بَابُ ذَكَاةِ مَا فِي بَطْنِ الذَّبِيحَةِ
Slaughtering what is in the womb of the slaughtered animal
Hadith 1036
حَدَّثَنِي حَدَّثَنِي يَحْيَى، عَنْ مَالِك، عَنْ نَافِعٍ ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ ، أَنَّهُ كَانَ يَقُولُ : " إِذَا نُحِرَتِ النَّاقَةُ، فَذَكَاةُ مَا فِي بَطْنِهَا فِي ذَكَاتِهَا، إِذَا كَانَ قَدْ تَمَّ خَلْقُهُ وَنَبَتَ شَعَرُهُ، فَإِذَا خَرَجَ مِنْ بَطْنِ أُمِّهِ، ذُبِحَ، حَتَّى يَخْرُجَ الدَّمُ مِنْ جَوْفِهِ "
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) used to say: When a she-camel is slaughtered, the fetus in her womb is also considered to have undergone proper slaughter, provided that all its limbs are fully formed and its hair has completely grown. If the fetus comes out of the womb alive, then it is necessary to slaughter it so that its blood may flow out from its body.
Hadith 1037
وَحَدَّثَنِي، عَنْ مَالِك، عَنْ يَزِيدَ بْنِ عَبْدِ اللَّهِ بْنِ قُسَيْطٍ اللَّيْثِيِّ ، عَنْ سَعِيدٍ بْنِ الْمُسَيَّبِ ، أَنَّهُ كَانَ يَقُولُ : " ذَكَاةُ مَا فِي بَطْنِ الذَّبِيحَةِ فِي ذَكَاةِ أُمِّهِ، إِذَا كَانَ قَدْ تَمَّ خَلْقُهُ، وَنَبَتَ شَعَرُهُ "
Saeed bin Musayyib used to say that the zakat of the fetus in the womb will be fulfilled by the zakat of its mother, when the fetus is fully formed and hair has appeared.
