بَابُ مَا يُكْرَهُ مِنْ بَيْعِ التَّمْرِ
Chapter on What is Disliked in Selling Dates
Hadith 1323
حَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ زَيْدِ بْنِ أَسْلَمَ ، عَنْ عَطَاءِ بْنِ يَسَارٍ ، أَنَّهُ قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " التَّمْرُ بِالتَّمْرِ مِثْلًا بِمِثْلٍ " . فَقِيلَ لَهُ : إِنَّ عَامِلَكَ عَلَى خَيْبَرَ يَأْخُذُ الصَّاعَ بِالصَّاعَيْنِ . فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " ادْعُوهُ لِي " . فَدُعِيَ لَهُ، فَقَالَ لَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَتَأْخُذُ الصَّاعَ بِالصَّاعَيْنِ ؟ " فَقَالَ : يَا رَسُولَ اللَّهِ، لَا يَبِيعُونَنِي الْجَنِيبَ بِالْجَمْعِ صَاعًا بِصَاعٍ . فَقَالَ لَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " بِعِ الْجَمْعَ بِالدَّرَاهِمِ ثُمَّ ابْتَعْ بِالدَّرَاهِمِ جَنِيبًا "
It is narrated from Hazrat Ata bin Yasar that the Messenger of Allah, peace and blessings be upon him, said: "Sell dates for dates in equal measure." A man said: O Messenger of Allah, peace and blessings be upon him! Your agent at Khaybar takes one sa’ of dates and gives two sa’ in return. The Prophet, peace and blessings be upon him, said: "Call him." He was called. The Prophet, peace and blessings be upon him, asked: Do you take one sa’ by giving two sa’ of dates? He replied: O Messenger of Allah, peace and blessings be upon him! One sa’ of good dates cannot be obtained in exchange for one sa’ of inferior dates. The Prophet, peace and blessings be upon him, said: "First sell the inferior dates for money, then buy the good dates with that."
Hadith 1324
وَحَدَّثَنِي، عَنْ مَالِك، عَنْ عَبْدِ الْحَميدِ بْنِ سُهَيْلِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ ، عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ ، عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ ، وَعَنْ أَبِي هُرَيْرَةَ ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ اسْتَعْمَلَ رَجُلًا عَلَى خَيْبَرَ فَجَاءَهُ بِتَمْرٍ جَنِيبٍ، فَقَالَ لَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَكُلُّ تَمْرِ خَيْبَرَ هَكَذَا ؟ " فَقَالَ : لَا وَاللَّهِ يَا رَسُولَ اللَّهِ، إِنَّا لَنَأْخُذُ الصَّاعَ مِنْ هَذَا بِالصَّاعَيْنِ، وَالصَّاعَيْنِ بِالثَّلَاثَةِ . فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " لَا تَفْعَلْ، بِعِ الْجَمْعَ بِالدَّرَاهِمِ، ثُمَّ ابْتَعْ بِالدَّرَاهِمِ جَنِيبًا "
It is narrated from Sayyiduna Abu Sa'id and Sayyiduna Abu Huraira (may Allah be pleased with them) that the Messenger of Allah (peace and blessings be upon him) appointed a man as a collector at Khaybar. He brought excellent dates. The Prophet (peace and blessings be upon him) asked: "Are all the dates of Khaybar like this?" He replied: "No, O Messenger of Allah! We buy one sa' of these dates for two sa's (of ordinary dates), or two sa's for three sa's." The Prophet (peace and blessings be upon him) said: "Do not do so. First sell the inferior dates for money, then buy the superior dates with that money."
Hadith 1325
وَحَدَّثَنِي، عَنْ مَالِك، عَنْ عَبْدِ اللَّهِ بْنِ يَزِيدَ ، أَنَّ زَيْدًا أَبَا عَيَّاشٍ أَخْبَرَهُ، أَنَّهُ سَأَلَ سَعْدَ بْنَ أَبِي وَقَّاصٍ عَنِ الْبَيْضَاءِ بِالسُّلْتِ، فَقَالَ لَهُ سَعْدٌ : " أَيَّتُهُمَا أَفْضَلُ ؟ " قَالَ : الْبَيْضَاءُ . فَنَهَاهُ عَنْ ذَلِكَ، وَقَالَ سَعْدٌ : سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يُسْأَلُ عَنِ اشْتِرَاءِ التَّمْرِ بِالرُّطَبِ . فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَيَنْقُصُ الرُّطَبُ إِذَا يَبِسَ ؟ " فَقَالُوا : نَعَمْ . فَنَهَى عَنْ ذَلِكَ
It is narrated from Hazrat Zaid bin Abu Ayyash that he asked Sayyiduna Sa’d bin Abi Waqqas (may Allah be pleased with him) whether barley can be sold in exchange for sult (a type of grain that is between wheat and barley, produced in Ghor and Hijaz). He said: Which of the two is better? He replied: Barley. So he forbade it, and Sayyiduna Sa’d (may Allah be pleased with him) said: I heard the Messenger of Allah (peace and blessings be upon him), people asked him about selling dry dates in exchange for fresh dates. The Messenger of Allah (peace and blessings be upon him) said: “When fresh dates dry, does their weight decrease?” The people said: Yes. Then the Messenger of Allah (peace and blessings be upon him) forbade it.
