Hadith 1506
حَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ
ابْنِ شِهَابٍ ، عَنْ
سَعِيدِ بْنِ الْمُسَيَّبِ ، أَنَّهُ كَانَ يَقُولُ فِي الشَّفَتَيْنِ :
" الدِّيَةُ كَامِلَةً فَإِذَا قُطِعَتِ السُّفْلَى فَفِيهَا ثُلُثَا الدِّيَة " .
Hazrat Saeed bin Musayyib used to say that there is a full diyah (blood money) for both lips; if only the lower lip is cut off, then one-third diyah will be given.
Hadith 1507
حَدَّثَنِي يَحْيَى، عَنْ مَالِك، أَنَّهُ سَأَلَ ابْنَ شِهَابٍ : عَنِ الرَّجُلِ الْأَعْوَرِ يَفْقَأُ عَيْنَ الصَّحِيحِ ؟ فَقَالَ ابْنُ شِهَابٍ : " إِنْ أَحَبَّ الصَّحِيحُ أَنْ يَسْتَقِيدَ مِنْهُ فَلَهُ الْقَوَدُ، وَإِنْ أَحَبَّ فَلَهُ الدِّيَةُ أَلْفُ دِينَارٍ أَوِ اثْنَا عَشَرَ أَلْفَ دِرْهَمٍ " .
Imam Malik, may Allah have mercy on him, said: I asked Ibn Shihab, "If a one-eyed person puts out the eye of a good man, what should be done?" He said: He has the choice, whether to put out the eye of the one-eyed person or to take blood money—one thousand dinars or twelve thousand dirhams.
Hadith 1507B1
وحَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ أَنَّهُ بَلَغَهُ «أَنَّ فِي كُلِّ زَوْجٍ مِنَ الْإِنْسَانِ الدِّيَةَ كَامِلَةً، وَأَنَّ فِي اللِّسَانِ الدِّيَةَ كَامِلَةً، وَأَنَّ فِي الْأُذُنَيْنِ إِذَا ذَهَبَ سَمْعُهُمَا الدِّيَةَ كَامِلَةً اصْطُلِمَتَا، أَوْ لَمْ تُصْطَلَمَا، وَفِي ذَكَرِ الرَّجُلِ الدِّيَةُ كَامِلَةً، وَفِي الْأُنْثَيَيْنِ الدِّيَةُ كَامِلَةً» ¤
Imam Malik, may Allah have mercy on him, received the information that indeed, for every pair (of limbs) of a person, in case of their destruction, there is full blood money (diyah). And for the tongue, there is full diyah; for both ears, when their hearing is lost, there is full diyah, whether they are cut off or not; for the male genital organ (if cut off), there is also full diyah, and for the two testicles (both of a man), there is also full diyah.
Hadith 1507B2
وَحَدَّثَنِي يَحْيَى، عَنْ مالِكٍ، أَنَّهُ بَلَغَهُ «أَنَّ فِي ثَدْيَيِ الْمَرْأَةِ الدِّيَةَ كَامِلَةً». قَالَ مَالِكٌ: «وَأَخَفُّ ذَلِكَ عِنْدِي الْحَاجِبَانِ، وَثَدْيَا الرَّجُلِ». ¤
Imam Malik (may Allah have mercy on him) received the information that there is full blood money (diyah) for (cutting off) both breasts of a woman.
Imam Malik (may Allah have mercy on him) said: In my view, the matter of the eyebrows and both (testicles) of a man is lighter than this.
Hadith 1507B3
قَالَ مَالِكٌ: «الْأَمْرُ عِنْدَنَا أَنَّ الرَّجُلَ إِذَا أُصِيبَ مِنْ أَطْرَافِهِ أَكْثَرُ مِنْ دِيَتِهِ، فَذَلِكَ لَهُ إِذَا أُصِيبَتْ يَدَاهُ وَرِجْلَاهُ وَعَيْنَاهُ، فَلَهُ ثَلَاثُ دِيَاتٍ». ¤
Imam Malik, may Allah have mercy on him, said: Our ruling here is that if so much damage is inflicted on a man's limbs that (if the separate blood money for each is considered) it exceeds the blood money for his (own life) (i.e., one hundred camels), then (the separate blood money for all the limbs) will be given to him. Thus, for example, if both hands, both feet, and both eyes of a man are destroyed, then there will be three (full) blood monies for him.
Hadith 1507B4
قَالَ مَالِكٌ: «فِي عَيْنِ الْأَعْوَرِ الصَّحِيحَةِ إِذَا فُقِئَتْ خَطَأً إِنَّ فِيهَا الدِّيَةَ كَامِلَةً»
Imam Malik, may Allah have mercy on him, said regarding the sound eye of a one-eyed person: If it is accidentally destroyed, then undoubtedly there is full blood money (diyah) for it.
