Hadith 1201
حَدَّثَنَا حَدَّثَنَا يَحْيَى، عَنْ مَالِك، عَنْ
يَحْيَى بْنِ سَعِيدٍ ، عَنِ
الْقَاسِمِ بْنِ مُحَمَّدٍ ،
وَسُلَيْمَانَ بْنِ يَسَارٍ ، أَنَّهُ سَمِعَهُمَا يَذْكُرَانِ أَنَّ يَحْيَى بْنَ سَعِيدِ بْنِ الْعَاصِ طَلَّقَ ابْنَةَ عَبْدِ الرَّحْمَنِ بْنِ الْحَكَمِ الْبَتَّةَ، فَانْتَقَلَهَا عَبْدُ الرَّحْمَنِ بْنُ الْحَكَمِ، فَأَرْسَلَتْ
عَائِشَةُ أُمُّ الْمُؤْمِنِينَ إِلَى مَرْوَانَ بْنِ الْحَكَمِ، وَهُوَ يَوْمَئِذٍ أَمِيرُ الْمَدِينَةِ، فَقَالَتْ : اتَّقِ اللَّهَ، وَارْدُدِ الْمَرْأَةَ إِلَى بَيْتِهَا، فَقَالَ مَرْوَانُ فِي حَدِيثِ سُلَيْمَانَ : إِنَّ عَبْدَ الرَّحْمَنِ غَلَبَنِي، وَقَالَ مَرْوَانُ فِي حَدِيثِ الْقَاسِمِ : أَوَ مَا بَلَغَكِ شَأْنُ فَاطِمَةَ بِنْتِ قَيْسٍ ؟ فَقَالَتْ عَائِشَةُ : لَا يَضُرُّكَ أَنْ لَا تَذْكُرَ حَدِيثَ فَاطِمَةَ، فَقَالَ مَرْوَانُ :
" إِنْ كَانَ بِكِ الشَّرُّ فَحَسْبُكِ مَا بَيْنَ هَذَيْنِ مِنَ الشَّرِّ "
Qasim bin Muhammad and Sulayman bin Yasar used to mention that Yahya bin Sa'id divorced the daughter of Abdur Rahman bin Hakam with a final irrevocable divorce. Her father, Abdur Rahman, had her moved from that house, so Lady Aisha, may Allah be pleased with her, sent a message to Marwan, who was the governor of Madinah at that time: Fear Allah and return the woman to the house in which she was divorced. In Sulayman's narration, it is stated that Marwan said: Abdur Rahman has authority over me (I cannot stop him), and in Qasim's narration, Marwan said to Lady Aisha, may Allah be pleased with her: Do you not remember the hadith of Lady Fatimah bint Qays, may Allah be pleased with her? Lady Aisha, may Allah be pleased with her, said: If you do not remember the hadith of Lady Fatimah bint Qays, may Allah be pleased with her, it does not matter. Marwan said: If, according to you, the reason for Lady Fatimah bint Qays moving was that there was a dispute between the wife and husband, then that reason is also present here.
Hadith 1202
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ
نَافِعٍ ، " أَنَّ بِنْتَ سَعِيدِ بْنِ زَيْدِ بْنِ عَمْرِو بْنِ نُفَيْلٍ، كَانَتْ تَحْتَ عَبْدِ اللَّهِ بْنِ عَمْرِو بْنِ عُثْمَانَ بْنِ عَفَّانَ،
فَطَلَّقَهَا الْبَتَّةَ، فَانْتَقَلَتْ، فَأَنْكَرَ ذَلِكَ عَلَيْهَا عَبْدُ اللَّهِ بْنُ عُمَرَ "
It is narrated from Nafi that the daughter of Sa'id bin Zaid was married to Abdullah bin Amr bin Uthman. He gave her three divorces, and she left that house. Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) disliked this.
Hadith 1203
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ
نَافِعٍ ، أَنَّ
عَبْدَ اللَّهِ بْنَ عُمَرَ " طَلَّقَ امْرَأَةً لَهُ فِي مَسْكَنِ حَفْصَةَ زَوْجِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، وَكَانَ طَرِيقَهُ إِلَى الْمَسْجِدِ، فَكَانَ
يَسْلُكُ الطَّرِيقَ الْأُخْرَى مِنْ أَدْبَارِ الْبُيُوتِ كَرَاهِيَةَ أَنْ يَسْتَأْذِنَ عَلَيْهَا، حَتَّى رَاجَعَهَا "
It is narrated from Nafi‘ that Sayyiduna Abdullah bin Umar (may Allah be pleased with them) divorced his wife in the house of Sayyidah Hafsah (may Allah be pleased with her), and from her house there was a way to the mosque. Sayyiduna Abdullah bin Umar (may Allah be pleased with them) used to go by another route from behind the houses, because he considered it disliked to enter the house of a divorced woman without permission and without having taken her back.
Hadith 1204
وَحَدَّثَنِي، عَنْ مَالِك، عَنْ
يَحْيَى بْنِ سَعِيدٍ ، أَنَّ سَعِيدَ بْنَ الْمُسَيَّبِ سُئِلَ عَنِ الْمَرْأَةِ يُطَلِّقُهَا زَوْجُهَا وَهِيَ فِي بَيْتٍ بِكِرَاءٍ، عَلَى مَنِ الْكِرَاءُ ؟ فَقَالَ
سَعِيدُ بْنُ الْمُسَيَّبِ :
" عَلَى زَوْجِهَا "، قَالَ : فَإِنْ لَمْ يَكُنْ عِنْدَ زَوْجِهَا ؟ قَالَ : " فَعَلَيْهَا "، قَالَ : فَإِنْ لَمْ يَكُنْ عِنْدَهَا ؟ قَالَ : " فَعَلَى الْأَمِيرِ "
It is narrated from Yahya ibn Sa'id that Sa'id ibn al-Musayyib was asked: If a woman is living in a rented house and her husband divorces her, who will pay the rent during the waiting period ('iddah)? Sa'id said: The husband will pay. He was asked: What if the husband does not have (the means)? Sa'id said: The wife will pay. He was asked: What if the wife also does not have (the means)? Sa'id said: The ruler will pay.
