Hadith 1191
عَنْ نَافِعٍ، أَنَّ عَبْدَ اللّٰهِ بْنَ عُمَرَ طَلَّقَ امْرَأَتَهُ، وَهِيَ حَائِضٌ عَلَى عَهْدِ رَسُولِ اللّٰهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَسَأَلَ عُمَرُ بْنُ الْخَطَّابِ رَسُولَ اللّٰهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ عَنْ ذَلِكَ، فَقَالَ رَسُولُ اللّٰهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ : ” مُرْهُ فَلْيُرَاجِعْهَا، ثُمَّ يُمْسِكْهَا حَتَّى تَطْهُرَ، ثُمَّ تَحِيضَ، ثُمَّ تَطْهُرَ، ثُمَّ إِنْ شَاءَ أَمْسَكَ بَعْدُ، وَإِنْ شَاءَ طَلَّقَ، قَبْلَ أَنْ يَمَسَّ فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ اللّٰهُ أَنْ يُطَلَّقَ لَهَا النِّسَاءُ.“
It is narrated from Nafi‘ that Abdullah bin Umar (may Allah be pleased with them both) divorced his wife during her menstrual period in the time of the Messenger of Allah (peace be upon him). Umar bin Khattab (may Allah be pleased with him) mentioned this to the Messenger of Allah (peace be upon him). He (peace be upon him) said: "Command him to take her back, then let her remain with him until she becomes pure from her menstruation, then menstruates again, then becomes pure. Then he has the choice: either to keep her or to divorce her. If he divorces her, he should not have intercourse with her during that period of purity. This is the waiting period in which Allah has commanded divorce to be given."
Hadith 1192
عَنْ عَائِشَةَ أُمِّ الْمُؤْمِنِينَ أَنَّهَا انْتَقَلَتْ حَفْصَةَ بِنْتَ عَبْدِ الرَّحْمٰنِ بْنِ أَبِي بَكْرٍ الصِّدِّيقِ حِينَ دَخَلَتْ فِي الدَّمِ مِنَ الْحَيْضَةِ الثَّالِثَةِ، قَالَ ابْنُ شِهَابٍ فَذُكِرَ ذَلِكَ لِعَمْرَةَ بِنْتِ عَبْدِ الرَّحْمٰنِ فَقَالَتْ : صَدَقَ عُرْوَةُ وَقَدْ جَادَلَهَا فِي ذَلِكَ نَاسٌ، فَقَالُوا : إِنَّ اللّٰهَ تَبَارَكَ وَتَعَالَى يَقُولُ فِي كِتَابِهِ : ﴿ثَلَاثَةَ قُرُوءٍ﴾ [البقرة: 228] فَقَالَتْ عَائِشَةُ : صَدَقْتُمْ، تَدْرُونَ مَا الْأَقْرَاءُ؟ إِنَّمَا الْأَقْرَاءُ الْأَطْهَارُ.
Lady Aisha (may Allah be pleased with her) allowed her niece Hafsa bint Abdur Rahman to complete her waiting period (‘iddah) when her third menstrual period began. Ibn Shihab (may Allah have mercy on him) said: I narrated this from Umrah bint Abdur Rahman. Umrah said: Urwah spoke the truth, in fact, people argued with Lady Aisha (may Allah be pleased with her) regarding this matter and said that Allah Almighty says: "Divorced women shall keep themselves in waiting for three periods (quroo’)." She said: You speak the truth, but do you know what is meant by quroo’? By quroo’, purity (tuhr) is meant.
Hadith 1193
عَنْ ابْنِ شِهَابٍ أَنَّهُ قَالَ سَمِعْتُ أَبَا بَكْرِ بْنَ عَبْدِ الرَّحْمٰنِ يَقُولُ : مَا أَدْرَكْتُ أَحَدًا مِنْ فُقَهَائِنَا إِلَّا وَهُوَ يَقُولُ هَذَا يُرِيدُ قَوْلَ عَائِشَةَ.
Ibn Shihab said: I heard Abu Bakr bin Abdur Rahman say: I found all the jurists saying like Lady Aisha, may Allah be pleased with her.
Hadith 1194
عَنْ سُلَيْمَانَ بْنِ يَسَارٍ أَنَّ الْأَحْوَصَ هَلَكَ بِالشَّامِ، حِينَ دَخَلَتِ امْرَأَتُهُ فِي الدَّمِ مِنَ الْحَيْضَةِ الثَّالِثَةِ، وَقَدْ كَانَ طَلَّقَهَا، فَكَتَبَ مُعَاوِيَةُ بْنُ أَبِي سُفْيَانَ إِلَى زَيْدِ بْنِ ثَابِتٍ، يَسْأَلُهُ عَنْ ذَلِكَ فَكَتَبَ إِلَيْهِ زَيْدٌ إِنَّهَا : إِذَا دَخَلَتْ فِي الدَّمِ مِنَ الْحَيْضَةِ الثَّالِثَةِ، فَقَدْ بَرِئَتْ مِنْهُ وَبَرِئَ مِنْهَا وَلَا تَرِثُهُ وَلَا يَرِثُهَا.
It is narrated from Sulayman bin Yasar that Ahwas divorced his wife. When her third menstrual period began, Ahwas died. Muawiyah bin Abi Sufyan wrote to Sayyiduna Zayd bin Thabit (may Allah be pleased with him) asking: What is the ruling regarding this? Sayyiduna Zayd bin Thabit (may Allah be pleased with him) wrote in reply that when her third menstrual period began, the husband no longer had any relation to her, nor she to the husband. She will not inherit from him, nor will he inherit from her.
