بَابُ مَسِّ الرَّجُلِ وَلِيدَتَهُ إِذَا دَبَّرَهَا
A man touching his slave woman if he has made her Mudabbar (to be freed after his death)
Hadith 1300
مَالِكٌ، عَنْ نَافِعٍ : أَنَّ عَبْدَ اللهِ بْنَ عُمَرَ، دَبَّرَ جَارِيَتَيْنِ لَهُ، فَكَانَ يَطَؤُهُمَا وَهُمَا مُدَبَّرَتَانِ
It is narrated from Nafi‘ that Sayyiduna ‘Abdullah bin ‘Umar (may Allah be pleased with them both) made his slave women mudabbir and also had intercourse with them.
Hadith 1301
مَالِكٌ عَنْ يَحْيَى بْنِ سَعِيدٍ : أَنَّ سَعِيدَ بْنَ الْمُسَيِّبِ كَانَ يَقُولُ : إِذَا دَبَّرَ الرَّجُلُ جَارِيَتَهُ، فَإِنَّ لَهُ أَنْ يَطَأَهَا، وَلَيْسَ لَهُ أَنْ يَبِيعَهَا وَلَا يَهَبَهَا، وَوَلَدُهَا بِمَنْزِلَتِهَا
Hazrat Saeed bin Musayyib used to say: When a person declares his slave-girl as Mudabbara, he can have intercourse with her, but he cannot sell or gift her, and her children will be like their mother.
