Hadith 1403
It is narrated from Sayyiduna Rafi' bin Khadij (may Allah be pleased with him) that the Messenger of Allah (peace and blessings of Allah be upon him) forbade leasing out fields. Hanzalah said: I asked Rafi', what if it is leased for gold or silver? He said: There is no harm in that.
Hadith 1404
Ibn Shihab asked Said ibn al-Musayyib: Is it permissible to lease land in exchange for gold or silver? He said: Yes, there is no objection.
Hadith 1405
وَحَدَّثَنِي مَالِك، عَنْ ابْنِ شِهَابٍ، أَنَّهُ سَأَلَ سَالِمَ بْنَ عَبْدِ اللَّهِ بْنِ عُمَرَ عَنْ " كِرَاءِ الْمَزَارِعِ، فَقَالَ : لَا بَأْسَ بِهَا بِالذَّهَبِ وَالْوَرِقِ " . قَالَ ابْنُ شِهَابٍ : فَقُلْتُ لَهُ : أَرَأَيْتَ الْحَدِيثَ الَّذِي يُذْكَرُ عَنْ رَافِعِ بْنِ خَدِيجٍ ؟ فَقَالَ : أَكْثَرَ رَافِعٌ، وَلَوْ كَانَ لِي مَزْرَعَةٌ أَكْرَيْتُهَا
Ibn Shihab asked Salim bin Abdullah about renting out fields. He said: There is nothing wrong with it in exchange for gold or silver. Ibn Shihab said: Have you not heard the hadith of Sayyiduna Rafi' bin Khadij (may Allah be pleased with him)? Salim said: Rafi' exaggerated; if I had cultivated land, I would rent it out.
Hadith 1406
وَحَدَّثَنِي وَحَدَّثَنِي مَالِك، أَنَّهُ بَلَغَهُ، أَنَّ عَبْدَ الرَّحْمَنِ بْنَ عَوْفٍ تَكَارَى أَرْضًا، فَلَمْ تَزَلْ فِي يَدَيْهِ بِكِرَاءٍ حَتَّى مَاتَ، قَالَ ابْنُهُ : فَمَا كُنْتُ أُرَاهَا إِلَّا لَنَا مِنْ طُولِ مَا مَكَثَتْ فِي يَدَيْهِ، حَتَّى ذَكَرَهَا لَنَا عِنْدَ مَوْتِهِ " فَأَمَرَنَا بِقَضَاءِ شَيْءٍ كَانَ عَلَيْهِ مِنْ كِرَائِهَا ذَهَبٍ أَوْ وَرِقٍ "
Sayyiduna Abdur Rahman bin Awf (may Allah be pleased with him) leased a piece of land, which remained with him until his death. His son said: We considered it our property because it remained with us for a long time. When Sayyiduna Abdur Rahman (may Allah be pleased with him) was about to die, he said: It is leased, and he ordered that the rent which was due upon him be paid, in gold or silver.
Hadith 1407
وَحَدَّثَنِي مَالِكٌ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ " أَنَّهُ كَانَ يُكْرِي أَرْضَهُ بِالذَّهَبِ وَالْوَرِقِ " . وَسُئِلَ مَالِكٌ عَنْ رَجُلٍ أَكْرَى مَزْرَعَتَهُ بِمِائَةِ صَاعٍ مِنْ تَمْرٍ، أَوْ مِمَّا يَخْرُجُ مِنْهَا مِنَ الْحِنْطَةِ أَوْ مِنْ غَيْرِ مَا يَخْرُجُ مِنْهَا ؟ فَكَرِهَ ذَلِكَ
Hazrat Urwah bin Zubair used to lease his land in exchange for silver or gold.
Imam Malik (may Allah have mercy on him) was asked: If a person leases his land on the condition that when dates or wheat or any other thing is produced in it, he will take a certain amount, for example, one hundred saa'? Imam Malik (may Allah have mercy on him) considered this to be disliked.
