Hadith 1534
وَحَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ عُمَرَ بْنِ حُسَيْنٍ مَوْلَى عَائِشَةَ بِنْتِ قُدَامَةَ، أَنَّ عَبْدَ الْمَلِكِ بْنَ مَرْوَانَ " أَقَادَ وَلِيَّ رَجُلٍ مِنْ رَجُلٍ قَتَلَهُ بِعَصًا فَقَتَلَهُ وَلِيُّهُ بِعَصًا " .
A man killed another with a stick. Abdul Malik bin Marwan handed the killer over to the heir of the murdered man, and he also killed him with a stick.
Hadith 1534B1
قَالَ مَالِك : وَالْأَمْرُ الْمُجْتَمَعُ عَلَيْهِ الَّذِي لَا اخْتِلَافَ فِيهِ عِنْدَنَا، أَنَّ الرَّجُلَ إِذَا ضَرَبَ الرَّجُلَ بِعَصًا أَوْ رَمَاهُ بِحَجَرٍ أَوْ ضَرَبَهُ عَمْدًا فَمَاتَ مِنْ ذَلِكَ، فَإِنَّ ذَلِكَ هُوَ الْعَمْدُ وَفِيهِ الْقِصَاصُ .
Imam Malik, may Allah have mercy on him, said: In our view, this ruling is agreed upon that if a person intentionally strikes someone with a stick or a stone and he is killed, then retribution (qisas) will be taken.
Hadith 1534B2
قَالَ مَالِك : فَقَتْلُ الْعَمْدِ عِنْدَنَا أَنْ يَعْمِدَ الرَّجُلُ إِلَى الرَّجُلِ فَيَضْرِبَهُ حَتَّى تَفِيظَ نَفْسُهُ، وَمِنَ الْعَمْدِ أَيْضًا أَنْ يَضْرِبَ الرَّجُلُ الرَّجُلَ فِي النَّائِرَةِ تَكُونُ بَيْنَهُمَا ثُمَّ يَنْصَرِفُ عَنْهُ وَهُوَ حَيٌّ، فَيُنْزَى فِي ضَرْبِهِ فَيَمُوتُ فَتَكُونُ فِي ذَلِكَ الْقَسَامَةُ .
Imam Malik, may Allah have mercy on him, said: In our view, intentional murder is when a person deliberately kills another until his life departs, and it is also intentional murder if a person has enmity with another, strikes him once and leaves while he is still alive, and afterwards he dies from that same blow; in this case, qasamah will be obligatory.
Hadith 1534B3
قَالَ مَالِك : الْأَمْرُ عِنْدَنَا، أَنَّهُ يُقْتَلُ فِي الْعَمْدِ الرِّجَالُ الْأَحْرَارُ بِالرَّجُلِ الْحُرِّ الْوَاحِدِ، وَالنِّسَاءُ بِالْمَرْأَةِ كَذَلِكَ، وَالْعَبِيدُ بِالْعَبْدِ كَذَلِكَ
Imam Malik, may Allah have mercy on him, said: In the case of intentional murder, several free persons will be killed in place of one free person if all are partners in the killing; similarly, the same ruling will apply to women and slaves.
