بَابُ جَامِعِ عَقْلِ الْأَسْنَانِ
Comprehensive Chapter on Compensation for Teeth
Hadith 1514
وَحَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، عَنْ زَيْدِ بْنِ أَسْلَمَ، عَنْ مُسْلِمِ بْنِ جُنْدُبٍ، عَنْ أَسْلَمَ مَوْلَى عُمَرَ بْنِ الْخَطَّابِ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ، «قَضَى فِي الضِّرْسِ بِجَمَلٍ، وَفِي التَّرْقُوَةِ بِجَمَلٍ، وَفِي الضِّلَعِ بِجَمَلٍ»
Sayyiduna Umar bin Khattab (may Allah be pleased with him) ordered one camel for a molar tooth, one camel for a collarbone, and one camel for a rib bone.
Hadith 1515
وَحَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، أَنَّهُ سَمِعَ سَعِيدَ بْنَ الْمُسَيِّبِ يَقُولُ: «قَضَى عُمَرُ بْنُ الْخَطَّابِ فِي الْأَضْرَاسِ بِبَعِيرٍ بَعِيرٍ»، وَقَضَى مُعَاوِيَةُ بْنُ أَبِي سُفْيَانَ فِي الْأَضْرَاسِ بِخَمْسَةِ أَبْعِرَةٍ خَمْسَةِ أَبْعِرَةٍ. قَالَ سَعِيدُ بْنُ الْمُسَيِّبِ: «فَالدِّيَةُ تَنْقُصُ فِي قَضَاءِ عُمَرَ بْنِ الْخَطَّابِ، وَتَزِيدُ فِي قَضَاءِ مُعَاوِيَةَ، فَلَوْ كُنْتُ أَنَا لَجَعَلْتُ فِي الْأَضْرَاسِ بَعِيرَيْنِ بَعِيرَيْنِ، فَتِلْكَ الدِّيَةُ سَوَاءٌ، وَكُلُّ مُجْتَهِدٍ مَأْجُورٌ»
Said ibn al-Musayyib said: Sayyiduna Umar ibn al-Khattab (may Allah be pleased with him) ordered one camel for each molar, and Sayyiduna Muawiyah (may Allah be pleased with him) ordered five camels for each molar. So Sayyiduna Umar (may Allah be pleased with him) reduced the blood money, and Sayyiduna Muawiyah (may Allah be pleased with him) increased it. If it were up to me, I would have given two camels for each molar; in this way, the blood money would be completed.
Hadith 1516
وَحَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، أَنَّهُ كَانَ يَقُولُ: «إِذَا أُصِيبَتِ السِّنُّ فَاسْوَدَّتْ فَفِيهَا عَقْلُهَا تَامًّا، فَإِنْ طُرِحَتْ بَعْدَ أَنْ تَسْوَدَّ فَفِيهَا عَقْلُهَا أَيْضًا تَامًّا»
Hazrat Saeed bin Musayyib used to say that when a tooth is struck and it turns black, the full compensation (diyah) will be obligatory; if it turns black and then falls out, even then the full compensation will be obligatory.
