Hadith 1521
وَحَدَّثَنِي يَحْيَى، عَنْ مَالِك أَنَّهُ بَلَغَهُ، أَنَّ عُمَرَ بْنَ عَبْدِ الْعَزِيزِ " قَضَى أَنَّ دِيَةَ الْيَهُودِيِّ أَوِ النَّصْرَانِيِّ إِذَا قُتِلَ أَحَدُهُمَا مِثْلُ نِصْفِ دِيَةِ الْحُرِّ الْمُسْلِمِ " . قَالَ مَالِك : الْأَمْرُ عِنْدَنَا أَنْ لَا يُقْتَلَ مُسْلِمٌ بِكَافِرٍ، إِلَّا أَنْ يَقْتُلَهُ مُسْلِمٌ قَتْلَ غِيلَةٍ فَيُقْتَلُ بِهِ .
Hazrat Umar bin Abdul Aziz said that the blood money (diyah) of a Jew or a Christian is half of the blood money of a free Muslim.
Imam Malik, may Allah have mercy on him, said: According to us, the ruling is that no Muslim will be killed in retaliation for a disbeliever, except when the Muslim kills him deceitfully by trickery, then he will be killed.
Hadith 1522
Sulaiman bin Yasar used to say that the blood money (diyah) of a Magian (Persian fire-worshipper) is eight hundred dirhams.

قَالَ مَالِك : وَهُوَ الْأَمْرُ عِنْدَنَا . قَالَ مَالِك : وَجِرَاحُ الْيَهُودِيِّ وَالنَّصْرَانِيِّ وَالْمَجُوسِيِّ فِي دِيَاتِهِمْ عَلَى حِسَابِ جِرَاحِ الْمُسْلِمِينَ فِي دِيَاتِهِمُ الْمُوضِحَةُ نِصْفُ عُشْرِ دِيَتِهِ، وَالْمَأْمُومَةُ ثُلُثُ دِيَتِهِ، وَالْجَائِفَةُ ثُلُثُ دِيَتِهِ، فَعَلَى حِسَابِ ذَلِكَ جِرَاحَاتُهُمْ كُلُّهَا
Imam Malik, may Allah have mercy on him, said: This is the ruling according to us. Imam Malik, may Allah have mercy on him, said: The blood money for the wounds of a Jew or a Christian is according to this calculation: for a "mudhiha" (a wound exposing the bone), one twentieth part; and for "mamuma" (a head wound reaching the membrane) and "jaifa" (a wound reaching the body cavity), one third part «(وقس على هذا)».
