Hadith 1167
حَدَّثَنِي حَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ
نَافِعٍ ، أَنَّ رُبَيِّعَ بِنْتَ مُعَوَّذِ بْنِ عَفْرَاءَ جَاءَتْ هِيَ وَعَمُّهَا إِلَى عَبْدِ اللَّهِ بْنِ عُمَرَ، فَأَخْبَرَتْهُ أَنَّهَا اخْتَلَعَتْ مِنْ زَوْجِهَا فِي زَمَانِ عُثْمَانَ بْنِ عَفَّانَ، فَبَلَغَ ذَلِكَ
عُثْمَانَ بْنَ عَفَّانَ ، فَلَمْ يُنْكِرْهُ، وَقَالَ
عَبْدُ اللَّهِ بْنُ عُمَرَ :
" عِدَّتُهَا عِدَّةُ الْمُطَلَّقَةِ "
It is narrated from Nafi that Rabi' bint Mu'awwiz bin 'Afra and her paternal aunt came to Abdullah bin Umar (may Allah be pleased with them) and stated that they had taken khul' from their husbands during the time of Uthman (may Allah be pleased with him). When this news reached Uthman (may Allah be pleased with him), he did not object to it. Abdullah bin Umar (may Allah be pleased with them) said: The waiting period ('iddah) of a woman who takes khul' is like the waiting period of a divorced woman.
Hadith 1168
وَحَدَّثَنِي، عَنْ مَالِكٍ، أَنَّهُ بَلَغَهُ، أَنَّ سَعِيدَ بْنَ الْمُسَيَّبِ، وَسُلَيْمَانَ بْنَ يَسَارٍ، وَابْنَ شِهَابٍ، كَانُوا يَقُولُونَ : " عِدَّةُ الْمُخْتَلِعَةِ مِثْلُ عِدَّةِ الْمُطَلَّقَةِ ثَلَاثَةُ قُرُوءٍ " .
Imam Malik (may Allah have mercy on him) was informed that Sa'id bin al-Musayyib, Sulayman bin Yasar, and Ibn Shihab used to say: A woman who obtains khul' should observe 'iddah for three periods of purity, just as a divorced woman observes 'iddah.
Hadith 1168B1
. قَالَ مَالِكٌ فِي الْمُفْتَدِيَةِ : إِنَّهَا لَا تَرْجِعُ إِلَى زَوْجِهَا إِلَّا بِنِكَاحٍ جَدِيدٍ، فَإِنْ هُوَ نَكَحَهَا، فَفَارَقَهَا قَبْلَ أَنْ يَمَسَّهَا، لَمْ يَكُنْ لَهُ عَلَيْهَا عِدَّةٌ مِنَ الطَّلَاقِ الْآخَرِ، وَتَبْنِي عَلَى عِدَّتِهَا الْأُولَى . قَالَ مَالِكٌ : وَهَذَا أَحْسَنُ مَا سَمِعْتُ فِي ذَلِكَ
Imam Malik, may Allah have mercy on him, said: If a woman ransoms herself with wealth, she cannot return to her husband unless she contracts a new marriage. Then, if she marries the same husband and he divorces her before consummation, she does not have to observe a new waiting period, but rather completes the first waiting period.
Imam Malik, may Allah have mercy on him, said: This is what I have heard as good.
Hadith 1168B2
. قَالَ مَالِكٌ : إِذَا افْتَدَتِ الْمَرْأَةُ مِنْ زَوْجِهَا بِشَيْءٍ، عَلَى أَنْ يُطَلِّقَهَا، فَطَلَّقَهَا طَلَاقًا مُتَتَابِعًا نَسَقًا، فَذَلِكَ ثَابِتٌ عَلَيْهِ، فَإِنْ كَانَ بَيْنَ ذَلِكَ صُمَاتٌ، فَمَا أَتْبَعَهُ بَعْدَ الصُّمَاتِ، فَلَيْسَ بِشَيْءٍ
Imam Malik, may Allah have mercy on him, said: When a woman gives some wealth on the condition that her husband divorces her, and the husband gives her three divorces at once, then three divorces will take effect. And if he gives one divorce and remains silent, then gives a second or third divorce, the divorce given after remaining silent will be void.
