Hadith 1126
حَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ
زَيْدِ بْنِ أَسْلَمَ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ :
" إِذَا تَزَوَّجَ أَحَدُكُمُ الْمَرْأَةَ، أَوِ اشْتَرَى الْجَارِيَةَ، فَلْيَأْخُذْ بِنَاصِيَتِهَا، وَلْيَدْعُ بِالْبَرَكَةِ، وَإِذَا اشْتَرَى الْبَعِيرَ، فَلْيَأْخُذْ بِذِرْوَةِ سَنَامِهِ، وَلْيَسْتَعِذْ بِاللَّهِ مِنَ الشَّيْطَانِ "
It is narrated from Sayyiduna Zaid bin Aslam (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "When any of you marries a woman or buys a slave-girl, he should take hold of her forehead and pray for blessing, and when he buys a camel, he should place his hand on its hump and seek refuge from the accursed devil."
Hadith 1127
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ
أَبِي الزُّبَيْرِ الْمَكِّيِّ : أَنَّ رَجُلًا خَطَبَ إِلَى رَجُلٍ أُخْتَهُ، فَذَكَرَ أَنَّهَا قَدْ كَانَتْ أَحْدَثَتْ فَبَلَغَ ذَلِكَ
عُمَرَ بْنَ الْخَطَّابِ فَضَرَبَهُ أَوْ كَادَ يَضْرِبُهُ، ثُمَ قَالَ :
" مَا لَكَ وَلِلْخَبَرِ "
It is narrated from Abu Zubair Makki that a man proposed marriage to another man's sister. He stated that the woman was immoral. When this news reached Sayyiduna Umar, may Allah be pleased with him, he summoned that man and beat him or intended to beat him, and said, "What was your purpose in conveying this news?"
Hadith 1128
It is narrated from Rabi'ah bin Abu Abdur Rahman that Qasim bin Muhammad and Urwah bin Zubair used to say: If a man has four wives, and then he gives three divorces to one of them, he can marry another woman in her place; it is not necessary to wait for her 'iddah to finish.
Hadith 1129
وَحَدَّثَنِي، عَنْ مَالِكٍ، عَنْ رَبِيعَةَ بْنِ أَبِي عَبْدِ الرَّحْمَنِ، أَنَّ الْقَاسِمَ بْنَ مُحَمَّدٍ، وَعُرْوَةَ بْنَ الزُّبَيْرِ أَفْتَيَا الْوَلِيدَ بْنَ عَبْدِ الْمَلِكِ عَامَ قَدِمَ الْمَدِينَةَ بِذَلِكَ، غَيْرَ أَنَّ الْقَاسِمَ بْنَ مُحَمَّدٍ، قَالَ : " طَلَّقَهَا فِي مَجَالِسَ شَتَّى "
It is narrated from Rabi'ah bin Abu Abdur Rahman that Qasim bin Muhammad and Urwah bin Zubair gave the same fatwa to Walid bin Abdul Malik in the year he came to Madinah, but Qasim bin Muhammad said that the woman had been divorced in several sittings.
Hadith 1130
Saeed bin Musayyib said that there are three things in which there is no jest: marriage, divorce, and emancipation.
Hadith 1131
وَحَدَّثَنِي، عَنْ مَالِك، عَنِ
ابْنِ شِهَابٍ ، عَنْ
رَافِعِ بْنِ خَدِيجٍ ، أَنَّهُ تَزَوَّجَ بِنْتَ مُحَمَّدِ بْنِ مَسْلَمَةَ الْأَنْصَارِيِّ، فَكَانَتْ عِنْدَهُ حَتَّى كَبِرَتْ، فَتَزَوَّجَ عَلَيْهَا فَتَاةً شَابَّةً، فَآثَرَ الشَّابَّةَ عَلَيْهَا، فَنَاشَدَتْهُ الطَّلَاقَ، فَطَلَّقَهَا وَاحِدَةً ثُمَّ أَمْهَلَهَا، حَتَّى إِذَا كَادَتْ تَحِلُّ رَاجَعَهَا، ثُمَّ عَادَ فَآثَرَ الشَّابَّةَ، فَنَاشَدَتْهُ الطَّلَاقَ، فَطَلَّقَهَا وَاحِدَةً، ثُمَّ رَاجَعَهَا، ثُمَّ عَادَ فَآثَرَ الشَّابَّةَ، فَنَاشَدَتْهُ الطَّلَاقَ، فَقَالَ :
" مَا شِئْتِ، إِنَّمَا بَقِيَتْ وَاحِدَةٌ، فَإِنْ شِئْتِ اسْتَقْرَرْتِ عَلَى مَا تَرَيْنَ مِنَ الْأُثْرَةِ، وَإِنْ شِئْتِ فَارَقْتُكِ "، قَالَتْ : بَلْ أَسْتَقِرُّ عَلَى الْأُثْرَةِ، فَأَمْسَكَهَا عَلَى ذَلِكَ، وَلَمْ يَرَ رَافِعٌ عَلَيْهِ إِثْمًا حِينَ قَرَّتْ عِنْدَهُ عَلَى الْأُثْرَةِ
Hazrat Rafi’ bin Khadij married the daughter of Muhammad bin Maslamah Ansari. She stayed with him, and when she became old, Rafi’ married a young woman and became more inclined towards her. The old woman asked for a divorce, so Muhammad bin Maslamah gave her one divorce. Then, when her waiting period was about to end, he took her back, but remained inclined towards the young woman. The old woman again asked for a divorce, so he gave her another divorce. Then, when her waiting period was about to end, he took her back, but remained inclined towards the young woman. The old woman again asked for a divorce. Then Rafi’ bin Khadij said: Now what do you want? Only one divorce remains. If you wish to stay with me in this condition, then stay; and if you cannot, then I will let you go. She said: I wish to stay in this condition. Rafi’ kept her and did not consider himself sinful for it.
