بَابُ مَا جَاءَ فِي دِيَةِ الْعَمْدِ ، إِذَا قُبِلَتْ وَجِنَايَةِ الْمَجْنُونِ
What is reported about blood money for intentional murder if accepted, and the crime of the insane
Hadith 1496
حَدَّثَنِي يَحْيَى، عَنْ مَالِك، أَنَّ ابْنَ شِهَابٍ، كَانَ يَقُولُ فِي دِيَةِ الْعَمْدِ : " إِذَا قُبِلَتْ خَمْسٌ وَعِشْرُونَ بِنْتَ مَخَاضٍ، وَخَمْسٌ وَعِشْرُونَ بِنْتَ لَبُونٍ، وَخَمْسٌ وَعِشْرُونَ حِقَّةً، وَخَمْسٌ وَعِشْرُونَ جَذَعَةً "
Ibn Shihab used to say regarding intentional murder that when the heirs of the slain agree to accept blood money, then the blood money will be twenty-five bint makhad, twenty-five bint labun, twenty-five hiqqah, and twenty-five jaz’ah.
Hadith 1497
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ يَحْيَى بْنِ سَعِيدٍ ، أَنَّ مَرْوَانَ بْنَ الْحَكَمِ كَتَبَ إِلَى مُعَاوِيَةَ بْنِ أَبِي سُفْيَانَ : أَنَّهُ أُتِيَ بِمَجْنُونٍ قَتَلَ رَجُلًا، فَكَتَبَ إِلَيْهِ مُعَاوِيَةُ : " أَنِ اعْقِلْهُ وَلَا تُقِدْ مِنْهُ فَإِنَّهُ لَيْسَ عَلَى مَجْنُونٍ قَوَدٌ " .
It is narrated from Yahya bin Saeed that Marwan bin Hakam wrote to Muawiyah bin Abi Sufyan that a madman has been brought to me who has killed a person. Muawiyah wrote in reply that imprison him and do not take retribution from him, because retribution is not applicable to a madman.
Hadith 1497B1
قَالَ مَالِك، فِي الْكَبِيرِ وَالصَّغِيرِ إِذَا قَتَلَا رَجُلًا جَمِيعًا عَمْدًا : أَنَّ عَلَى الْكَبِيرِ أَنْ يُقْتَلَ، وَعَلَى الصَّغِيرِ نِصْفُ الدِّيَةِ . قَالَ مَالِك : وَكَذَلِكَ الْحُرُّ وَالْعَبْدُ يَقْتُلَانِ الْعَبْدَ فَيُقْتَلُ الْعَبْدُ وَيَكُونُ عَلَى الْحُرِّ نِصْفُ قِيمَتِهِ
Imam Malik, may Allah have mercy on him, said that if an adult and a minor together intentionally kill a person, then retribution (qisas) will be taken from the adult, and half of the blood money (diyah) will be obligatory upon the minor.
Imam Malik, may Allah have mercy on him, said that similarly, if a free person and a slave together intentionally kill a slave, then the slave will be killed in retribution, and the free person will be liable for half the value of that slave.
