Hadith 1232
حَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ
يَحْيَى بْنِ سَعِيدٍ ، أَنَّهُ قَالَ : سَمِعْتُ
الْقَاسِمَ بْنَ مُحَمَّدٍ ، يَقُولُ : " إِنَّ يَزِيدَ بْنَ عَبْدِ الْمَلِكِ فَرَّقَ بَيْنَ رِجَالٍ وَبَيْنَ نِسَائِهِمْ وَكُنَّ، أُمَّهَاتِ أَوْلَادِ رِجَالٍ هَلَكُوا، فَتَزَوَّجُوهُنَّ بَعْدَ حَيْضَةٍ أَوْ حَيْضَتَيْنِ، فَفَرَّقَ بَيْنَهُمْ حَتَّى يَعْتَدُّونَ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا، فَقَالَ الْقَاسِمُ بْنُ مُحَمَّدٍ : سُبْحَانَ اللَّهِ، يَقُولُ اللَّهُ فِي كِتَابِهِ : وَالَّذِينَ يُتَوَفَّوْنَ مِنْكُمْ وَيَذَرُونَ أَزْوَاجًا سورة البقرة آية 234،
مَا هُنَّ مِنَ الْأَزْوَاجِ "
Qasim bin Muhammad used to say that Yazid bin Abdul Malik created a separation between men and those women who were umm walad, and whose masters had died, and who had married after one or two menstrual cycles. And he ordered them to observe an 'iddah of four months and ten days. Then Qasim bin Muhammad said: Subhan Allah, Allah Almighty says in His Book: "Those among you who die and leave behind wives, they should observe an 'iddah of four months and ten days." And umm walad are not included among wives.
Hadith 1233
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ
نَافِعٍ ، عَنْ
عَبْدِ اللَّهِ بْنِ عُمَرَ ، أَنَّهُ قَالَ:
" عِدَّةُ أُمِّ الْوَلَدِ إِذَا تُوُفِّيَ عَنْهَا سَيِّدُهَا، حَيْضَةٌ " . وَحَدَّثَنِي مَالِك، عَنْ يَحْيَى بْنِ سَعِيدٍ ، عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ ، أَنَّهُ كَانَ يَقُولُ: " عِدَّةُ أُمِّ الْوَلَدِ إِذَا تُوُفِّيَ عَنْهَا سَيِّدُهَا حَيْضَةٌ " . قَالَ مَالِكٌ: وَهُوَ الْأَمْرُ عِنْدَنَا . قَالَ مَالِكٌ: وَإِنْ لَمْ تَكُنْ مِمَّنْ تَحِيضُ، فَعِدَّتُهَا ثَلَاثَةُ أَشْهُرٍ
Sayyiduna Abdullah bin Umar (may Allah be pleased with them) said: When the master of an umm walad dies, she should observe the waiting period (‘iddah) for one menstrual cycle.
Hadith 1234
مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ، أَنَّهُ كَانَ يَقُولُ : عِدَّةُ أُمِّ الْوَلَدِ، إِذَا تُوُفِّيَ سَيِّدُهَا، حَيْضَةٌ . ¤ قَالَ مَالِكٌ : وَهُوَ الْأَمْرُ عِنْدَنَا . ¤
It is narrated from Qasim bin Muhammad that he used to say: When the master of an umm walad slave-woman dies, her waiting period (‘iddah) is one menstrual cycle.
Imam Malik, may Allah have mercy on him, said: According to us, this is the ruling.
Hadith 1234B1
قَالَ مَالِكٌ : فَإِنْ لَمْ تَكُنْ مِمَّنْ تَحِيضُ، فَعِدَّتُهَا ثَلَاثَةُ أَشْهُرٍ .
Imam Malik, may Allah have mercy on him, said: If this umm walad does not menstruate, then she should observe 'iddah for three months.
