بَابُ مَا جَاءَ فِي الشَّهَادَاتِ
Chapter on what is reported regarding testimonies
Hadith 1414
حَدَّثَنَا يَحْيَى، عَنْ مَالِك، عَنْ عَبْدِ اللَّهِ بْنِ أَبِي بَكْرِ بْنِ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ ، عَنْ أَبِيهِ ، عَنْ عَبْدِ اللَّهِ بْنِ عَمْرِو بْنِ عُثْمَانَ ، عَنْ أَبِي عَمْرَةَ الْأَنْصَارِيِّ ، عَنْ زَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ : " أَلَا أُخْبِرُكُمْ بِخَيْرِ الشُّهَدَاءِ، الَّذِي يَأْتِي بِشَهَادَتِهِ قَبْلَ أَنْ يُسْأَلَهَا، أَوْ يُخْبِرُ بِشَهَادَتِهِ قَبْلَ أَنْ يُسْأَلَهَا "
It is narrated from Sayyiduna Zaid bin Khalid Juhani, may Allah be pleased with him, that the Messenger of Allah, peace and blessings be upon him, said: "Shall I not inform you of the best witness, who gives testimony before he is asked?"
Hadith 1415
وَحَدَّثَنِي وَحَدَّثَنِي مَالِك، عَنْ رَبِيعَةَ بْنِ أَبِي عَبْدِ الرَّحْمَنِ ، أَنَّهُ قَالَ : قَدِمَ عَلَى عُمَرَ بْنِ الْخَطَّابِ رَجُلٌ مِنْ أَهْلِ الْعِرَاقِ، فَقَالَ : لَقَدْ جِئْتُكَ لِأَمْرٍ مَا لَهُ رَأْسٌ وَلَا ذَنَبٌ . فَقَالَ عُمَرُ : " مَا هُوَ ؟ " قَالَ : شَهَادَاتُ الزُّورِ ظَهَرَتْ بِأَرْضِنَا . فَقَالَ عُمَرُ : " أَوَ قَدْ كَانَ ذَلِكَ ؟ " قَالَ : نَعَمْ . فَقَالَ عُمَرُ : " وَاللَّهِ لَا يُؤْسَرُ رَجُلٌ فِي الْإِسْلَامِ بِغَيْرِ الْعُدُولِ "
It is narrated from Rabi’ah bin Abi Abdur Rahman that a man from Iraq came to Sayyiduna Umar, may Allah be pleased with him, and said: I have come to you regarding a matter that has neither head nor tail. Sayyiduna Umar, may Allah be pleased with him, said: What is it? He said: False testimonies have become widespread in our land. Sayyiduna Umar, may Allah be pleased with him, said: Really? He said: Yes. Then Sayyiduna Umar, may Allah be pleased with him, said: Now no Muslim shall be imprisoned without reliable witnesses.
Hadith 1416
وَحَدَّثَنِي وَحَدَّثَنِي مَالِك أَنَّهُ بَلَغَهُ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ، قَالَ : " لَا تَجُوزُ شَهَادَةُ خَصْمٍ وَلَا ظَنِينٍ "
Sayyiduna Umar (may Allah be pleased with him) said: The testimony of an enemy and an accused person is not valid.
