بَابُ مَا جَاءَ فِي صَيْدِ الْمُعَلَّمَاتِ
Chapter on what is reported regarding hunting trained animals
Hadith 1041
وَحَدَّثَنِي وَحَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ نَافِعٍ ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ ، أَنَّهُ كَانَ يَقُولُ فِي الْكَلْبِ الْمُعَلَّمِ : " كُلْ مَا أَمْسَكَ عَلَيْكَ إِنْ قَتَلَ، وَإِنْ لَمْ يَقْتُلْ "
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) used to say that the prey caught by a trained dog is lawful to eat, whether the dog kills the prey or keeps it alive.
Hadith 1042
وَحَدَّثَنِي، عَنْ مَالِكٍ، عَمَّنْ سَمِعَ نَافِعًا ، يَقُولُ : قَالَ عَبْدُ اللَّهِ بْنُ عُمَرَ : وَإِنْ أَكَلَ، وَإِنْ لَمْ يَأْكُلْ
Sayyiduna Abdullah bin Umar (may Allah be pleased with them) says: Even if that dog eats something from the game, its meat is still permissible to eat.
Hadith 1043
وَحَدَّثَنِي، عَنْ وَحَدَّثَنِي، عَنْ مَالِكٍ، أَنَّهُ بَلَغَهُ، عَنْ سَعْدِ بْنِ أَبِي وَقَّاصٍ، أَنَّهُ سُئِلَ عَنِ الْكَلْبِ الْمُعَلَّمِ، إِذَا قَتَلَ الصَّيْدَ، فَقَالَ سَعْدٌ : " كُلْ، وَإِنْ لَمْ تَبْقَ إِلَّا بَضْعَةٌ وَاحِدَةٌ " . وَحَدَّثَنِي، عَنْ مَالِكٍ، أَنَّهُ سَمِعَ بَعْضَ أَهْلِ الْعِلْمِ يَقُولُونَ فِي الْبَازِي، وَالْعُقَابِ، وَالصَّقْرِ، وَمَا أَشْبَهَ ذَلِكَ : أَنَّهُ إِذَا كَانَ يَفْقَهُ كَمَا تَفْقَهُ الْكِلَابُ الْمُعَلَّمَةُ، فَلَا بَأْسَ بِأَكْلِ مَا قَتَلَتْ مِمَّا صَادَتْ، إِذَا ذُكِرَ اسْمُ اللَّهِ عَلَى إِرْسَالِهَا . قَالَ مَالِكٌ : وَأَحْسَنُ مَا سَمِعْتُ فِي الَّذِي يَتَخَلَّصُ الصَّيْدَ مِنْ مَخَالِبِ الْبَازِي، أَوْ مِنَ الْكَلْبِ، ثُمَّ يَتَرَبَّصُ بِهِ، فَيَمُوتُ، أَنَّهُ لَا يَحِلُّ أَكْلُهُ . قَالَ مَالِكٌ : وَكَذَلِكَ كُلُّ مَا قُدِرَ عَلَى ذَبْحِهِ، وَهُوَ فِي مَخَالِبِ الْبَازِي، أَوْ فِي الْكَلْبِ، فَيَتْرُكُهُ صَاحِبُهُ وَهُوَ قَادِرٌ عَلَى ذَبْحِهِ، حَتَّى يَقْتُلَهُ الْبَازِي أَوِ الْكَلْبُ، فَإِنَّهُ لَا يَحِلُّ أَكْلُهُ . قَالَ مَالِكٌ : وَكَذَلِكَ الَّذِي يَرْمِي الصَّيْدَ، فَيَنَالُهُ وَهُوَ حَيٌّ، فَيُفَرِّطُ فِي ذَبْحِهِ حَتَّى يَمُوتَ، فَإِنَّهُ لَا يَحِلُّ أَكْلُهُ . قَالَ مَالِك : الْأَمْرُ الْمُجْتَمَعُ عَلَيْهِ عِنْدَنَا، أَنَّ الْمُسْلِمَ إِذَا أَرْسَلَ كَلْبَ الْمَجُوسِيِّ الضَّارِيَ، فَصَادَ أَوْ قَتَلَ، إِنَّهُ إِذَا كَانَ مُعَلَّمًا فَأَكْلُ ذَلِكَ الصَّيْدِ، حَلَالٌ لَا بَأْسَ بِهِ، وَإِنْ لَمْ يُذَكِّهِ الْمُسْلِمُ، وَإِنَّمَا مَثَلُ ذَلِكَ مَثَلُ الْمُسْلِمِ، يَذْبَحُ بِشَفْرَةِ الْمَجُوسِيِّ، أَوْ يَرْمِي بِقَوْسِهِ أَوْ بِنَبْلِهِ، فَيَقْتُلُ بِهَا، فَصَيْدُهُ ذَلِكَ وَذَبِيحَتُهُ حَلَالٌ لَا بَأْسَ بِأَكْلِهِ، وَإِذَا أَرْسَلَ الْمَجُوسِيُّ كَلْبَ الْمُسْلِمِ الضَّارِيَ عَلَى صَيْدٍ، فَأَخَذَهُ، فَإِنَّهُ لَا يُؤْكَلُ ذَلِكَ الصَّيْدُ إِلَّا أَنْ يُذَكَّى، وَإِنَّمَا مَثَلُ ذَلِكَ مَثَلُ قَوْسِ الْمُسْلِمِ وَنَبْلِهِ، يَأْخُذُهَا الْمَجُوسِيُّ فَيَرْمِي بِهَا الصَّيْدَ، فَيَقْتُلُهُ، وَبِمَنْزِلَةِ شَفْرَةِ الْمُسْلِمِ يَذْبَحُ بِهَا الْمَجُوسِيُّ، فَلَا يَحِلُّ أَكْلُ شَيْءٍ مِنْ ذَلِكَ
Sayyiduna Sa’d bin Abi Waqqas (may Allah be pleased with him) was asked: If a trained dog kills the game and eats from it? Sayyiduna Sa’d (may Allah be pleased with him) said: Eat from it, whatever remains, even if it is only a single piece.
Imam Malik (may Allah have mercy on him) said: I have heard from the people of knowledge, they used to say that if a hawk, an eagle, a falcon, or any animal similar to them is trained and becomes intelligent, just as trained dogs become intelligent, then the animal killed by them is also permissible, provided that they are released with the name of Allah (Bismillah).
Imam Malik (may Allah have mercy on him) said: If the game escapes from the talon of the hawk or the mouth of the dog and then dies, its consumption is not permissible.
Imam Malik (may Allah have mercy on him) said: If a person becomes able to slaughter the animal but does not slaughter it, and leaves it in the talon of the hawk or the mouth of the dog until the hawk or dog kills it, then its consumption is not permissible. And he said: If in any way a person shoots an arrow at the game, then finds it alive and delays in slaughtering it until the animal dies, then its consumption is not permissible.
Imam Malik (may Allah have mercy on him) said: If a Muslim releases a dog trained by a polytheist on the game, and it goes and kills the game, then its consumption is permissible. Its example is like a Muslim slaughtering an animal with a polytheist’s knife, or hunting with his bow and arrow; then the consumption of that animal is permissible.
Imam Malik (may Allah have mercy on him) said: If a polytheist releases a dog trained by a Muslim on the game, then the consumption of that game is not permissible, just as if a polytheist slaughters an animal with a Muslim’s knife, or hunts with a Muslim’s bow and arrow, then its consumption is not permissible.
