Hadith 1372
حَدَّثَنِي يَحْيَى، عَنْ مَالِك أَنَّهُ بَلَغَهُ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " نَهَى عَنْ بَيْعَتَيْنِ فِي بَيْعَةٍ "
Imam Malik (may Allah have mercy on him) was informed that the Messenger of Allah (peace and blessings be upon him) forbade two sales in one sale.
Hadith 1373
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك أَنَّهُ بَلَغَهُ، أَنَّ رَجُلًا قَالَ لِرَجُلٍ : ابْتَعْ لِي هَذَا الْبَعِيرَ بِنَقْدٍ حَتَّى أَبْتَاعَهُ مِنْكَ إِلَى أَجَلٍ، فَسُئِلَ عَنْ ذَلِكَ عَبْدُ اللَّهِ بْنُ عُمَرَ فَكَرِهَهُ وَنَهَى عَنْهُ "
Imam Malik (may Allah have mercy on him) was informed that a man said to another: "Buy this camel for me in cash, and I will buy it from you on a promise." Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) considered this bad and forbade it.
Hadith 1374
وَحَدَّثَنِي مَالِك أَنَّهُ بَلَغَهُ، أَنَّ الْقَاسِمَ بْنَ مُحَمَّدٍ سُئِلَ عَنْ " رَجُلٍ اشْتَرَى سِلْعَةً بِعَشَرَةِ دَنَانِيرَ نَقْدًا أَوْ بِخَمْسَةَ عَشَرَ دِينَارًا إِلَى أَجَلٍ، فَكَرِهَ ذَلِكَ وَنَهَى عَنْهُ " .
Hazrat Qasim bin Muhammad was asked: A person bought something in exchange for ten dinars in cash, or fifteen dinars on credit? So Qasim bin Muhammad considered this bad, and forbade it.
Hadith 1374B1
قَالَ مَالِك فِي رَجُلٍ ابْتَاعَ سِلْعَةً مِنْ رَجُلٍ بِعَشَرَةِ دَنَانِيرَ نَقْدًا أَوْ بِخَمْسَةَ عَشَرَ دِينَارًا إِلَى أَجَلٍ، قَدْ وَجَبَتْ لِلْمُشْتَرِي بِأَحَدِ الثَّمَنَيْنِ : إِنَّهُ لَا يَنْبَغِي ذَلِكَ، لِأَنَّهُ إِنْ أَخَّرَ الْعَشَرَةَ كَانَتْ خَمْسَةَ عَشَرَ إِلَى أَجَلٍ، وَإِنْ نَقَدَ الْعَشَرَةَ كَانَ إِنَّمَا اشْتَرَى بِهَا الْخَمْسَةَ عَشَرَ الَّتِي إِلَى أَجَلٍ .
Imam Malik, may Allah have mercy on him, said that if a person buys a cloth on the condition that if he pays cash, he should pay ten dinars, and if he pays on credit, he should pay fifteen dinars, in any case, the buyer must pay one of the two prices, then this is not permissible, because if he does not pay ten dinars in cash, then fifteen on credit are in place of ten, and if he pays ten in cash, then it is as if he has taken fifteen on credit in exchange for it.
Hadith 1374B2
قَالَ مَالِك فِي رَجُلٍ اشْتَرَى مِنْ رَجُلٍ سِلْعَةً بِدِينَارٍ نَقْدًا أَوْ بِشَاةٍ مَوْصُوفَةٍ إِلَى أَجَلٍ قَدْ وَجَبَ عَلَيْهِ بِأَحَدِ الثَّمَنَيْنِ : إِنَّ ذَلِكَ مَكْرُوهٌ لَا يَنْبَغِي، لِأَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَدْ نَهَى عَنْ بَيْعَتَيْنِ فِي بَيْعَةٍ، وَهَذَا مِنْ بَيْعَتَيْنِ فِي بَيْعَةٍ .
Imam Malik, may Allah have mercy on him, said that if a person buys something in exchange for one dinar in cash, or in exchange for a goat on credit, and one of these two must be given to the buyer, then this is not permissible, because the Messenger of Allah, peace and blessings be upon him, forbade two sales in one sale, and this is exactly that.
Hadith 1374B3
قَالَ مَالِك فِي رَجُلٍ قَالَ لِرَجُلٍ : أَشْتَرِي مِنْكَ هَذِهِ الْعَجْوَةَ خَمْسَةَ عَشَرَ صَاعًا أَوِ الصَّيْحَانِيَّ عَشَرَةَ أَصْوُعٍ، أَوِ الْحِنْطَةَ الْمَحْمُولَةَ خَمْسَةَ عَشَرَ صَاعًا أَوِ الشَّامِيَّةَ عَشَرَةَ أَصْوُعٍ بِدِينَارٍ، قَدْ وَجَبَتْ لِي إِحْدَاهُمَا : إِنَّ ذَلِكَ مَكْرُوهٌ لَا يَحِلُّ، وَذَلِكَ أَنَّهُ قَدْ أَوْجَبَ لَهُ عَشَرَةَ أَصْوُعٍ صَيْحَانِيًّا، فَهُوَ يَدَعُهَا وَيَأْخُذُ خَمْسَةَ عَشَرَ صَاعًا مِنَ الْعَجْوَةِ، أَوْ تَجِبُ عَلَيْهِ خَمْسَةَ عَشَرَ صَاعًا مِنَ الْحِنْطَةِ الْمَحْمُولَةِ فَيَدَعُهَا وَيَأْخُذُ عَشَرَةَ أَصْوُعٍ مِنَ الشَّامِيَّةِ، فَهَذَا أَيْضًا مَكْرُوهٌ لَا يَحِلُّ، وَهُوَ أَيْضًا يُشْبِهُ مَا نُهِيَ عَنْهُ مِنْ بَيْعَتَيْنِ فِي بَيْعَةٍ، وَهُوَ أَيْضًا مِمَّا نُهِيَ عَنْهُ أَنْ يُبَاعَ مِنْ صِنْفٍ وَاحِدٍ مِنَ الطَّعَامِ اثْنَانِ بِوَاحِدٍ
Imam Malik, may Allah have mercy on him, said that if the buyer says to the seller: I have bought from you fifteen sa’ of this type of dates or ten sa’ of this type for one dinar, I will definitely take one of the two. Or he says: I have bought from you fifteen sa’ of this type of wheat or ten sa’ of this type of wheat for one dinar, I will definitely take one of the two, then this is not correct. It is as if he took ten sa’ of dates and then left them and took fifteen sa’ of dates, or left ten sa’ of wheat and took fifteen sa’ in exchange. This is also included in it, that is, making two sales in one sale.
