بَابُ مَا لَا يُجْمَعُ بَيْنَهُ مِنَ النِّسَاءِ
Women who cannot be joined in marriage
Hadith 1093
وَحَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ أَبِي الزِّنَادِ ، عَنِ الْأَعْرَجِ ، عَنْ أَبِي هُرَيْرَةَ ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ : " لَا يُجْمَعُ بَيْنَ الْمَرْأَةِ وَعَمَّتِهَا، وَلَا بَيْنَ الْمَرْأَةِ وَخَالَتِهَا "
It is narrated from Sayyiduna Abu Huraira (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Do not combine a paternal aunt and her niece, nor a maternal aunt and her niece (in marriage)."
Hadith 1094
وَحَدَّثَنِي، عَنْ مَالِك، عَنْ يَحْيَى بْنِ سَعِيدٍ ، عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ ، أَنَّهُ كَانَ يَقُولُ : " يُنْهَى أَنْ تُنْكَحَ الْمَرْأَةُ عَلَى عَمَّتِهَا، أَوْ عَلَى خَالَتِهَا، وَأَنْ يَطَأَ الرَّجُلُ وَلِيدَةً وَفِي بَطْنِهَا جَنِينٌ لِغَيْرِهِ "
Saeed bin Musayyib used to say: It is forbidden to marry a niece over her paternal aunt, and a niece over her maternal aunt, and it is forbidden to have intercourse with a slave woman who is pregnant by another man.
