Hadith 1376
It is narrated from Sayyiduna Abu Huraira, may Allah be pleased with him, that the Messenger of Allah, peace and blessings be upon him, forbade mulamasa and munabadhah.
Hadith 1376B1
قَالَ مَالِك : وَالْمُلَامَسَةُ : أَنْ يَلْمِسَ الرَّجُلُ الثَّوْبَ وَلَا يَنْشُرُهُ وَلَا يَتَبَيَّنُ مَا فِيهِ أَوْ يَبْتَاعَهُ لَيْلًا وَلَا يَعْلَمُ مَا فِيهِ . وَالْمُنَابَذَةُ : أَنْ يَنْبِذَ الرَّجُلُ إِلَى الرَّجُلِ ثَوْبَهُ وَيَنْبِذَ الْآخَرُ إِلَيْهِ ثَوْبَهُ عَلَى غَيْرِ تَأَمُّلٍ مِنْهُمَا، وَيَقُولُ كُلُّ وَاحِدٍ مِنْهُمَا : هَذَا بِهَذَا، فَهَذَا الَّذِي نُهِيَ عَنْهُ مِنَ الْمُلَامَسَةِ وَالْمُنَابَذَةِ .
Imam Malik, may Allah have mercy on him, said that "Mulamasa" is when a man buys a cloth by touching it, without unfolding it or looking inside, or buys it in the darkness of night, not knowing what is in it. And "Munabadhah" is when the seller throws his cloth towards the buyer, and the buyer throws his cloth towards the seller, without any thought or consideration; this one in exchange for that, and that one in exchange for this. Both of these are prohibited.
Hadith 1376B2
قَالَ مَالِك فِي السَّاجِ الْمُدْرَجِ فِي جِرَابِهِ، أَوِ الثَّوْبِ الْقُبْطِيِّ الْمُدْرَجِ فِي طَيِّهِ : إِنَّهُ لَا يَجُوزُ بَيْعُهُمَا حَتَّى يُنْشَرَا وَيُنْظَرَ إِلَى مَا فِي أَجْوَافِهِمَا، وَذَلِكَ أَنَّ بَيْعَهُمَا مِنْ بَيْعِ الْغَرَرِ وَهُوَ مِنَ الْمُلَامَسَةِ .
Imam Malik, may Allah have mercy on him, said that it is not permissible to sell a folded piece of cloth, or a sheet tied up in a bundle, until it is opened and the inside is seen.
Hadith 1376B3
قَالَ مَالِك : وَبَيْعُ الْأَعْدَالِ عَلَى الْبَرْنَامَجِ، مُخَالِفٌ لِبَيْعِ السَّاجِ فِي جِرَابِهِ وَالثَّوْبِ فِي طَيِّهِ وَمَا أَشْبَهَ ذَلِكَ، فَرَقَ بَيْنَ ذَلِكَ الْأَمْرُ الْمَعْمُولُ بِهِ وَمَعْرِفَةُ ذَلِكَ فِي صُدُورِ النَّاسِ وَمَا مَضَى مِنْ عَمَلِ الْمَاضِينَ فِيهِ، وَأَنَّهُ لَمْ يَزَلْ مِنْ بُيُوعِ النَّاسِ الْجَائِزَةِ وَالتِّجَارَةِ بَيْنَهُمُ الَّتِي لَا يَرَوْنَ بِهَا بَأْسًا، لِأَنَّ بَيْعَ الْأَعْدَالِ عَلَى الْبَرْنَامَجِ عَلَى غَيْرِ نَشْرٍ لَا يُرَادُ بِهِ الْغَرَرُ، وَلَيْسَ يُشْبِهُ الْمُلَامَسَةَ
Imam Malik, may Allah have mercy on him, said that the ruling of selling barnamaj is not like that; it is permissible, because people have always been doing it, and deception is not intended by it.
