Hadith 1223
حَدَّثَنِي حَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ
عَبْدِ رَبِّهِ بْنِ سَعِيدِ بْنِ قَيْسٍ ، عَنْ
أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ ، أَنَّهُ قَالَ : سُئِلَ عَبْدُ اللَّهِ بْنُ عَبَّاسٍ، وَأَبُو هُرَيْرَةَ، عَنِ الْمَرْأَةِ الْحَامِلِ يُتَوَفَّى عَنْهَا زَوْجُهَا، فَقَالَ
ابْنُ عَبَّاسٍ : آخِرَ الْأَجَلَيْنِ، وَقَالَ
أَبُو هُرَيْرَةَ : " إِذَا وَلَدَتْ فَقَدْ حَلَّتْ " فَدَخَلَ أَبُو سَلَمَةَ بْنُ عَبْدِ الرَّحْمَنِ عَلَى أُمِّ سَلَمَةَ زَوْجِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَسَأَلَهَا عَنْ ذَلِكَ، فَقَالَتْ
أُمُّ سَلَمَةَ : وَلَدَتْ سُبَيْعَةُ الْأَسْلَمِيَّةُ بَعْدَ وَفَاةِ زَوْجِهَا بِنِصْفِ شَهْرٍ، فَخَطَبَهَا رَجُلَانِ أَحَدُهُمَا شَابٌّ وَالْآخَرُ كَهْلٌ، فَحَطَّتْ إِلَى الشَّابِّ، فَقَالَ الشَّيْخُ : لَمْ تَحِلِّي بَعْدُ، وَكَانَ أَهْلُهَا غُيَّبًا، وَرَجَا إِذَا جَاءَ أَهْلُهَا أَنْ يُؤْثِرُوهُ بِهَا، فَجَاءَتْ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ :
" قَدْ حَلَلْتِ، فَانْكِحِي مَنْ شِئْتِ "
It is narrated from Abu Salamah bin Abdur Rahman that a question was asked to Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) and Sayyiduna Abu Hurairah (may Allah be pleased with him) regarding a pregnant woman whose husband dies: according to which calculation should she observe her waiting period (‘iddah)? Sayyiduna Ibn Abbas (may Allah be pleased with them both) said: She should choose whichever of the two waiting periods is longer. And Sayyiduna Abu Hurairah (may Allah be pleased with him) said: She should wait until she gives birth. Then Abu Salamah went to Umm al-Mu’minin Sayyidah Umm Salamah (may Allah be pleased with her) and asked her about it. She said: Subai’ah Aslamiyyah gave birth fifteen days after her husband died. Then two men sent her proposals—one was young and the other was older. She inclined towards the young man. The older man said: “Your ‘iddah has not yet ended,” thinking that since her relatives were not present, when they would come, perhaps they would incline the woman towards him. Then Subai’ah went to the Messenger of Allah (peace and blessings be upon him) and described the situation. He (peace and blessings be upon him) said: “Your ‘iddah has ended, so you may marry whomever you wish.”
Hadith 1224
وَحَدَّثَنِي، عَنْ مَالِك، عَنْ
نَافِعٍ ، عَنْ
عَبْدِ اللَّهِ بْنِ عُمَرَ ، أَنَّهُ سُئِلَ عَنِ الْمَرْأَةِ يُتَوَفَّى عَنْهَا زَوْجُهَا وَهِيَ حَامِلٌ، فَقَالَ عَبْدُ اللَّهِ بْنُ عُمَرَ :
" إِذَا وَضَعَتْ حَمْلَهَا، فَقَدْ حَلَّتْ " . فَأَخْبَرَهُ فَأَخْبَرَهُ
رَجُلٌ مِنْ الْأَنْصَارِ كَانَ عِنْدَهُ، أَنَّ
عُمَرَ بْنَ الْخَطَّابِ ، قَالَ :
" لَوْ وَضَعَتْ وَزَوْجُهَا عَلَى سَرِيرِهِ لَمْ يُدْفَنْ بَعْدُ، لَحَلَّتْ "
Abdullah bin Umar (may Allah be pleased with them both) was asked: If a pregnant woman's husband dies, what is her waiting period ('iddah)? Abdullah bin Umar (may Allah be pleased with them both) said: When she gives birth to the child, her waiting period is complete. At that moment, an Ansari man said: Umar bin Khattab (may Allah be pleased with him) said: If the husband's funeral is still on the bier and his wife gives birth to the child, her waiting period will be over.
