بَابُ عِدَّةِ الْأَمَةِ إِذَا تُوُفِّيَ سَيِّدُهَا أَوْ زَوْجُهَا
Waiting Period of a Slave Woman if Her Master or Husband Dies
Hadith 1235
وَحَدَّثَنِي مَالِك، عَنْ يَحْيَى بْنِ سَعِيدٍ ، عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ ، أَنَّهُ كَانَ يَقُولُ: " عِدَّةُ أُمِّ الْوَلَدِ إِذَا تُوُفِّيَ عَنْهَا سَيِّدُهَا حَيْضَةٌ " . قَالَ مَالِكٌ: وَهُوَ الْأَمْرُ عِنْدَنَا . قَالَ مَالِكٌ: وَإِنْ لَمْ تَكُنْ مِمَّنْ تَحِيضُ، فَعِدَّتُهَا ثَلَاثَةُ أَشْهُرٍ . حَدَّثَنِي يَحْيَى، عَنْ مَالِك، أَنَّهُ بَلَغَهُ، أَنَّ سَعِيدَ بْنَ الْمُسَيَّبِ ، وَسُلَيْمَانَ بْنَ يَسَارٍ ، كَانَا يَقُولَانِ: " عِدَّةُ الْأَمَةِ إِذَا هَلَكَ عَنْهَا زَوْجُهَا شَهْرَانِ وَخَمْسُ لَيَالٍ "
Saeed bin Musayyib and Sulaiman bin Yasar used to say that when the husband of a slave-girl dies, her waiting period (‘iddah) is two months and five days.
Hadith 1236
وَحَدَّثَنِي، عَنْ مَالِكٍ، عَنِ ابْنِ شِهَابٍ ، مِثْلَ ذَلِكَ . قَالَ مَالِكٌ فِي الْعَبْدِ يُطَلِّقُ الْأَمَةَ طَلَاقًا لَمْ يَبُتَّهَا فِيهِ : لَهُ عَلَيْهَا فِيهِ الرَّجْعَةُ، ثُمَّ يَمُوتُ وَهِيَ فِي عِدَّتِهَا مِنْ طَلَاقِهِ، إِنَّهَا تَعْتَدُّ عِدَّةَ الْأَمَةِ الْمُتَوَفَّى عَنْهَا زَوْجُهَا، شَهْرَيْنِ وَخَمْسَ لَيَالٍ، وَإِنَّهَا إِنْ عَتَقَتْ وَلَهُ عَلَيْهَا رَجْعَةٌ، ثُمَّ لَمْ تَخْتَرْ فِرَاقَهُ بَعْدَ الْعِتْقِ حَتَّى يَمُوتَ، وَهِيَ فِي عِدَّتِهَا مِنْ طَلَاقِهِ، اعْتَدَّتْ عِدَّةَ الْحُرَّةِ الْمُتَوَفَّى عَنْهَا زَوْجُهَا أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا، وَذَلِكَ أَنَّهَا إِنَّمَا وَقَعَتْ عَلَيْهَا عِدَّةُ الْوَفَاةِ بَعْدَ مَا عَتَقَتْ، فَعِدَّتُهَا عِدَّةُ الْحُرَّةِ . قَالَ مَالِكٌ : وَهَذَا الْأَمْرُ عِنْدَنَا
Ibn Shihab has also said the same.
Imam Malik, may Allah have mercy on him, said that if a slave divorces his slave woman with a revocable divorce, then dies while his wife is in her waiting period, she should observe a waiting period of two months and five days. If that slave woman is set free and does not wish to separate from her husband until her husband dies during her waiting period, then that slave woman should observe a waiting period of four months and ten days like a free woman, because after the death, the obligation of waiting period became binding on her as a free woman, so she should do as a free woman does. Imam Malik, may Allah have mercy on him, said: This is the ruling according to us.
