّهَا النَّاسُ قَدْ سُنَّتْ لَكُمُ السُّنَنُ. وَفُرِضَتْ لَكُمُ الْفَرَائِضُ. وَتُرِكْتُمْ عَلَى الْوَاضِحَةِ. إِلَّا أَنْ تَضِلُّوا بِالنَّاسِ يَمِينًا وَشِمَالًا». وَضَرَبَ بِإِحْدَى يَدَيْهِ عَلَى الْأُخْرَى ". ثُمَّ قَالَ: «إِيَّاكُمْ أَنْ تَهْلِكُوا عَنْ آيَةِ الرَّجْمِ». أَنْ يَقُولَ قَائِلٌ لَا نَجِدُ حَدَّيْنِ فِي كِتَابِ اللَّهِ. فَقَدْ رَجَمَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ وَرَجَمْنَا. وَالَّذِي نَفْسِي بِيَدِهِ، لَوْلَا أَنْ يَقُولَ النَّاسُ: زَادَ عُمَرُ بْنُ الْخَطَّابِ فِي كِتَابِ اللَّهِ تَعَالَى لَكَتَبْتُهَا - الشَّيْخُ وَالشَّيْخَةُ فَارْجُمُوهُمَا أَلْبَتَّةَ - فَإِنَّا قَدْ قَرَأْنَاهَا
It is narrated from Hazrat Sa'id bin al-Musayyib that when Sayyiduna Umar (may Allah be pleased with him) returned from Mina (this was his last Hajj in 23 Hijri), he made his camel sit down at Abtah (a place near Makkah also called Muhassab), and made a pile of pebbles on one side, spread his sheet over himself, and lay down on his back (using the pile of pebbles as a pillow). Then he raised both hands towards the sky and said: O Lord! My life has become long, my strength has diminished, and my subjects have spread far and wide (meaning the caliphate and government have spread to many lands, and people in distant places have become subjects), so now take me to Yourself in such a state that I do not neglect Your commands, nor fall short in worship. Then he came to Madinah and delivered a sermon to the people. He said: O people! All the ways have become clear, and all the obligations have been prescribed, and you have been set upon a straight and clear path, but beware lest you go astray to the right or left. And he struck one hand upon the other, then said: Do not forget the verse of Rajm (stoning), lest someone say, "We do not find two punishments in the Book of Allah." Behold, the Messenger of Allah (peace and blessings be upon him) carried out Rajm, and we also carried out Rajm after him. By the One in Whose hand is my soul, if people did not say that Umar (may Allah be pleased with him) had added to the Book of Allah, I would have written this verse in the Qur'an «الشَّيْخُ وَالشَّيْخَةُ فَارْجُمُوهُمَا أَلْبَتَّةَ» that is: "When a married man and a married woman commit adultery, stone them." We have recited this verse. (Then its recitation was discontinued, but its ruling remains until the Day of Judgment.)
Hadith 1549B1
Saeed bin Musayyib said that not even the month of Dhu al-Hijjah had passed when Sayyiduna Umar, may Allah be pleased with him, was killed. (At the hands of Firoz the Magian; Allah, Glorified and Exalted is He, accepted the supplication of Sayyiduna Umar, may Allah be pleased with him, and granted him the rank of martyrdom.)
Hadith 1550
وَحَدَّثَنِي وَحَدَّثَنِي مَالِك أَنَّهُ بَلَغَهُ، أَنَّ عُثْمَانَ بْنَ عَفَّانَ أُتِيَ بِامْرَأَةٍ قَدْ وَلَدَتْ فِي سِتَّةِ أَشْهُرٍ، فَأَمَرَ بِهَا أَنْ تُرْجَمَ، فَقَالَ لَهُ عَلِيُّ بْنُ أَبِي طَالِبٍ : " لَيْسَ ذَلِكَ عَلَيْهَا، إِنَّ اللَّهَ تَبَارَكَ وَتَعَالَى، يَقُولُ فِي كِتَابِهِ : وَحَمْلُهُ وَفِصَالُهُ ثَلاثُونَ شَهْرًا سورة الأحقاف آية 15، وَقَالَ : وَالْوَالِدَاتُ يُرْضِعْنَ أَوْلادَهُنَّ حَوْلَيْنِ كَامِلَيْنِ لِمَنْ أَرَادَ أَنْ يُتِمَّ الرَّضَاعَةَ سورة البقرة آية 233، فَالْحَمْلُ يَكُونُ سِتَّةَ أَشْهُرٍ، فَلَا رَجْمَ عَلَيْهَا " . فَبَعَثَ عُثْمَانُ بْنُ عَفَّانَ فِي أَثَرِهَا، فَوَجَدَهَا قَدْ رُجِمَتْ
It reached Imam Malik (may Allah have mercy on him) that a woman came to Sayyiduna Uthman (may Allah be pleased with him) whose child was born in six months, and he ordered her to be stoned. Sayyiduna Ali (may Allah be pleased with him) said that she cannot be stoned; Allah, the Glorious and Exalted, says in His Book: "The bearing of the child and his weaning is thirty months," and in another place He says: "Mothers shall suckle their children for two whole years for those who wish to complete the period of suckling." So the pregnancy is six months; for this reason, there is no stoning. When Sayyiduna Uthman (may Allah be pleased with him) heard this, he sent people after the woman (so that she would not be stoned), but when they looked, she had already been stoned.
Hadith 1551
حَدَّثَنِي مَالِك، أَنَّهُ سَأَلَ ابْنَ شِهَابٍ عَنِ الَّذِي يَعْمَلُ عَمَلَ قَوْمِ لُوطٍ ؟ فَقَالَ ابْنُ شِهَابٍ : " عَلَيْهِ الرَّجْمُ أَحْصَنَ أَوْ لَمْ يُحْصِنْ "
Imam Malik, may Allah have mercy on him, asked Ibn Shihab: What is the ruling for one who commits sodomy? Ibn Shihab said that he should be stoned, whether he is married or unmarried.
