Hadith 1459
حَدَّثَنِي مَالِك، عَنْ
رَبِيعَةَ بْنِ أَبِي عَبْدِ الرَّحْمَنِ ، عَنْ
يَزِيدَ مَوْلَى الْمُنْبَعِثِ، عَنْ
زَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ ، أَنَّهُ قَالَ : جَاءَ رَجُلٌ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَسَأَلَهُ عَنِ اللُّقَطَةِ، فَقَالَ :
" اعْرِفْ عِفَاصَهَا وَوِكَاءَهَا، ثُمَّ عَرِّفْهَا سَنَةً، فَإِنْ جَاءَ صَاحِبُهَا، وَإِلَّا فَشَأْنَكَ بِهَا " . قَالَ فَضَالَّةُ : الْغَنَمِ يَا رَسُولَ اللَّهِ ؟ قَالَ : " هِيَ لَكَ أَوْ لِأَخِيكَ أَوْ لِلذِّئْبِ " . قَالَ فَضَالَّةُ : الْإِبِلِ . قَالَ : " مَا لَكَ وَلَهَا، مَعَهَا سِقَاؤُهَا وَحِذَاؤُهَا تَرِدُ الْمَاءَ وَتَأْكُلُ الشَّجَرَ حَتَّى يَلْقَاهَا رَبُّهَا "
It is narrated from Sayyiduna Zayd bin Khalid al-Juhani, may Allah be pleased with him, that a man came to the Messenger of Allah, peace and blessings be upon him, and asked him about a lost item (luqatah). The Messenger of Allah, peace and blessings be upon him, said: "Recognize its container (in which the lost item is, whether it is of leather or cloth), and recognize its binding, then announce its matter to the people for a year. If its owner is found, give it to him; if not, then take it for yourself." Then the man said: "If a stray goat is found, O Messenger of Allah, peace and blessings be upon him?" The Messenger of Allah, peace and blessings be upon him, said: "The goat will benefit you, or your brother, or the wolf will eat it." Then the man said: "If a stray camel is found?" The Messenger of Allah, peace and blessings be upon him, said: "What concern do you have with the camel? It has its water with it, and its shoes with it; wherever it finds water, it drinks, and whatever tree it finds, it eats, until its owner finds it."
Hadith 1460
It is narrated from Hazrat Muawiyah bin Abdullah that his father stated that he found a pouch containing eighty (80) dinars at a stop on the road to Syria, where people had dismounted. He reported this to Sayyiduna Umar (may Allah be pleased with him). Umar (may Allah be pleased with him) said: Announce it at the doors of the mosques, and inform anyone who comes from Syria, for one year. When a year has passed, then you have the choice (regarding it).
Hadith 1461
وَحَدَّثَنِي وَحَدَّثَنِي مَالِك، عَنْ
نَافِعٍ ، أَنَّ رَجُلًا وَجَدَ لُقَطَةً، فَجَاءَ إِلَى عَبْدِ اللَّهِ بْنِ عُمَرَ، فَقَالَ لَهُ : إِنِّي وَجَدْتُ لُقَطَةً، فَمَاذَا تَرَى فِيهَا ؟ فَقَالَ لَهُ
عَبْدُ اللَّهِ بْنُ عُمَرَ : " عَرِّفْهَا " . قَالَ : قَدْ فَعَلْتُ . قَالَ : " زِدْ " . قَالَ : قَدْ فَعَلْتُ . فَقَالَ عَبْدُ اللَّهِ :
" لَا آمُرُكَ أَنْ تَأْكُلَهَا، وَلَوْ شِئْتَ لَمْ تَأْخُذْهَا "
It is narrated from Nafi that a man found a lost item (luqata), brought it to Abdullah bin Umar (may Allah be pleased with them), and asked: What do you say about this matter? Abdullah bin Umar (may Allah be pleased with them) said: Ask the people and announce it. The man said: I have already asked and announced. Abdullah bin Umar (may Allah be pleased with them) said: Do it again. The man said: I have already asked and announced. Abdullah bin Umar (may Allah be pleased with them) said: I will never order you to eat it; if you wished, you would not have taken it.
