Hadith 1486
It is narrated from Sayyiduna Usama bin Zaid that the Messenger of Allah, peace and blessings be upon him, said: "A Muslim does not inherit from a disbeliever."
Hadith 1487
It is narrated from Hazrat Ali bin Husayn, that is, Imam Zain al-Abidin, he said: When Abu Talib died, his heirs were Aqil and Talib(1), and Sayyiduna Ali (may Allah be pleased with him) was not his heir(2). Ali bin Husayn said: For this reason, we have given up our share from the houses in Mecca.
Hadith 1488
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ
يَحْيَى بْنِ سَعِيدٍ ، عَنْ
سُلَيْمَانَ بْنِ يَسَارٍ ، أَنَّ
مُحَمَّدَ بْنَ الْأَشْعَثِ أَخْبَرَهُ، أَنَّ عَمَّةً لَهُ يَهُودِيَّةً أَوْ نَصْرَانِيَّةً تُوُفِّيَتْ، وَأَنَّ مُحَمَّدَ بْنَ الْأَشْعَثِ ذَكَرَ ذَلِكَ لِعُمَرَ بْنِ الْخَطَّابِ، وَقَالَ لَهُ : مَنْ يَرِثُهَا ؟ فَقَالَ لَهُ
عُمَرُ بْنُ الْخَطَّابِ :
" يَرِثُهَا أَهْلُ دِينِهَا " . ثُمَّ أَتَى عُثْمَانَ بْنَ عَفَّانَ، فَسَأَلَهُ عَنْ ذَلِكَ، فَقَالَ لَهُ
عُثْمَانُ : أَتُرَانِي نَسِيتُ مَا قَالَ لَكَ عُمَرُ بْنُ الْخَطَّابِ ؟ يَرِثُهَا أَهْلُ دِينِهَا
A paternal aunt of Muhammad bin Ash'ath, who was either a Jew or a Christian, died. Muhammad bin Ash'ath informed Sayyiduna Umar (may Allah be pleased with him) and asked who would be her heir. Sayyiduna Umar bin Khattab (may Allah be pleased with him) said: Her heirs will be those who follow her religion. Then, when Sayyiduna Uthman bin Affan (may Allah be pleased with him) became the caliph, he was asked about it. Sayyiduna Uthman bin Affan (may Allah be pleased with him) said: Do you think I have forgotten what Sayyiduna Umar bin Khattab (may Allah be pleased with him) told you? Her heirs will be those who follow her religion.
Hadith 1489
It is narrated from Ismail bin Abi Hakim that Umar bin Abdul Aziz had a Christian slave, whom he set free. When he died, Umar bin Abdul Aziz said to me, "Include his wealth in the treasury (Bayt al-Mal)."
Hadith 1490
Hazrat Saeed bin Musayyib used to say that Sayyiduna Umar bin Khattab (may Allah be pleased with him) refused to grant inheritance of people from foreign lands to the people of his own country, except for those who were born in Arabia.

قَالَ مَالِكٌ : وَإِنْ جَاءَتِ امْرَأَةٌ حَامِلٌ مِنْ أَرْضِ الْعَدُوِّ، فَوَضَعَتْهُ فِي أَرْضِ الْعَرَبِ، فَهُوَ وَلَدُهَا، يَرِثُهَا إِنْ مَاتَتْ، وَتَرِثُهُ إِنْ مَاتَ، مِيرَاثَهَا فِي كِتَابِ اللَّهِ . قَالَ مَالِكٌ : الْأَمْرُ الْمُجْتَمَعُ عَلَيْهِ عِنْدَنَا، وَالسُّنَّةُ الَّتِي لَا اخْتِلَافَ فِيهَا، وَالَّذِي أَدْرَكْتُ عَلَيْهِ أَهْلَ الْعِلْمِ بِبَلَدِنَا : أَنَّهُ لَا يَرِثُ الْمُسْلِمُ الْكَافِرَ بِقَرَابَةٍ، وَلَا وَلَاءٍ، وَلَا رَحِمٍ، وَلَا يَحْجُبُ أَحَدًا عَنْ مِيرَاثِهِ .
Imam Malik, may Allah have mercy on him, said that if a woman comes from the land of the disbelievers while pregnant and resides in Arabia, and gives birth there, then she will inherit from her son and the son will inherit from her.
Hadith 1490B2
قَالَ مَالِكٌ : وَكَذَلِكَ كُلُّ مَنْ لَا يَرِثُ إِذَا لَمْ يَكُنْ دُونَهُ وَارِثٌ، فَإِنَّهُ لَا يَحْجُبُ أَحَدًا عَنْ مِيرَاثِهِ
Imam Malik, may Allah have mercy on him, said that according to us this ruling is based on consensus and there is no difference of opinion in it: a Muslim cannot inherit from a disbeliever due to any relationship, whether it is by lineage, wala', or kinship, nor can he deprive anyone of his inheritance.
Imam Malik, may Allah have mercy on him, said that likewise, whoever does not inherit cannot deprive another of inheritance.
