Hadith 1077
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: "A previously married woman has more right over herself than her guardian, and the virgin's permission will be sought, and her permission is her silence."
Hadith 1078
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِكٍ، أَنَّهُ بَلَغَهُ، عَنْ
سَعِيدِ بْنِ الْمُسَيَّبِ ، أَنَّهُ قَالَ : قَالَ
عُمَرُ بْنُ الْخَطَّابِ :
" لَا تُنْكَحُ الْمَرْأَةُ إِلَّا بِإِذْنِ وَلِيِّهَا، أَوْ ذِي الرَّأْيِ مِنْ أَهْلِهَا، أَوِ السُّلْطَانِ "
It is narrated from Sa'id bin al-Musayyib that Sayyiduna Umar, may Allah be pleased with him, said: A woman should not be married except with the permission of her guardian, or with the permission of an intelligent person from her family, or with the permission of the ruler.
Hadith 1079
وَحَدَّثَنِي، عَنْ مَالِكٍ، أَنَّهُ بَلَغَهُ، أَنَّ الْقَاسِمَ بْنَ مُحَمَّدٍ، وَسَالِمَ بْنَ عَبْدِ اللَّهِ، " كَانَا يُنْكِحَانِ بَنَاتِهِمَا الْأَبْكَارَ، وَلَا " .
Hazrat Qasim bin Muhammad and Salim bin Abdullah used to marry off their virgin daughters, and they did not ask them.
Hadith 1079B1
قَالَ مَالِكٌ : وَذَلِكَ الْأَمْرُ عِنْدَنَا فِي نِكَاحِ الْأَبْكَارِ
Imam Malik, may Allah have mercy on him, said: In our view, the same ruling applies to virgin women.
Hadith 1079B2
قَالَ مَالِكٌ : وَلَيْسَ لِلْبِكْرِ جَوَازٌ فِي مَالِهَا، حَتَّى تَدْخُلَ بَيْتَهَا، وَيُعْرَفَ مِنْ حَالِهَا
Imam Malik, may Allah have mercy on him, said: A virgin does not have disposal over her wealth until she enters her husband's house and her condition becomes known.
Hadith 1080
وَحَدَّثَنِي، عَنْ مَالِكٍ، أَنَّهُ بَلَغَهُ، أَنَّ الْقَاسِمَ بْنَ مُحَمَّدٍ، وَسَالِمَ بْنَ عَبْدِ اللَّهِ، وَسُلَيْمَانَ بْنَ يَسَارٍ، كَانُوا يَقُولُونَ فِي الْبِكْرِ يُزَوِّجُهَا أَبُوهَا بِغَيْرِ إِذْنِهَا : " إِنَّ ذَلِكَ لَازِمٌ لَهَا "
Imam Malik (may Allah have mercy on him) was informed that Hazrat Qasim bin Muhammad, Salim bin Abdullah, and Sulaiman bin Yasar used to say: If a virgin woman’s marriage is contracted by her father without her permission, then her marriage becomes binding.
