بَابُ ظِهَارِ الْعَبْدِ
Zihar (declaring wife as unlawful) by a slave
Hadith 1159
حَدَّثَنِي يَحْيَى، عَنْ مَالِك، أَنَّهُ سَأَلَ ابْنَ شِهَابٍ عَنْ ظِهَارِ الْعَبْدِ، فَقَالَ : " نَحْوُ ظِهَارِ الْحُرِّ " .
Imam Malik, may Allah have mercy on him, asked Ibn Shihab, may Allah have mercy on him, about the case of the slave's zihar. He said: It is like that of a free man.
Hadith 1159B1
قَالَ مَالِكٌ : يُرِيدُ أَنَّهُ يَقَعُ عَلَيْهِ كَمَا يَقَعُ عَلَى الْحُرِّ . قَالَ مَالِكٌ : وَظِهَارُ الْعَبْدِ عَلَيْهِ وَاجِبٌ، وَصِيَامُ الْعَبْدِ فِي الظِّهَارِ شَهْرَانِ . قَالَ مَالِكٌ فِي الْعَبْدِ يَتَظَاهَرُ مِنَ امْرَأَتِهِ : إِنَّهُ لَا يَدْخُلُ عَلَيْهِ إِيلَاءٌ، وَذَلِكَ أَنَّهُ لَوْ ذَهَبَ يَصُومُ صِيَامَ كَفَّارَةِ الْمُتَظَاهِرِ، دَخَلَ عَلَيْهِ طَلَاقُ الْإِيلَاءِ قَبْلَ أَنْ يَفْرُغَ مِنْ صِيَامِهِ
Imam Malik, may Allah have mercy on him, said: Expiation is also obligatory upon a slave just as it is upon a free person.
