Hadith 1136
حَدَّثَنِي حَدَّثَنِي يَحْيَى، عَنْ مَالِك، أَنَّهُ بَلَغَهُ، أَنَّهُ كُتِبَ إِلَى عُمَرَ بْنِ الْخَطَّابِ مِنَ الْعِرَاقِ، أَنَّ رَجُلًا، قَالَ لِامْرَأَتِهِ : حَبْلُكِ عَلَى غَارِبِكِ، فَكَتَبَ عُمَرُ بْنُ الْخَطَّابِ إِلَى عَامِلِهِ : " أَنْ مُرْهُ يُوَافِينِي بِمَكَّةَ فِي الْمَوْسِمِ "، فَبَيْنَمَا عُمَرُ يَطُوفُ بِالْبَيْتِ، إِذْ لَقِيَهُ الرَّجُلُ، فَسَلَّمَ عَلَيْهِ، فَقَالَ عُمَرُ : " مَنْ أَنْتَ ؟ " فَقَالَ : أَنَا الَّذِي أَمَرْتَ أَنْ أُجْلَبَ عَلَيْكَ، فَقَالَ لَهُ عُمَرُ : " أَسْأَلُكَ بِرَبِّ هَذِهِ الْبَنِيَّةِ، مَا أَرَدْتَ بِقَوْلِكَ حَبْلُكِ عَلَى غَارِبِكِ "، فَقَالَ لَهُ الرَّجُلُ : لَوِ اسْتَحْلَفْتَنِي فِي غَيْرِ هَذَا الْمَكَانِ مَا صَدَقْتُكَ، أَرَدْتُ بِذَلِكَ الْفِرَاقَ، فَقَالَ عُمَرُ بْنُ الْخَطَّابِ : " هُوَ مَا أَرَدْتَ "
A written message came to Sayyiduna Umar ibn Khattab (may Allah be pleased with him) that a man said to his wife: «حَبْلُكِ عَلَى غَارِبِكِ». Sayyiduna Umar ibn Khattab (may Allah be pleased with him) wrote: Tell this man to meet me in Makkah during the Hajj season. Sayyiduna Umar ibn Khattab (may Allah be pleased with him) was performing Tawaf of the Ka'bah when a man met him and greeted him with salam. He asked: Who are you? He replied: I am the one whom you instructed to meet you in Makkah. Sayyiduna Umar ibn Khattab (may Allah be pleased with him) said: I swear by the Lord of this House, what did you mean by «حَبْلُكِ عَلَى غَارِبِكِ»? He replied: O Commander of the Faithful! If you had made me swear anywhere else, I would not have told the truth, but now I will tell the truth: my intention was to leave her. Sayyiduna Umar ibn Khattab (may Allah be pleased with him) said: It will be as you intended.
Hadith 1137
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِكٍ، أَنَّهُ بَلَغَهُ، أَنَّ عَلِيَّ بْنَ أَبِي طَالِبٍ، كَانَ يَقُولُ فِي الرَّجُلِ يَقُولُ لِامْرَأَتِهِ أَنْتِ عَلَيَّ حَرَامٌ : " إِنَّهَا ثَلَاثُ تَطْلِيقَاتٍ " . قَالَ مَالِكٌ : وَذَلِكَ أَحْسَنُ مَا سَمِعْتُ فِي ذَلِكَ
Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) used to say: Whoever says to his wife, "You are forbidden to me," three divorces will take place.
Imam Malik (may Allah have mercy on him) said: This narration is very good in my view.
Hadith 1138
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ
نَافِعٍ ، أَنَّ
عَبْدَ اللَّهِ بْنَ عُمَرَ ، كَانَ يَقُولُ فِي الْخَلِيَّةِ وَالْبَرِيَّةِ :
" إِنَّهَا ثَلَاثُ تَطْلِيقَاتٍ، كُلُّ وَاحِدَةٍ مِنْهُمَا "
Sayyiduna Abdullah bin Umar (may Allah be pleased with them) used to say: In Khul‘ and Bari’ah, in each of them, three divorces will take effect.
Hadith 1139
وَحَدَّثَنِي، عَنْ مَالِك، عَنْ
يَحْيَى بْنِ سَعِيدٍ ، عَنِ
الْقَاسِمِ بْنِ مُحَمَّدٍ ، " أَنَّ
رَجُلًا كَانَتْ تَحْتَهُ وَلِيدَةٌ لِقَوْمٍ، فَقَالَ لِأَهْلِهَا : شَأْنَكُمْ بِهَا، فَرَأَى النَّاسُ أَنَّهَا تَطْلِيقَةٌ وَاحِدَةٌ "
It is narrated from Hazrat Qasim bin Muhammad that a man had a slave-girl in his marriage. He said to the owners of the slave-girl: "You know, your matter knows." People considered this as one divorce.
Hadith 1140
وَحَدَّثَنِي، عَنْ مَالِك، أَنَّهُ سَمِعَ ابْنَ شِهَابٍ، يَقُولُ فِي الرَّجُلِ يَقُولُ لِامْرَأَتِهِ بَرِئْتِ مِنِّي وَبَرِئْتُ مِنْكِ : " إِنَّهَا ثَلَاثُ تَطْلِيقَاتٍ، بِمَنْزِلَةِ الْبَتَّةِ " .
Ibn Shihab used to say: If a man says to a woman, "I am free from you and you are free from me," then three divorces will take place, like an irrevocable divorce.
Hadith 1140B1
قَالَ مَالِكٌ، فِي الرَّجُلِ يَقُولُ لِامْرَأَتِهِ أَنْتِ خَلِيَّةٌ أَوْ بَرِيَّةٌ أَوْ بَائِنَةٌ : إِنَّهَا ثَلَاثُ تَطْلِيقَاتٍ لِلْمَرْأَةِ الَّتِي قَدْ دَخَلَ بِهَا، وَيُدَيَّنُ فِي الَّتِي لَمْ يَدْخُلْ بِهَا، أَوَاحِدَةً أَرَادَ، أَمْ ثَلَاثًا ؟ فَإِنْ قَالَ وَاحِدَةً، أُحْلِفَ عَلَى ذَلِكَ، وَكَانَ خَاطِبًا مِنَ الْخُطَّابِ، لِأَنَّهُ لَا يُخْلِي الْمَرْأَةَ الَّتِي قَدْ دَخَلَ بِهَا زَوْجُهَا، وَلَا يُبِينُهَا وَلَا يُبْرِيهَا، إِلَّا ثَلَاثُ تَطْلِيقَاتٍ، وَالَّتِي لَمْ يَدْخُلْ بِهَا تُخْلِيهَا وَتُبْرِيهَا، وَتُبِينُهَا الْوَاحِدَةُ . قَالَ مَالِكٌ : وَهَذَا أَحْسَنُ مَا سَمِعْتُ فِي ذَلِكَ
Imam Malik, may Allah have mercy on him, said: If a man says to his wife: "You are Khaliyyah (released)," or "Bariyyah (free)," or "Bainah (separated)," then if he has had intercourse with that woman, three divorces will take effect. And if he has not had intercourse, then it will be according to his intention. If he says: "I intended only one," then he will be considered truthful upon taking an oath. However, the woman will become separated (bain) with just one divorce, and he cannot take her back, but he can marry her again with a new contract, because a woman with whom intercourse has not taken place becomes separated (bain) with just one divorce, while the one with whom intercourse has taken place becomes separated (bain) with three divorces.
