Hadith 1492
عَنْ مَالِكٍ أَنَّهُ بَلَغَهُ، أَنَّ عُرْوَةَ بْنَ الزُّبَيْرِ كَانَ يَقُولُ فِي وَلَدِ الْمُلَاعَنَةِ وَوَلَدِ الزِّنَا إِنَّهُ إِذَا مَاتَ وَرِثَتْهُ أُمُّهُ، حَقَّهَا فِي كِتَابِ اللّٰهِ عَزَّ وَجَلَّ. وَإِخْوَتُهُ لِأُمِّهِ حُقُوقَهُمْ، وَيَرِثُ الْبَقِيَّةَ، مَوَالِي أُمِّهِ. إِنْ كَانَتْ مَوْلَاةً. وَإِنْ كَانَتْ عَرَبِيَّةً، وَرِثَتْ حَقَّهَا، وَوَرِثَ إِخْوَتُهُ لِأُمِّهِ حُقُوقَهُمْ، وَكَانَ مَا بَقِيَ لِلْمُسْلِمِينَ. ¤
It reached Imam Malik (may Allah have mercy on him) that Urwah bin Zubair used to say that the child of a woman involved in li'an or the child of adultery, when he dies, his mother will receive her share according to the Book of Allah, and his maternal brothers will also receive their shares. The remainder will go to the mawali of his mother if she was a freed slave, and if she was an Arab woman, then after the shares of the mother and siblings, whatever remains will be the right of the Muslims.
Hadith 1493
قَالَ مَالِكٌ : وَبَلَغَنِي عَنْ سُلَيْمَانَ بْنِ يَسَارٍ مِثْلُ ذَلِكَ. وَعَلَى ذَلِكَ أَدْرَكْتُ أَهْلَ الْعِلْمِ بِبَلَدِنَا.
Imam Malik, may Allah have mercy on him, also reported to me from Sulayman bin Yasar in the same way, and this is also the opinion of the scholars of our city.
