Hadith 1417
قَالَ يَحْيَى : عَنْ مَالِك أَنَّهُ بَلَغَهُ، عَنْ
سُلَيْمَانَ بْنِ يَسَارٍ ، وَغَيْرِهِ، أَنَّهُمْ سُئِلُوا عَنْ رَجُلٍ جُلِدَ الْحَدَّ، أَتَجُوزُ شَهَادَتُهُ ؟ فَقَالُوا : " نَعَمْ،
إِذَا ظَهَرَتْ مِنْهُ التَّوْبَةُ "
Sulaiman bin Yasar and others were asked whether a person who has been subjected to the hadd punishment for qadhf, can his testimony be accepted? They replied: Yes, when he repents, and the truthfulness of his repentance becomes evident from his actions.

The same question was asked to Ibn Shihab, and he also said the same as Sulayman bin Yasar had said.
Hadith 1418B1
يُسْأَلُ عَنْ ذَلِكَ، فَقَالَ مِثْلَ مَا قَالَ سُلَيْمَانُ بْنُ يَسَارٍ . قَالَ مَالِك: وَذَلِكَ الْأَمْرُ عِنْدَنَا، وَذَلِكَ لِقَوْلِ اللَّهِ تَبَارَكَ وَتَعَالَى: وَالَّذِينَ يَرْمُونَ الْمُحْصَنَاتِ ثُمَّ لَمْ يَأْتُوا بِأَرْبَعَةِ شُهَدَاءَ فَاجْلِدُوهُمْ ثَمَانِينَ جَلْدَةً وَلا تَقْبَلُوا لَهُمْ شَهَادَةً أَبَدًا وَأُولَئِكَ هُمُ الْفَاسِقُونَ { 4 } إِلا الَّذِينَ تَابُوا مِنْ بَعْدِ ذَلِكَ وَأَصْلَحُوا فَإِنَّ اللَّهَ غَفُورٌ رَحِيمٌ سورة النور آية 4-5 . قَالَ مَالِك: فَالْأَمْرُ الَّذِي لَا اخْتِلَافَ فِيهِ عِنْدَنَا، أَنَّ الَّذِي يُجْلَدُ الْحَدَّ ثُمَّ تَابَ وَأَصْلَحَ تَجُوزُ شَهَادَتُهُ، وَهُوَ أَحَبُّ مَا سَمِعْتُ إِلَيَّ فِي ذَلِكَ .
Imam Malik, may Allah have mercy on him, said: In our view, this is the ruling, because Allah, the Glorious and Exalted, has said: "Those who accuse chaste women and then do not bring four witnesses, flog them with eighty (80) lashes, and never accept their testimony thereafter, for they are the wicked. Except for those who repent after that and reform, for surely Allah is Forgiving, Merciful." Imam Malik, may Allah have mercy on him, said: So, whoever has had the hadd of qadhf applied to him, then repents and reforms, his testimony is valid.
