Hadith 1316
حَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ نَافِعٍ ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ ، عَنْ زَيْدِ بْنِ ثَابِتٍ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " أَرْخَصَ لِصَاحِبِ الْعَرِيَّةِ أَنْ يَبِيعَهَا بِخَرْصِهَا "
It is narrated from Sayyiduna Zaid bin Thabit (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) permitted the owner of ‘Ariyyah to sell his fruit by estimation.
Hadith 1317
قَالَ مَالِك : وَإِنَّمَا تُبَاعُ الْعَرَايَا بِخَرْصِهَا مِنَ التَّمْرِ يُتَحَرَّى ذَلِكَ، وَيُخْرَصُ فِي رُءُوسِ النَّخْلِ، وَإِنَّمَا أُرْخِصَ فِيهِ لِأَنَّهُ أُنْزِلَ بِمَنْزِلَةِ التَّوْلِيَةِ وَالْإِقَالَةِ وَالشِّرْكِ، وَلَوْ كَانَ بِمَنْزِلَةِ غَيْرِهِ مِنَ الْبُيُوعِ مَا أَشْرَكَ أَحَدٌ أَحَدًا فِي طَعَامِهِ حَتَّى يَقْبِضَهُ الْمُبْتَاعُ
Imam Malik, may Allah have mercy on him, said that the estimation of ‘Ariyyah will be made on the trees, and the Messenger of Allah, peace and blessings be upon him, permitted it. This is like musawamah (bargaining), iqalah (cancellation of sale), or partnership. If it were like other types of sales, then musawamah, iqalah, or partnership of food items before taking possession would not be valid, and this too would not be valid.
وَحَدَّثَنِي، عَنْ مَالِك، عَنْ دَاوُدَ بْنِ الْحُصَيْنِ ، عَنْ أَبِي سُفْيَانَ مَوْلَى ابْنِ أَبِي أَحْمَدَ، عَنْ أَبِي هُرَيْرَةَ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " أَرْخَصَ فِي بَيْعِ الْعَرَايَا بِخَرْصِهَا فِيمَا دُونَ خَمْسَةِ أَوْسُقٍ " . أَوْ فِي خَمْسَةِ أَوْسُقٍ . يَشُكُّ دَاوُدُ، قَالَ : خَمْسَةِ أَوْسُقٍ أَوْ دُونَ خَمْسَةِ أَوْسُقٍ .
It is narrated from Sayyiduna Abu Huraira, may Allah be pleased with him, that the Messenger of Allah, peace and blessings be upon him, permitted the sale of 'ariyyah by estimation, provided it is less than five wasqs or up to five wasqs.
Hadith 1317
وَحَدَّثَنِي، عَنْ مَالِك، عَنْ دَاوُدَ بْنِ الْحُصَيْنِ ، عَنْ أَبِي سُفْيَانَ مَوْلَى ابْنِ أَبِي أَحْمَدَ، عَنْ أَبِي هُرَيْرَةَ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " أَرْخَصَ فِي بَيْعِ الْعَرَايَا بِخَرْصِهَا فِيمَا دُونَ خَمْسَةِ أَوْسُقٍ " . أَوْ فِي خَمْسَةِ أَوْسُقٍ . يَشُكُّ دَاوُدُ، قَالَ : خَمْسَةِ أَوْسُقٍ أَوْ دُونَ خَمْسَةِ أَوْسُقٍ .
