Hadith 1377
حَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ
نَافِعٍ ، عَنْ
عَبْدِ اللَّهِ بْنِ عُمَرَ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ :
" الْمُتَبَايِعَانِ كُلُّ وَاحِدٍ مِنْهُمَا بِالْخِيَارِ عَلَى صَاحِبِهِ مَا لَمْ يَتَفَرَّقَا إِلَّا بَيْعَ الْخِيَارِ " .
It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: "The seller and the buyer both have the option (to cancel the transaction) as long as they have not separated, except in the sale in which the option (of rescission) has been stipulated."
Hadith 1377B
قَالَ مَالِك : وَلَيْسَ لِهَذَا عِنْدَنَا حَدٌّ مَعْرُوفٌ، وَلَا أَمْرٌ مَعْمُولٌ بِهِ فِيهِ
Imam Malik, may Allah have mercy on him, said: In our view, there is no fixed period for the option (of rescinding a sale).
Hadith 1378
وَحَدَّثَنِي مَالِك أَنَّهُ بَلَغَهُ، أَنَّ
عَبْدَ اللَّهِ بْنَ مَسْعُودٍ كَانَ يُحَدِّثُ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ :
" أَيُّمَا بَيِّعَيْنِ تَبَايَعَا، فَالْقَوْلُ مَا قَالَ الْبَائِعُ، أَوْ يَتَرَادَّانِ " .
It is narrated from Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "When the seller and the buyer disagree, the statement of the seller will be considered valid and the sale will be annulled."
Hadith 1378B1
قَالَ مَالِك فِيمَنْ بَاعَ مِنْ رَجُلٍ سِلْعَةً، فَقَالَ الْبَائِعُ عِنْدَ مُوَاجَبَةِ الْبَيْعِ : أَبِيعُكَ عَلَى أَنْ أَسْتَشِيرَ فُلَانًا، فَإِنْ رَضِيَ فَقَدْ جَازَ الْبَيْعُ، وَإِنْ كَرِهَ فَلَا بَيْعَ بَيْنَنَا، فَيَتَبَايَعَانِ عَلَى ذَلِكَ، ثُمَّ يَنْدَمُ الْمُشْتَرِي قَبْلَ أَنْ يَسْتَشِيرَ الْبَائِعُ فُلَانًا : إِنَّ ذَلِكَ الْبَيْعَ لَازِمٌ لَهُمَا عَلَى مَا وَصَفَا وَلَا خِيَارَ لِلْمُبْتَاعِ، وَهُوَ لَازِمٌ لَهُ إِنْ أَحَبَّ الَّذِي اشْتَرَطَ لَهُ الْبَائِعُ أَنْ يُجِيزَهُ .
Imam Malik, may Allah have mercy on him, said that a person sold something and at the time of selling made the condition that he would consult so-and-so; if that person permitted, the sale would be valid, and if he forbade, the sale would be void. The buyer agreed to this condition, but afterwards regretted it; then he would have no choice, rather, when that person gives permission to the seller, the sale will become valid.
Hadith 1378B2
قَالَ مَالِك : الْأَمْرُ عِنْدَنَا فِي الرَّجُلِ يَشْتَرِي السِّلْعَةَ مِنَ الرَّجُلِ فَيَخْتَلِفَانِ فِي الثَّمَنِ، فَيَقُولُ الْبَائِعُ : بِعْتُكَهَا بِعَشَرَةِ دَنَانِيرَ، وَيَقُولُ الْمُبْتَاعُ : ابْتَعْتُهَا مِنْكَ بِخَمْسَةِ دَنَانِيرَ، إِنَّهُ يُقَالُ لِلْبَائِعِ : إِنْ شِئْتَ فَأَعْطِهَا لِلْمُشْتَرِي بِمَا قَالَ، وَإِنْ شِئْتَ فَاحْلِفْ بِاللَّهِ مَا بِعْتَ سِلْعَتَكَ إِلَّا بِمَا قُلْتَ، فَإِنْ حَلَفَ قِيلَ لِلْمُشْتَرِي : إِمَّا أَنْ تَأْخُذَ السِّلْعَةَ بِمَا قَالَ الْبَائِعُ، وَإِمَّا أَنْ تَحْلِفَ بِاللَّهِ مَا اشْتَرَيْتَهَا إِلَّا بِمَا قُلْتَ، فَإِنْ حَلَفَ بَرِئَ مِنْهَا، وَذَلِكَ أَنَّ كُلَّ وَاحِدٍ مِنْهُمَا مُدَّعٍ عَلَى صَاحِبِهِ
Imam Malik, may Allah have mercy on him, said: According to us, the ruling is that if a person buys something from another person, and then there is a dispute regarding the price, the seller says: I sold it for ten dinars, and the buyer says: I bought it for five dinars, then it will be said to the seller: If you wish, give the item to the buyer for five dinars; if not, then swear an oath that: I did not sell my item except for ten dinars. If the seller swears the oath, then it will be said to the buyer: If you wish, take the item for ten dinars; if not, then swear an oath that: I did not buy this item except for five dinars. If the buyer swears this oath, then he will be acquitted, because each of them is a claimant against the other.
