Hadith 1532
وَحَدَّثَنِي وَحَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ
يَحْيَى بْنِ سَعِيدٍ ، عَنْ
سَعِيدِ بْنِ الْمُسَيَّبِ ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ قَتَلَ نَفَرًا خَمْسَةً أَوْ سَبْعَةً بِرَجُلٍ وَاحِدٍ قَتَلُوهُ قَتْلَ غِيلَةٍ، وَقَالَ
عُمَرُ :
" لَوْ تَمَالَأَ عَلَيْهِ أَهْلُ صَنْعَاءَ لَقَتَلْتُهُمْ جَمِيعًا "
It is narrated from Sa'id bin al-Musayyib that Sayyiduna Umar, may Allah be pleased with him, killed five or seven men in retaliation for one person; they had deceived and killed him. Then Sayyiduna Umar, may Allah be pleased with him, said: If all the people of Sana'a had participated in his killing, I would have killed them all.
Hadith 1533
Umm al-Mu'mineen Sayyidah Hafsah (may Allah be pleased with her) killed a slave woman who had performed magic on her, and previously she (may Allah be pleased with her) had made her a mudabbirah, then she ordered her to be killed, so she was killed.
Hadith 1533B1
قَالَ مَالِك : السَّاحِرُ الَّذِي يَعْمَلُ السِّحْرَ وَلَمْ يَعْمَلْ ذَلِكَ لَهُ غَيْرُهُ، هُوَ مَثَلُ الَّذِي قَالَ اللَّهُ تَبَارَكَ وَتَعَالَى فِي كِتَابِهِ : وَلَقَدْ عَلِمُوا لَمَنِ اشْتَرَاهُ مَا لَهُ فِي الآخِرَةِ مِنْ خَلاقٍ سورة البقرة آية 102، فَأَرَى أَنْ يُقْتَلَ ذَلِكَ إِذَا عَمِلَ ذَلِكَ هُوَ نَفْسُهُ
Imam Malik, may Allah have mercy on him, said that whoever knows magic and practices it, it is appropriate to kill him.
