بَابُ مَا جَاءَ فِي صَيْدِ الْبَحْرِ
Chapter on what is reported regarding seafood hunting
Hadith 1044
وَحَدَّثَنِي وَحَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ نَافِعٍ ، أَنَّ عَبْدَ الرَّحْمَنِ بْنَ أَبِي هُرَيْرَةَ سَأَلَ عَبْدَ اللَّهِ بْنَ عُمَرَ عَمَّا لَفَظَ الْبَحْرُ، " فَنَهَاهُ عَنْ أَكْلِهِ "، قَالَ نَافِعٌ : ثُمَّ انْقَلَبَ عَبْدُ اللَّهِ، فَدَعَا بِالْمُصْحَفِ، فَقَرَأَ : أُحِلَّ لَكُمْ صَيْدُ الْبَحْرِ وَطَعَامُهُ سورة المائدة آية 96، قَالَ نَافِعٌ : فَأَرْسَلَنِي عَبْدُ اللَّهِ بْنُ عُمَرَ إِلَى عَبْدِ الرَّحْمَنِ بْنِ أَبِي هُرَيْرَةَ، " إِنَّهُ لَا بَأْسَ بِأَكْلِهِ "
Nafi reports that Abdur Rahman bin Abi Hurairah asked Abdullah bin Umar (may Allah be pleased with them both) about an animal which the sea throws out, so Abdullah (may Allah be pleased with him) forbade eating it. Then Abdullah (may Allah be pleased with him) went home and asked for the Book of Allah, and read this verse: "Lawful to you is the game of the sea and its food." Nafi said: Then Abdullah bin Umar (may Allah be pleased with them both) sent me to Abdur Rahman bin Abi Hurairah to tell him that eating that animal is permissible.
Hadith 1045
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ زَيْدِ بْنِ أَسْلَمَ ، عَنْ سَعْدٍ الْجَارِيِّ مَوْلَى عُمَرَ بْنِ الْخَطَّابِ، أَنَّهُ قَالَ : سَأَلْتُ عَبْدَ اللَّهِ بْنَ عُمَرَ عَنِ الْحِيتَانِ يَقْتُلُ بَعْضُهَا بَعْضًا، أَوْ تَمُوتُ صَرَدًا، فَقَالَ : " لَيْسَ بِهَا بَأْسٌ "، قَالَ سَعْدٌ : ثُمَّ سَأَلْتُ عَبْدَ اللَّهِ بْنَ عَمْرِو بْنِ الْعَاصِ، فَقَالَ مِثْلَ ذَلِكَ
Hazrat Saad al-Jari, the freed slave of Sayyiduna Umar bin Khattab (may Allah be pleased with him), said: I asked Sayyiduna Abdullah bin Umar (may Allah be pleased with them): What about those fish that are killed by other fish or die due to cold? He said: Their consumption is permissible. Then I asked Sayyiduna Abdullah bin Amr bin al-As (may Allah be pleased with him), and he said the same.
Hadith 1046
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ أَبِي الزِّنَادِ ، عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ ، عَنْ أَبِي هُرَيْرَةَ ، وَزَيْدِ بْنِ ثَابِتٍ ، أَنَّهُمَا كَانَا " لَا يَرَيَانِ بِمَا لَفَظَ الْبَحْرُ بَأْسًا "
Sayyiduna Abu Huraira (may Allah be pleased with him) and Sayyiduna Zayd bin Thabit (may Allah be pleased with him) considered it permissible to eat the animal which the sea throws out.
Hadith 1047
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِك، عَنْ أَبِي الزِّنَادِ ، عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ ، أَنَّ نَاسًا مِنْ أَهْلِ الْجَارِ قَدِمُوا، فَسَأَلُوا مَرْوَانَ بْنَ الْحَكَمِ عَمَّا لَفَظَ الْبَحْرُ، فَقَالَ : لَيْسَ بِهِ بَأْسٌ، وَقَالَ : اذْهَبُوا إِلَى زَيْدِ بْنِ ثَابِتٍ، وَأَبِي هُرَيْرَةَ، فَاسْأَلُوهُمَا عَنْ ذَلِكَ، ثُمَّ ائْتُونِي فَأَخْبِرُونِي مَاذَا يَقُولَانِ ؟ فَأَتَوْهُمَا، فَسَأَلُوهُمَا، فَقَالَا : لَا بَأْسَ بِهِ . فَأَتَوْا مَرْوَانَ، فَأَخْبَرُوهُ، فَقَالَ مَرْوَانُ : قَدْ قُلْتُ لَكُمْ . قَالَ مَالِك : لَا بَأْسَ بِأَكْلِ الْحِيتَانِ يَصِيدُهَا الْمَجُوسِيُّ، لِأَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ فِي الْبَحْرِ : " هُوَ الطَّهُورُ، مَاؤُهُ الْحِلُّ مَيْتَتُهُ " . قَالَ مَالِكٌ : وَإِذَا أُكِلَ ذَلِكَ مَيْتًا، فَلَا يَضُرُّهُ مَنْ صَادَهُ
It is narrated from Hazrat Abu Salamah bin Abdur Rahman that some people from Jar (Jar is a place on the seashore near Madinah Munawwarah) came to Marwan and asked, "What is the ruling regarding an animal that the sea throws out?" Marwan said: "Its consumption is permissible, and you should go to Sayyiduna Zaid bin Thabit and Sayyiduna Abu Hurairah (may Allah be pleased with them both) and ask them, then come back and inform me what they say." They asked both of them, and both said: "It is permissible." Those people then came back and told Marwan, and Marwan said: "I had already told you so."
Imam Malik (may Allah have mercy on him) said: If a polytheist hunts fish, their consumption is permissible, because the Messenger of Allah (peace and blessings be upon him) said: "The water of the sea is pure, and its dead (animals) are lawful." When the dead of the sea is lawful, then if anyone hunts it, its consumption is permissible.
Imam Malik (may Allah have mercy on him) said: If a polytheist hunts fish, their consumption is permissible, because the Messenger of Allah (peace and blessings be upon him) said: "The water of the sea is pure, and its dead (animals) are lawful." When the dead of the sea is lawful, then if anyone hunts it, its consumption is permissible.