Hadith 1195
عَنْ مَالِكٍ أَنَّهُ بَلَغَهُ، عَنْ الْقَاسِمِ بْنِ مُحَمَّدٍ، وَسَالِمِ بْنِ عَبْدِ اللّٰهِ، وَأَبِي بَكْرِ بْنِ عَبْدِ الرَّحْمٰنِ، وَسُلَيْمَانَ بْنِ يَسَارٍ، وَابْنِ شِهَابٍ، أَنَّهُمْ كَانُوا يَقُولُونَ : إِذَا دَخَلَتِ الْمُطَلَّقَةُ فِي الدَّمِ مِنَ الْحَيْضَةِ الثَّالِثَةِ، فَقَدْ بَانَتْ مِنْ زَوْجِهَا، وَلَا مِيرَاثَ بَيْنَهُمَا وَلَا رَجْعَةَ لَهُ عَلَيْهَا.
It reached Imam Malik, may Allah have mercy on him, that Qasim bin Muhammad, Salim bin Abdullah, Abu Bakr bin Abdur Rahman, Sulaiman bin Yasar, and Ibn Shihab used to say: When a divorced woman begins her third menstruation, she becomes separated (bain) from her husband, and the husband no longer has the right to take her back. Now, neither will inherit from the other.
Hadith 1196
عَنْ عَبْدِ اللّٰهِ بْنِ عُمَرَ أَنَّهُ كَانَ يَقُولُ : إِذَا طَلَّقَ الرَّجُلُ امْرَأَتَهُ، فَدَخَلَتْ فِي الدَّمِ مِنَ الْحَيْضَةِ الثَّالِثَةِ، فَقَدْ بَرِئَتْ مِنْهُ، وَبَرِئَ مِنْهَا وَلَا تَرِثُهُ وَلَا يَرِثُهَا.
Sayyiduna Abdullah bin Umar (may Allah be pleased with them) used to say: When a man divorces his wife and her third menstruation begins, then the woman no longer has any relation with her husband, nor does the husband with her; neither will he inherit from her nor will she inherit from him.
Hadith 1197
عَنِ الْفُضَيْلِ بْنِ أَبِي عَبْدِ اللّٰهِ مَوْلَى الْمَهْرِيِّ، أَنَّ الْقَاسِمَ بْنَ مُحَمَّدٍ، وَسَالِمَ بْنَ عَبْدِ اللّٰهِ، كَانَا يَقُولَانِ : إِذَا طُلِّقَتِ الْمَرْأَةُ فَدَخَلَتْ فِي الدَّمِ مِنَ الْحَيْضَةِ الثَّالِثَةِ، فَقَدْ بَانَتْ مِنْهُ وَحَلَّتْ.
It is narrated from Fudail bin Abi Abdullah that Qasim bin Muhammad and Salim bin Abdullah used to say: When a divorced woman begins her third menstruation, she becomes separated from her husband, and it becomes permissible for her to marry another man.
Hadith 1198
وَحَدَّثَنِي، عَنْ مَالِك، أَنَّهُ بَلَغَهُ، عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ، وَابْنِ شِهَابٍ، وَسُلَيْمَانَ بْنِ يَسَارٍ، أَنَّهُمْ كَانُوا يَقُولُونَ : " إِنَّ عِدَّةَ الْمُخْتَلِعَةِ ثَلَاثَةُ قُرُوءٍ "
It reached Imam Malik, may Allah have mercy on him, that Sa'id bin al-Musayyib, Ibn Shihab, and Sulayman bin Yasar used to say: The waiting period ('iddah) of a woman who seeks khul' is three menstrual cycles (quru').
Hadith 1199
وَحَدَّثَنِي، عَنْ مَالِك، أَنَّهُ سَمِعَ ابْنَ شِهَابٍ، يَقُولُ : " عِدَّةُ الْمُطَلَّقَةِ الْأَقْرَاءُ، وَإِنْ تَبَاعَدَتْ "
Ibn Shihab used to say: The waiting period (‘iddah) of a divorced woman will be counted from the days of purity, even if they are many days.
Hadith 1200
وَحَدَّثَنِي، عَنْ مَالِك، عَنْ
يَحْيَى بْنِ سَعِيدٍ ، عَنْ
رَجُلٍ مِنَ الْأَنْصَارِ، أَنَّ امْرَأَتَهُ سَأَلَتْهُ الطَّلَاقَ، فَقَالَ لَهَا :
" إِذَا حِضْتِ فَآذِنِينِي "، فَلَمَّا حَاضَتْ آذَنَتْهُ، فَقَالَ : " إِذَا طَهُرْتِ فَآذِنِينِي "، فَلَمَّا طَهُرَتْ آذَنَتْهُ، فَطَلَّقَهَا . قَالَ مَالِك : وَهَذَا أَحْسَنُ مَا سَمِعْتُ فِي ذَلِكَ
The wife of an Ansari asked her husband for a divorce. He said: When you get your period, inform me. When she got her period, she informed him. He said: When you become pure, inform me. When she became pure and informed him, he then divorced her.
Imam Malik, may Allah have mercy on him, said: I have heard this as good.