Hadith 1225
وَحَدَّثَنِي، عَنْ مَالِك، عَنْ
هِشَامِ بْنِ عُرْوَةَ ، عَنْ
أَبِيهِ ، عَنِ
الْمِسْوَرِ بْنِ مَخْرَمَةَ أَنَّهُ أَخْبَرَهُ، أَنَّ سُبَيْعَةَ الْأَسْلَمِيَّةَ نُفِسَتْ بَعْدَ وَفَاةِ زَوْجِهَا بِلَيَالٍ، فَقَالَ لَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ :
" قَدْ حَلَلْتِ، فَانْكِحِي مَنْ شِئْتِ "
It is narrated from Sayyiduna Miswar bin Makhramah (may Allah be pleased with him) that Sayyidah Subai’ah Aslamiyyah (may Allah be pleased with her) gave birth to a child a few days after her husband’s death, so the Messenger of Allah (peace and blessings be upon him) said: “Now your ‘iddah has ended, you may marry whomever you wish.”
Hadith 1226
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ
يَحْيَى بْنِ سَعِيدٍ ، عَنْ
سُلَيْمَانَ بْنِ يَسَارٍ ، أَنَّ عَبْدَ اللَّهِ بْنَ عَبَّاسٍ، وَأَبَا سَلَمَةَ بْنَ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ، اخْتَلَفَا فِي الْمَرْأَةِ تُنْفَسُ بَعْدَ وَفَاةِ زَوْجِهَا بِلَيَالٍ، فَقَالَ أَبُو سَلَمَةَ : " إِذَا وَضَعَتْ مَا فِي بَطْنِهَا، فَقَدْ حَلَّتْ "، وَقَالَ ابْنُ عَبَّاسٍ : " آخِرَ الْأَجَلَيْنِ "، فَجَاءَ
أَبُو هُرَيْرَةَ ، فَقَالَ : أَنَا مَعَ ابْنِ أَخِي يَعْنِي أَبَا سَلَمَةَ فَبَعَثُوا كُرَيْبًا مَوْلَى عَبْدِ اللَّهِ بْنِ عَبَّاسٍ إِلَى
أُمِّ سَلَمَةَ زَوْجِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، يَسْأَلُهَا عَنْ ذَلِكَ، فَجَاءَهُمْ، فَأَخْبَرَهُمْ أَنَّهَا قَالَتْ :
وَلَدَتْ سُبَيْعَةُ الْأَسْلَمِيَّةُ بَعْدَ وَفَاةِ زَوْجِهَا بِلَيَالٍ، فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ : " قَدْ حَلَلْتِ، فَانْكِحِي مَنْ شِئْتِ " . قَالَ مَالِكٌ : وَهَذَا الْأَمْرُ الَّذِي لَمْ يَزَلْ عَلَيْهِ أَهْلُ الْعِلْمِ عِنْدَنَا
It is narrated from Sulayman bin Yasar that Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) and Abu Salamah bin Abdur Rahman differed regarding the waiting period (‘iddah) of a woman who gives birth fifteen days after her husband’s death. Abu Salamah said: When she gives birth, her ‘iddah is over, and Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) said: No, she should wait for whichever of the two waiting periods is longer. Meanwhile, Sayyiduna Abu Hurairah (may Allah be pleased with him) came and said: I am with my brother Abu Salamah. Then all of them sent Kurayb, who was the freed slave of Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both), to Umm al-Mu’minin Sayyidah Umm Salamah (may Allah be pleased with her) to ask her about this issue. She said that Subay’ah Aslamiyyah gave birth a few days after her husband’s death. When she mentioned this to the Prophet (peace and blessings be upon him), he said: “You have become lawful, so you may marry whomever you wish.”
Imam Malik (may Allah have mercy on him) said: This is the ruling according to us, and the scholars of our city have remained upon this view.
