Imam Malik, may Allah have mercy on him, said: In our view, this ruling is agreed upon that if a person intentionally strikes someone with a stick or a stone and he is killed, then retribution (qisas) will be taken.
Imam Malik, may Allah have mercy on him, said: In our view, intentional murder is when a person deliberately kills another until his life departs, and it is also intentional murder if a person has enmity with another, strikes him once and leaves while he is still alive, and afterwards he dies from that same blow; in this case, qasamah will be obligatory.
