Hadith 1368
عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ أَنَّهُ كَانَ يَقُولُ : نُهِيَ عَنْ بَيْعِ الْحَيَوَانِ بِاللَّحْمِ. قَالَ أَبُو الزِّنَادِ : فَقُلْتُ لِسَعِيدِ بْنِ الْمُسَيِّبِ : أَرَأَيْتَ رَجُلًا اشْتَرَى شَارِفًا بِعَشَرَةِ شِيَاهٍ؟ فَقَالَ سَعِيدٌ : إِنْ كَانَ اشْتَرَاهَا لِيَنْحَرَهَا، فَلَا خَيْرَ فِي ذَلِكَ. قَالَ أَبُو الزِّنَادِ : وَكُلُّ مَنْ أَدْرَكْتُ مِنَ النَّاسِ يَنْهَوْنَ عَنْ بَيْعِ الْحَيَوَانِ بِاللَّحْمِ، قَالَ أَبُو الزِّنَادِ : وَكَانَ ذَلِكَ يُكْتَبُ فِي عُهُودِ الْعُمَّالِ فِي زَمَانِ أَبَانَ بْنِ عُثْمَانَ وَهِشَامِ بْنِ إِسْمَاعِيلَ يَنْهَوْنَ عَنْ ذَلِكَ.
Said ibn al-Musayyib used to say: It is prohibited to sell an animal in exchange for meat. Abu al-Zinad said: I asked Said ibn al-Musayyib, "What if a person buys a camel in exchange for ten goats?" Said replied: "If it is bought for slaughtering, then it is not preferable." Abu al-Zinad said: I found all the scholars prohibiting the sale of an animal in exchange for meat, and during the time of Aban ibn Uthman and Hisham ibn Isma'il, this prohibition used to be written in the official decrees of the governors.
قَالَ مَالِكٌ : وَلَا بَأْسَ بِلَحْمِ الْحِيتَانِ، بِلَحْمِ الْإِبِلِ وَالْبَقَرِ وَالْغَنَمِ، وَمَا أَشْبَهَ ذَلِكَ مِنَ الْوُحُوشِ كُلِّهَا، اثْنَيْنِ بِوَاحِدٍ وَأَكْثَرَ مِنْ ذَلِكَ يَدًا بِيَدٍ، فَإِنْ دَخَلَ ذَلِكَ الْأَجَلُ فَلَا خَيْرَ فِيهِ. ¤
Imam Malik, may Allah have mercy on him, said that if the meat of fish is sold in exchange for the meat of camel, cow, or goat, whether more or less, there is no objection to it. However, it is necessary that the transaction be hand to hand (immediate payment), and not on credit.
قَالَ مَالِكٌ : وَأَرَى لُحُومَ الطَّيْرِ كُلَّهَا مُخَالِفَةً لِلُحُومِ الْأَنْعَامِ، وَالْحِيتَانِ، فَلَا أَرَى بَأْسًا بِأَنْ يُشْتَرَى بَعْضُ ذَلِكَ بِبَعْضٍ مُتَفَاضِلًا يَدًا بِيَدٍ، وَلَا يُبَاعُ شَيْءٌ مِنْ ذَلِكَ إِلَى أَجَلٍ.
Imam Malik, may Allah have mercy on him, said that in my view, the meat of birds is very different from the meat of animals and fish. If they are sold with a little difference in quantity, there is no objection, but it is necessary that the transaction be hand to hand, not on credit.
قَالَ مَالِكٌ : الْأَمْرُ الْمُجْتَمَعُ عَلَيْهِ عِنْدَنَا فِي لَحْمِ الْإِبِلِ وَالْبَقَرِ وَالْغَنَمِ، وَمَا أَشْبَهَ ذَلِكَ مِنَ الْوُحُوشِ، أَنَّهُ لَا يُشْتَرَى بَعْضُهُ بِبَعْضٍ، إِلَّا مِثْلًا بِمِثْلٍ، وَزْنًا بِوَزْنٍ، يَدًا بِيَدٍ، وَلَا بَأْسَ بِهِ وَإِنْ لَمْ يُوزَنْ، إِذَا تَحَرَّى أَنْ يَكُونَ مِثْلًا بِمِثْلٍ يَدًا بِيَدٍ. ¤
Imam Malik, may Allah have mercy on him, said: In our view, this ruling is agreed upon that whether the meat is of a camel, goat, or any other animal, exchanging meat for meat is not permissible except by weighing it equally and in cash. If equality is estimated, that is also sufficient.
