بَابُ مَا جَاءَ فِي الرَّضَاعَةِ بَعْدَ الْكِبَرِ
Chapter on what is reported regarding breastfeeding after adulthood
Hadith 1262
حَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنِ ابْنِ شِهَابٍ ، أَنَّهُ سُئِلَ عَنْ رَضَاعَةِ الْكَبِيرِ، فَقَالَ : أَخْبَرَنِي عُرْوَةُ بْنُ الزُّبَيْرِ ، أَنَّ أَبَا حُذَيْفَةَ بْنَ عُتْبَةَ بْنِ رَبِيعَةَ، وَكَانَ مِنْ أَصْحَابِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، وَكَانَ قَدْ شَهِدَ بَدْرًا، وَكَانَ تَبَنَّى سَالِمًا الَّذِي يُقَالُ لَهُ سَالِمٌ مَوْلَى أَبِي حُذَيْفَةَ، كَمَا تَبَنَّى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ زَيْدَ بْنَ حَارِثَةَ، وَأَنْكَحَ أَبُو حُذَيْفَةَ، سَالِمًا، وَهُوَ يَرَى أَنَّهُ ابْنُهُ، أَنْكَحَهُ بِنْتَ أَخِيهِ فَاطِمَةَ بِنْتَ الْوَلِيدِ بْنِ عُتْبَةَ بْنِ رَبِيعَةَ، وَهِيَ يَوْمَئِذٍ مِنَ الْمُهَاجِرَاتِ الْأُوَلِ، وَهِيَ مِنْ أَفْضَلِ أَيَامَى قُرَيْشٍ، فَلَمَّا أَنْزَلَ اللَّهُ تَعَالَى فِي كِتَابِهِ فِي زَيْدِ بْنِ حَارِثَةَ مَا أَنْزَلَ، فَقَالَ : ادْعُوهُمْ لآبَائِهِمْ هُوَ أَقْسَطُ عِنْدَ اللَّهِ فَإِنْ لَمْ تَعْلَمُوا آبَاءَهُمْ فَإِخْوَانُكُمْ فِي الدِّينِ وَمَوَالِيكُمْ سورة الأحزاب آية 5، رُدَّ كُلُّ وَاحِدٍ مِنْ أُولَئِكَ إِلَى أَبِيهِ، فَإِنْ لَمْ يُعْلَمْ أَبُوهُ، رُدَّ إِلَى مَوْلَاهُ، فَجَاءَتْ سَهْلَةُ بِنْتُ سُهَيْلٍ وَهِيَ امْرَأَةُ أَبِي حُذَيْفَةَ وَهِيَ مِنْ بَنِي عَامِرِ بْنِ لُؤَيٍّ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَتْ : يَا رَسُولَ اللَّهِ، كُنَّا نَرَى سَالِمًا وَلَدًا، وَكَانَ يَدْخُلُ عَلَيَّ وَأَنَا فُضُلٌ، وَلَيْسَ لَنَا إِلَّا بَيْتٌ وَاحِدٌ، فَمَاذَا تَرَى فِي شَأْنِهِ ؟ فَقَالَ لَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَرْضِعِيهِ خَمْسَ رَضَعَاتٍ، فَيَحْرُمُ بِلَبَنِهَا " . وَكَانَتْ تَرَاهُ ابْنًا مِنَ الرَّضَاعَةِ، فَأَخَذَتْ بِذَلِكَ عَائِشَةُ أُمُّ الْمُؤْمِنِينَ فِيمَنْ كَانَتْ تُحِبُّ أَنْ يَدْخُلَ عَلَيْهَا مِنَ الرِّجَالِ، فَكَانَتْ تَأْمُرُ أُخْتَهَا أُمَّ كُلْثُومٍ بِنْتَ أَبِي بَكْرٍ الصِّدِّيقِ، وَبَنَاتِ أَخِيهَا، أَنْ يُرْضِعْنَ مَنْ أَحَبَّتْ أَنْ يَدْخُلَ عَلَيْهَا مِنَ الرِّجَالِ، وَأَبَى سَائِرُ أَزْوَاجِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يَدْخُلَ عَلَيْهِنَّ بِتِلْكَ الرَّضَاعَةِ أَحَدٌ مِنَ النَّاسِ، وَقُلْنَ : لَا وَاللَّهِ، مَا نَرَى الَّذِي أَمَرَ بِهِ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ سَهْلَةَ بِنْتَ سُهَيْلٍ، إِلَّا رُخْصَةً مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي رَضَاعَةِ سَالِمٍ وَحْدَهُ، لَا وَاللَّهِ لَا يَدْخُلُ عَلَيْنَا بِهَذِهِ الرَّضَاعَةِ أَحَدٌ، فَعَلَى هَذَا كَانَ أَزْوَاجُ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي رَضَاعَةِ الْكَبِيرِ
Ibn Shihab was asked: What is the ruling if a man drinks the milk of a woman in old age? He said: 'Urwah bin Zubair narrated to me that Sayyiduna Hudhaifah bin 'Utbah bin Rabi'ah (may Allah be pleased with him), who was among the Companions of the Messenger of Allah (peace be upon him) and was with him at the Battle of Badr, had adopted Salim as his son, so Salim Mawla used to call Sayyiduna Abu Hudhaifah (may Allah be pleased with him) his father, just as the Messenger of Allah (peace be upon him) had adopted Zaid as his son. And Sayyiduna Abu Hudhaifah (may Allah be pleased with him) married Salim to his niece Fatimah bint Walid, who was among the first emigrants and was the most virtuous among all the widowed women of Quraysh. When Allah, Glorious and Exalted is He, revealed in His Book regarding Sayyiduna Zaid bin Harithah (may Allah be pleased with him): "Call them by [the names of] their fathers; that is more just in the sight of Allah." If their father's name was not known, they would be attributed to their master. Then Sayyidah Sahla bint Suhail (may Allah be pleased with her), the wife of Sayyiduna Abu Hudhaifah (may Allah be pleased with him), who was from the descendants of Banu 'Amir bin Lu'ayy, came to the Messenger of Allah (peace be upon him) and said: "O Messenger of Allah (peace be upon him)! We used to consider Sayyiduna Salim (may Allah be pleased with him) as our child. We would be uncovered in his presence, and he would enter freely. What should we do now? We do not have another house." The Messenger of Allah (peace be upon him) said: "Give him milk to drink five times, and he will become your mahram." Then the wife of Sayyiduna Abu Hudhaifah (may Allah be pleased with him) did so, and began to consider Salim as her foster son. Umm al-Mu'minin Sayyidah 'A'ishah (may Allah be pleased with her) used to act upon this hadith, and whenever she wished for a man to come and go freely in her presence, she would instruct her sister Umm Kulthum and her nieces to give their milk to that man. But the other wives of the Messenger of Allah (peace be upon him) rejected this, that anyone could become their mahram by drinking milk in old age and come and go freely in their presence. They used to say that this was a special concession from the Messenger of Allah (peace be upon him) for Sayyidah Sahla bint Suhail (may Allah be pleased with her). By Allah! No one can become our mahram through such nursing.
