Hadith 1113
حَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنِ
ابْنِ شِهَابٍ ، عَنْ
سَعِيدِ بْنِ الْمُسَيَّبِ ، أَنَّهُ قَالَ :
" الْمُحْصَنَاتُ مِنَ النِّسَاءِ هُنَّ أُولَاتُ الْأَزْوَاجِ، وَيَرْجِعُ ذَلِكَ إِلَى أَنَّ اللَّهَ حَرَّمَ الزِّنَا "
Saeed bin Musayyib said that by «محصنات» are meant those women who have husbands; its meaning is that Allah has forbidden adultery.
Hadith 1114
وَحَدَّثَنِي، عَنْ مَالِك، عَنِ
ابْنِ شِهَابٍ ، وَبَلَغَهُ، عَنِ
الْقَاسِمِ بْنِ مُحَمَّدٍ ، أَنَّهُمَا كَانَا يَقُولَانِ :
" إِذَا نَكَحَ الْحُرُّ الْأَمَةَ فَمَسَّهَا، فَقَدْ أَحْصَنَتْهُ " . ¤
Ibn Shihab and Qasim bin Muhammad used to say: If a free man marries a slave woman and has intercourse with her, then he becomes muhsan.
Hadith 1114B1
قَالَ مَالِك : وَكُلُّ مَنْ أَدْرَكْتُ كَانَ يَقُولُ ذَلِكَ، تُحْصِنُ الْأَمَةُ الْحُرَّ إِذَا نَكَحَهَا فَمَسَّهَا فَقَدْ أَحْصَنَتْهُ . ¤
Imam Malik, may Allah have mercy on him, said: I found the people whom I met saying that when a free man marries a slave woman and then has intercourse with her, that man becomes muhsan.
Hadith 1114B2
قَالَ مَالِك : يُحْصِنُ الْعَبْدُ الْحُرَّةَ إِذَا مَسَّهَا بِنِكَاحٍ، وَلَا تُحْصِنُ الْحُرَّةُ الْعَبْدَ إِلَّا أَنْ يَعْتِقَ، وَهُوَ زَوْجُهَا، فَيَمَسَّهَا بَعْدَ عِتْقِهِ، فَإِنْ فَارَقَهَا قَبْلَ أَنْ يَعْتِقَ، فَلَيْسَ بِمُحْصَنٍ حَتَّى يَتَزَوَّجَ بَعْدَ عِتْقِهِ، وَيَمَسَّ امْرَأَتَهُ . ¤
Imam Malik, may Allah have mercy on him, said: If a slave marries a free woman and has intercourse with her, he will not become muhsan, but the woman will become muhsan. However, if the slave is set free and after his freedom he has intercourse with her, then the slave will become muhsan. And if before his freedom, the slave leaves that woman, he will not become muhsan until after his freedom he marries her again and has intercourse with her.
Hadith 1114B3
قَالَ مَالِك : وَالْأَمَةُ إِذَا كَانَتْ تَحْتَ الْحُرِّ ثُمَّ فَارَقَهَا قَبْلَ أَنْ تَعْتِقَ، فَإِنَّهُ لَا يُحْصِنُهَا نِكَاحُهُ إِيَّاهَا، وَهِيَ أَمَةٌ حَتَّى تُنْكَحَ بَعْدَ عِتْقِهَا، وَيُصِيبَهَا زَوْجُهَا، فَذَلِكَ إِحْصَانُهَا، وَالْأَمَةُ إِذَا كَانَتْ تَحْتَ الْحُرِّ فَتَعْتِقُ وَهِيَ تَحْتَهُ، قَبْلَ أَنْ يُفَارِقَهَا، فَإِنَّهُ يُحْصِنُهَا إِذَا عَتَقَتْ وَهِيَ عِنْدَهُ، إِذَا هُوَ أَصَابَهَا بَعْدَ أَنْ تَعْتِقَ ¤
Imam Malik, may Allah have mercy on him, said: If a slave woman is married to a free man, then her husband leaves her before she is freed, she will not be considered a muhsanah until she marries after being freed and consummates the marriage.
Hadith 1114B4
وَقَالَ مَالِك : وَالْحُرَّةُ النَّصْرَانِيَّةُ وَالْيَهُودِيَّةُ، وَالْأَمَةُ الْمُسْلِمَةُ، يُحْصِنَّ الْحُرَّ الْمُسْلِمَ إِذَا نَكَحَ إِحْدَاهُنَّ فَأَصَابَهَا ¤
Imam Malik, may Allah have mercy on him, said: If a slave woman is married to a free man and she is set free while still in his marriage, then she will become a muhsanah, provided that her husband has intercourse with her after her emancipation. Malik, may Allah have mercy on him, said: If a Christian, Jewish, or Muslim man marries a free woman and has intercourse with her, then he will become a muhsan.