Hadith 1263
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ عَبْدِ اللَّهِ بْنِ دِينَارٍ ، أَنَّهُ قَالَ : جَاءَ رَجُلٌ إِلَى عَبْدِ اللَّهِ بْنِ عُمَرَ، وَأَنَا مَعَهُ عِنْدَ دَارِ الْقَضَاءِ، يَسْأَلُهُ عَنْ رَضَاعَةِ الْكَبِيرِ، فَقَالَ عَبْدُ اللَّهِ بْنُ عُمَرَ : جَاءَ رَجُلٌ إِلَى عُمَرَ بْنِ الْخَطَّابِ، فَقَالَ : إِنِّي كَانَتْ لِي وَلِيدَةٌ، وَكُنْتُ أَطَؤُهَا، فَعَمَدَتِ امْرَأَتِي إِلَيْهَا، فَأَرْضَعَتْهَا فَدَخَلْتُ عَلَيْهَا، فَقَالَتْ : دُونَكَ فَقَدْ وَاللَّهِ أَرْضَعْتُهَا، فَقَالَ عُمَرُ : " أَوْجِعْهَا وَأْتِ جَارِيَتَكَ، فَإِنَّمَا الرَّضَاعَةُ رَضَاعَةُ الصَّغِيرِ "
It is narrated from Abdullah bin Dinar that a man came to Sayyiduna Abdullah bin Umar (may Allah be pleased with them both), and I was with him near Dar al-Qada. He began to ask: What is the ruling regarding the suckling of an adult? Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) said: A man came to Sayyiduna Umar (may Allah be pleased with him) and said: I had a slave woman with whom I used to have relations. My wife intentionally gave her milk to drink. When I was about to go to her, she said: Listen, by Allah! I have already given her milk to drink. Sayyiduna Umar (may Allah be pleased with him) said: Punish your wife and have relations with your slave woman. Suckling is only in childhood (not in adulthood).
Hadith 1264
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ يَحْيَى بْنِ سَعِيدٍ ، أَنَّ رَجُلًا سَأَلَ أَبَا مُوسَى الْأَشْعَرِيَّ، فَقَالَ : إِنِّي مَصِصْتُ عَنِ امْرَأَتِي مِنْ ثَدْيِهَا لَبَنًا، فَذَهَبَ فِي بَطْنِي، فَقَالَ أَبُو مُوسَى : لَا أُرَاهَا إِلَّا قَدْ حَرُمَتْ عَلَيْكَ، فَقَالَ عَبْدُ اللَّهِ بْنُ مَسْعُودٍ : " انْظُرْ مَاذَا تُفْتِي بِهِ الرَّجُلَ ؟ " فَقَالَ أَبُو مُوسَى : فَمَاذَا تَقُولُ أَنْتَ ؟ فَقَالَ عَبْدُ اللَّهِ بْنُ مَسْعُودٍ : " لَا رَضَاعَةَ إِلَّا مَا كَانَ فِي الْحَوْلَيْنِ " . فَقَالَ أَبُو مُوسَى : لَا تَسْأَلُونِي عَنْ شَيْءٍ، مَا كَانَ هَذَا الْحَبْرُ بَيْنَ أَظْهُرِكُمْ
Yahya ibn Sa'id narrated that a man said to Sayyiduna Abu Musa Ash'ari (may Allah be pleased with him): I was sucking my wife's milk from her breast, and it went into my stomach. Sayyiduna Abu Musa Ash'ari (may Allah be pleased with him) said: In my view, that woman has become unlawful for you. Sayyiduna Abdullah ibn Mas'ud (may Allah be pleased with him) said: See what ruling you are giving to this man. Sayyiduna Abu Musa Ash'ari (may Allah be pleased with him) said: Well, what do you say? Sayyiduna Abdullah ibn Mas'ud (may Allah be pleased with him) said: Suckling is that which is within two years. When Sayyiduna Abu Musa (may Allah be pleased with him) heard this, he said: Do not ask me anything as long as this scholar is among you (referring to Sayyiduna Abdullah ibn Mas'ud, may Allah be pleased with him).
